ADDITIONAL CONDITIONS/INFORMATION ATTACHED TO LICENCE
FOR APPARATUS IN THE HIGHWAY
1. Signing and Guarding
The New Roads and Street Works Act 1991 makes it a legal requirement to comply with the Code of
Practice called "Safety at Street Works and Road Works", available from HMSO.
2. Reinstatement
a) The New Roads and Street Works Act 1991 makes it a legal requirement to reinstate the highway
according to the standards laid down in the Code of Practice called "Specification for the
Reinstatement of Openings in Highways", available from HMSO.
b) The reinstatement specification shall be in accordance with the road and surface types as specified
below.
3. Depth and Position of Apparatus
Ducts, pipes and other Apparatus shall have, generally, a minimum cover of 900mm (36") in the
carriageway and 600mm (24") in footways and verges. The decision of the Street Authority regarding
position and depth shall be binding on the Licensee.
4. Excavations Near Trees
When openings are to be made near or under the area covered by the branch spread of Highway or
Private trees, the line of the excavation and method of working must be approved by the Street
Authority before the work is commenced.
5. Highway Drainage and Other Apparatus
If the Licensee exposes a surface water drain or other highway apparatus or any other unidentified
apparatus during the course of the excavation, the Street Authority shall be notified before the trench is
back filled and there shall be no interference therewith without the permission of the Street Authority. If
damage is caused this must be reported to the Street Authority and the method of repair agreed and
inspected before any excavation is backfilled.
