Historical Divorce Fees (Reduced Fee)
2016-17, 2017-18 and 2018-19 financial years
Important note
Court users who paid a filing fee for an application for a divorce order, which was reduced by reason of financial
hardship, in the 2016-17, 2017-18 and 2019-20 financial years are eligible for a $5.00 refund.
Rounding rules were incorrectly applied to the indexation of a subset of filing fees for an application for a divorce order
under the Family Law (Fees) Regulation 2012 in the 2016-17, 2017-18 and 2019-20 financial years. This led to a small
overcharge of $5.00 per applicant who paid the filing fee reduced by reason of financial hardship.
To apply for a $5.00 refund, you are required to complete this “Historical Fee Refundform and email the form to
historicalfeerefunds@justice.wa.gov.au.

Privacy Collection Notice
To determine your eligibility for a $5.00 refund, the Family Court of Western Australia (FCWA) needs to verify that you
have paid a reduced filing fee for an application for a divorce order in 2016-17, 2017-18 or 2019-20.
To do this, FCWA will ask you to provide:
your current name and your name prior to your divorce
your current address and your address prior to your divorce
your date of birth
your current email address
the court file number of your divorce proceeding (included in email or SMS)
the month and year that you filed your application for a divorce order
The refund of $5.00 will be paid by direct deposit to your bank account. The FCWA will ask you to provide your
nominated Australian bank account details so that the refund can be electronically transferred. This process is secure.
The FCWA will only use your personal information for the purpose of verifying your refund claim.
If you do not provide the requested information, the FCWA will be unable to verify your eligibility for a $5.00 refund, and
you will not receive a refund.
