(1)AlandlordofpremisestowhichthisPartapplies[allresidentiallettings]shallbynoticefurnish
thetenantwithanaddressinEnglandandWalesatwhichnotices(includingnoticesinproceedings)
maybeservedonhimbythetenant.
(2)Wherealandlordofanysuchpremisesfailsto
complywithsubsection(1),anyrentorservice
chargeotherwiseduefromthetenanttothelandlordshall(subjecttosubsection3below)be
treatedforallpurposesasnotbeingduefromthetenanttothelandlordatanytimebeforethe
landlorddoescomplywiththatsubsection.

Anysuchrentorservicechargeshallnotbesotreatedinrelationtoanytimewhen,byvirtueof
anorderofanycourt,thereisin forceanappointmentofareceiverormanagerwhosefunctions
includethereceivingofrentor(asthecasemaybe)servicecharges
fromthetenant.
Allthismeansthatifyourtenanthasnotbeengivenapostaladdress(NOTaPObox)inEnglandand
Walesatwhichnoticesfromthetenanttothelandlordcanbeserved,thelandlordcannotenforce
paymentofrent,rentarrearsorservicechargesthrough
thecourts.
Thissituationcanberemediedsimplybyservingthes48noticebeforeanycourtactiontorecover
rentorservicecharges;otherwisethetenantwillhaveavaliddefence.
Theaddressdoesnothavetobethelandlord’shomeaddress.Itcanbeabusinessaddress,the
landlord’s
solicitor’saddressorthelettingagent’saddress.Itcouldalsobetheaddressofafriendor
relative,ifforexamplethelandlordlivesabroad.
Itisusualforthesection48noticetobecompliedwithinthetenancyagreementitself.Caselaw
nowexistswhichallowsanaddressin
England&Walesgivenforthelandlord(oragent)in the
tenancyagreement,andthisdoesnotneedtosayspecificallythatitisasection48notice.
It’simportantthereforetomakesureyourtenancyagreementsincludeanaddre s s forserviceof
notices,meaningthatthes48wouldonly
beneedediftheaddressforservicechangesatalaterdate
orthepropertyissoldandtakenoverbyanotherlandlord.
Inadditiontomeetingtherequirem entsofs48,tenancyagreementsshouldset‐outarrangements
forservingnoticesonthetenant–thiswillspecifywhenanoticeis
deemedtohavebeenserved.
Thebestmethodofserviceispersonalserviceonthetenant,orfailingthatdeliveringitthroughthe
letterboxoftherentalproperty(haveawitness)ordeliverybyfirstclasspost(getproofofpostage
fromapostoffice).
Itisnota
goodideatosendlettersbyrecordedorspecialdeliveryasthetenantmaybeoutor
refusetosign,inwhichcasethenoticewillnotgetdeliveredandmaybereturnedtosender.
