Lutron Electronics Co., Inc. Vive Integral Fixture Control Five-Year Limited Warranty
In no event will Lutron or any other seller be liable or
responsible for any (i) consequential or special damages,
(ii) repair work undertaken without Lutron prior consent,
(iii) ancillary equipment not furnished by Lutron which is
attached to or used in connection with the Vive Integral
Fixture Control, all such equipment being expressly
excluded from this warranty, or (iv) damage to the Vive
Integral Fixture Control resulting from the use of ancillary
equipment not furnished by Lutron for use with the Vive
Integral Fixture Control.
This warranty provides specific legal rights. Other rights,
which vary from state to state, may exist. Some states
do not allow limitations on how long an implied warranty
lasts or the exclusion or limitation of incidental or
consequential damages, so the above limitations or
exclusions may not apply.

This shall serve as the baseline warranty unless
superceded by another agreement between the fixture
OEM and Lutron, e.g. OEM Advantage Program.
For a period of five years from the date of shipment by
Lutron, Lutron warrants each new Vive Integral Fixture
Control to be free from manufacturing defects. Lutron
will, at its option, repair or provide a comparable
replacement for any defective Vive Integral Fixture
Control that, in the opinion of Lutron, has been installed
and operated pursuant to Lutron product specifications,
including installation in accordance with all instructions,
specification submittals and application notes and
performing all prescribed engineering and manufacturing
tests, and including operating below the maximum-rated
operating temperature Tc = 70 °C for DFC-OEM-DBI and
Tmax = 55 °C for DFCSJ-OEM-OCC and DFCSJ-OEM-
RF so long as Lutron is promptly notified of the defect
within the five-year warranty period and, if requested by
Lutron, the Vive Integral Fixture Control is returned to
Lutron.
Warranty is void if:
1. The fixture manufacturer does not follow the installation
instructions, the specification submittals, and all
applicable application notes.
2. The product is modified, disassembled or tampered with
in any way.
This warranty is in lieu of all other express warranties and
all implied warranties, including implied warranties of
merchantability and of fitness for a particular purpose.
This warranty does not cover: the cost of installation,
removal or reinstallation; damage resulting from misuse,
abuse, or improper or incorrect repair; damage from
improper wiring or installation; or incidental or
consequential damages. Lutron liability on any claim for
damages arising out of or relating to the manufacture,
sale, installation, delivery, or use of the Vive Integral
Fixture Control is limited to the purchase price of the
Vive Integral Fixture Control.
No Lutron agent, employee or representative has any
authority to bind Lutron to any affirmation, representation
or warranty concerning the Vive Integral Fixture Control.
Unless an affirmation, representation or warranty made
by an agent, employee or representative is specifically
included herein, or in standard printed materials provided
by Lutron, it does not form a part of the basis of any
bargain between Lutron and customer and will not in any
way be enforceable by customer.

En aucun cas, Lutron ou tout autre vendeur ne sera tenu
responsable (i) des dommages indirects ou spéciaux, (ii)

Cette garantie accorde des droits spécifiques et
éventuellement certains autres selon les états. Certains
pays n’autorisent pas la restriction de la durée d’une
garantie implicite ou l’exclusion ou la limitation des
dommages fortuits ou consécutifs, par conséquent la
limitation ou l’exclusion ci-dessus sont susceptibles ne
pas s’appliquer.

Pendant cinq ans à partir de la date d’expédition par
Lutron, Lutron garantit chaque nouvelle interface de
liaison numérique contre les défauts de fabrication. À sa
discrétion, Lutron réparera ou remplacera par un modèle
comparable tout système de commande de luminaire
intégrale Vive installé et utilisé, de l’avis de Lutron,
conformément aux spécifications du produit de Lutron, y
compris une installation conforme aux instructions,
propositions de spécifications et aux notes d’application
ainsi que l’exécution de tous les contrôles techniques et
de fabrication prescrits, et également l’utilisation à une
température inférieure à la température nominale
maximale Te=70 °C pour DFC-OEM-DBI et Tmax=55 °C
pour DFCSJ-OEM-OCC et DFCSJ-OEM-RF du moment
que Lutron est promptement informé du défaut dans la
période de garantie de cinq ans et, à la demande de
Lutron, la commande de luminaire intégrale Vive sera
renvoyée à Lutron.
La garantie est nulle si:
1. Le fabricant de luminaire ne respecte pas les instructions
d’installation, les propositions de spécifications et toutes
les notes d’application applicables.
2. Le produit a été modifié, démonté ou altéré de quelque
manière que ce soit.
Cette garantie remplace toutes les garanties expresses et
implicites, y compris les garanties implicites de qualité
marchande et d’adéquation à un usage particulier. Cette
garantie ne couvre pas le coût d’installation, de retrait ou de
réinstallation, les dommages résultant d’une mauvaise
utilisation, d’abus, de mauvaises réparations, de réparations
incorrectes, les dommages dus à un câblage ou une
installation incorrecte, ni les dommages accessoires ou
indirects. La responsabilité de Lutron quant à toute
réclamation pour des dommages découlant de ou en
rapport avec la fabrication, la vente, l’installation, la livraison
ou l’utilisation de la commande de luminaire intégrée Vive
est limitée au prix d’achat de la commande de luminaire
intégrée Vive.
Aucun agent employé ou représentant de Lutron ne dispose
du pouvoir d’engager Lutron par une affirmation, une
représentation ou une garantie concernant la commande de
luminaire intégrée Vive. Sauf si une affirmation, une
représentation ou une garantie faite par un agent, un employé
ou un représentant est spécifiquement incluse ci-après, ou
dans la documentation standard imprimée fournie par Lutron,
elle ne forme pas la base d’une négociation entre Lutron et le
client et ne sera aucunement applicable par le client.
