INSTRUCTION SHEET FOR DELAYED REGISTRATION OF
FOREIGN BIRTH ESTABLISHED BY COURT ORDER
PA 242 of 1994, MCL 333.2830, established a procedure that allows for the creation of a Michigan birth
certificate for children adopted in a foreign country by Michigan resident parents. The process starts at the
Circuit Court, Family Division in the county where the family resides.
In order to process your request for a Delayed Registration of Foreign Birth Established by Court Order, an
appointment must be scheduled at The Third Judicial Circuit Court, Family Division, Adoptions Unit. To
schedule an appointment, please call (313) 833-1880. Each parent that joined in the adoption must be present at
the appointment. Please note that if you are more than 15 minutes late for the scheduled appointment, another
appointment will be needed. Be sure to bring the following documentation and information with you to the
scheduled appointment:
Copies of the original adoption documents must be provided, including the adoption order and birth certificate.
English translations must be provided, if documentation is in a foreign language.
A copy of the child’s passport with picture and IR-3 or IR-4* stamp.
The attached “Motion and Order for Delayed Registration of Foreign Birth.” This document should be completed
prior to the scheduled appointment.
The attached “Application for Delayed Registration of Foreign Birth.” This document should be completed prior
to the scheduled appointment.
If the adoptee(s) date of birth was not established in the foreign country or it is found to be incorrect, The Third
Judicial Circuit of Michigan, Family Division will be able to establish a date of birth with sufficient evidence.
If you wish to change the child’s adopted name to something other than what is shown on the adoption decree, a
letter must be submitted at the time of the appointment indicating what the new adopted name will be. Both
petitioners must sign the letter, if applicable.
A filing fee of $160.00 payable to “Wayne County Clerk” is required. Personal checks will not be accepted,
please secure filing fee in the form of a Money Order or Cash for this fee.
The Michigan Department of Community Health charges $50.00 for the processing of the Delayed Registration of
Foreign Birth Established by Court Order. Additional copies may be purchased for $16.00. This fee should be
submitted at the time of the appointment, for prompt processing. Please secure this fee in the form of a
Personal Check or Money Order payable to the “State of Michigan”. Cash will not be accepted.
* On February 27, 2001 the Child Citizenship Act of 2000 was established. This act allows children that were
previously adopted in a foreign country to become citizens of the United States upon their entry into the United
States. This applies to those children that have received an IR-3 visa. The act also applies to children that have
received an IR-4 visa, as long as a full, final adoption was completed in a foreign country and the validity of the
adoption is recognized by the competent authority in their place of residence in the United States. The State of
Michigan and the Michigan Adoption Code (710.21b) recognize foreign adoptions as being valid.
However, if a child entered the United States with an IR-4 visa prior to February 27, 2001, a Re-Adoption must
occur. Please contact the Third Judicial Circuit Court, Family Division, Adoptions Unit at (313) 833-1880 to
schedule an appointment for Re-Adoption.
