If this requirement cannot be satised, a Development Application may be required

Note. Tree removal associated with a Complying Development application must be
accompanied by a detailed site plan showing proposed development.
p.6
1. Trees on site must be identied with ribbon and non injurious and/or non-permanent marking. Number each
tree to correspond with site plan, to assist with identication at site inspection.
2. You may be required to provide supporting documentation and supporting photographs (if appropriate) from
a qualied and practicing professional (e.g consulting arborist, structural engineer, plumber etc.) who can
validate any claim of substantial damage resulting from trees which are the subject of this application.
What is ‘substantial damage’ caused by a tree? Substantial damage refers to the following:
Damage to an approved building built on approved foundations, in-ground swimming pool or slab driveway; where it is clearly
demonstrated that tree roots are the sole cause of damage sustained and that remediation may only be achieved by the
removal of the tree.
It may include damage caused by falling branches to the roof of a building requiring replacement of the framework of the roof.
Substantial damage does not include the following:
Damage to these structures that may be remedied by pruning the tree and carrying out minor repairs to the damaged
structure.
Damage to footpaths, twin-strip driveways, retaining walls, above ground pools, roof tiles, car ports or buildings on stump,
pillar or pole foundations.
Note: Removal of trees for damage to sewer pipes/built structures will not be approved unless it can be
demonstrated to Council that all engineering alternatives have been investigated and have not been found
feasible.
3. All tree pruning is to be undertaken in accordance with Standards Australia Pruning of Amenity Trees
AS 4373-2007.· Tree removal and pruning processes must not result in damage to any part of retained
trees.
4. Further information on Tree Management is available from Council’s website www.bmcc.nsw.gov.au
