General Information
This form is for applying for a Temporary Fireworks Stand (TFS) Permit. A TFS Permit is a temporary
Location/Conformance Permit valid for the time period between June 1
st
through July 31
st
and December 29
th
through
December 31
st
for the year the permit was issued. For each tract of land that will be utilized for a TFS, a TFS Permit will
be required. For permitted TFS operations: (1) no TFS stand shall be located, erected or constructed on an acceptable
premise prior to June 1
st
of the year for the June 24
th
through July 5
th
selling period and must be removed by July 31
st
of
the same year, and (2) no TFS stand shall be located, erected or constructed on an acceptable premise prior to
December 6th
st
of the year for the December 29
th
through December 31
st
selling period and must be removed by
January 15t of the next year. Signage associated with a TFS shall be permitted by the granting of a TFS Permit and shall
be subject to the provisions of Section 8.14 of the Cascade County Zoning Regulations.

Compliance Requirements
TFS Permit applications shall be submitted to the Cascade County Planning Office for review and shall require a site
inspection as a part of the review process. The following checklist must be reviewed and completed by the applicant
before the application can be reviewed.
I acknowledge that all persons or legal entities engaged in the sale of fireworks in Cascade County must
prominently display their permit at the premises where fireworks are sold.
I acknowledge that all persons engaged in the sale of fireworks are prohibited from smoking within fifty (50)
feet from any fireworks stand.

One unobstructed exit for each stand 30 feet or less is provided. Two unobstructed exits for stands longer than
thirty (30) feet are provided.
One two-gallon pressurized water extinguisher (or equivalent) or charged garden hose is inside each stand less
than thirty (30) feet. Two two-gallon pressurized water extinguishers (or equivalent) or charged garden hoses
are inside each stand greater than thirty (30) feet in length.
No person under the age of eighteen (18) years of age will be engaged in the sale of fireworks.
A sign reading “NO SMOKING” is posted in letters at least four (4) inches in height where customers are most
likely to read it.
The premises used for the sale of fireworks meets the following locational requirements:
Located at least 300 feet from any worship facility, hospital, or educational facility.
Located at least 150 feet from any flammable liquid dispensing device or installation.
Located at least 150 feet from any residential dwelling unit.
Located at least 30 feet from any public roadway.
Located at least 50 feet from any non-residential structure.
All weeds, dry grass and combustible materials have been and shall remain cleared within 25 feet of any
premises used for the sale of fireworks.
Electrical wiring is in safe condition.
Fireworks will be displayed out of reach of members of the public.
Permission from landowner has been obtained (if applicant is not the owner of the property).
The location of each TFS meets the following setback requirements:
A front yard of at least 30 feet.
A rear yard of at least 30 feet
Side yards of at least 10 feet.
A minimum nine (9) feet width by eighteen (18) feet depth parking space is provided with a minimum of five (5)
parking spaces (the required front yard may be used for off-street parking).
A site plan prepared at a scale not less than one inch equals one-hundred feet (1” = 100’) containing the
following is attached:
Existing structures and proposed locations for each temporary fireworks stand and required setbacks.
Location and dimensions of the proposed off-street parking.
Land uses of surrounding properties within 300 feet.
Certification and Acknowledgement
The above-named applicant acknowledges reading and understanding the permit rules and restrictions for the sale of
fireworks within Cascade County, Montana. Applicant represents that he will abide by the same for the location,
construction and/or use of the fireworks stand(s).
Applicant further understands that a condition of the granting of this permit is the inspection and approval of the above-
described fireworks stand by an authorized agent of Cascade County, according to the rules and regulations provided
herein and pursuant to Section 8.14 of the Cascade County Zoning Regulations. Applicant acknowledges that failure to
maintain compliance may result in the revocation of an issued TFS Permit.
