Request to Rescind Step-Parent Adoption
Per 710.66 of the Michigan Adoption Code – “If an adult adoptee who was adopted by a
stepparent and the adult adoptee’s parent whose rights have been terminated desire to rescind the
adoption by the stepparent and restore the parental rights of that parent (the biological parent),
they shall file a rescission petition with the court of the county in which the adoption by the
stepparent was confirmed.”
Required documentation to begin the process of rescinding your stepparent adoption are:
• The completed Petition for Rescission of Adoption and Order (PCA 349)
– enclosed/attached.
• $160.00 filing fee – Money Order – made payable to the “Wayne County
Clerk”. Personal checks and cash are not accepted.
• A copy of both parties photo identification (adult adoptee, as well as, the
biological parent whose parental rights were terminated).
• A copy of your adoptive birth certificate
Please mail the documents listed above to the Third Judicial Circuit Court, Family
Division, 1025 E. Forest Avenue, Detroit, MI 48207-1098, Attention: Post Adoptions.
Once the above documentation is received a Court Hearing will be scheduled and all
interested parties will receive notice of the scheduled hearing.
Should the Court grant your request, a copy of the Court’s order will then be forwarded
to the department of public health to release the original birth certificate.
