Please note that Occupancy Fees are paid monthly in advance, or
alternatively by one or two advance instalments for the whole year.
Students with an Irish Guarantor can pay the Occupancy Fees via
advance monthly instalments. All students under 18 years old must have
an Irish Guarantor. Students without an Irish Guarantor must sign up to
the housing hand guarantor services.
2. GUARANTEE AND INDEMNITY
2.1 The Guarantor guarantees to the Licensor that the Licensee shall pay the
Occupancy Fees, initial payment, electricity charges (where applicable),
interest (where applicable) and any additional costs as set out in the
Licence and observe and perform the Licensee’s obligations as set out in
the Licence and if the Licensee fails to pay any of those Occupancy Fees
and/or fails to observe or perform any of the Tenant’s obligations, the
Guarantor shall pay and/or shall observe and perform them.
2.2 The Guarantor guarantees to the Licensor as a separate and
independent primary obligation to indemnify the Licensor against any
failure by the Licensee to pay any of the Occupancy Fees set out in the
Licence and any failure to observe or perform any of the Licensee’s
obligations under the Licence.
3. GUARANTOR’S LIABILITY
3.1 The liability of the Guarantor under paragraphs 2.1 and 2.2 shall
continue until the end of the contractual term as dened in the Licence
3.2 The liability of the Guarantor shall not be aected by:
(a) any time or other indulgence granted by the Licensor to the
Licensee; or
(b) any delay or forbearance by the Licensor in enforcing the payment
of any of the Occupancy Fees or the observance or performance of
any of the Licensor’s obligations under the Licence or in making any
demand in respect of any of them;
(c) any refusal by the Licensor to accept any Occupancy Fees or other
payment due under the Licence where the Licensor believes that
the acceptance of such Occupancy Fees or payment may prejudice its
ability to enter the Room, Studio or Apartment (as applicable) licensed
t
o the Licensee; or
(d) the Licensor exercising any right or remedy against the Licensee for
any failure to pay the Occupancy Fees set out in the Licence or to
observe or perform the Licensor’s obligations under the Licence
3.3 If the Guarantor is more than one person, the liability of each of the
persons making up the Guarantor is joint and several.
3.4 Any sum payable by the Guarantor shall be paid without any deduction,
set-o or counter-claim against the Licensor or the Licensee.
3.5 By signing this Agreement, the Guarantor hereby conrms that he/she is:
(a) resident in the Republic of Ireland; and
(b) in paid full-time employment; or
(c) retired and in receipt of a private pension
4. NOTICES
Any notices to be served on the Guarantor during or after the currency
of this Agreement shall be valid if posted or delivered to the home address
of the Guarantor as stated at the top of the rst page of this Agreement
(or any replacement address subsequently notied in writing to the
Licensor by the Guarantor). Any notices to be served on the Licensor
during or after the currency of this Agreement shall be valid if posted or
delivered to the address of the Licensor as stated at the top of the rst
page of this Agreement (or any replacement address subsequently
notied in writing by the Licensor to the Guarantor). In either case service
shall be deemed to have been eected on the day of delivery or (in the
case of posting) 2 working days after the date of posting.

1. DEFINITIONS
