Please refer to Part 2 of the Solid Waste Bylaw 2010 and Section 3 of the Bylaw Terms and
Conditions for the full regulations pertaining to Licensing of Waste Handling Facilities and
Waste Operators.
DEFINITIONS
WASTE HANDLING FACILITY means a place or facility carrying out a Waste Operation
licensed under this bylaw and includes, but is not limited to, landfill sites, cleanfill sites,
commercial composting facilities, recovery operations, transfer stations, tips, Recycling centres,
transfer points, waste pads, transportation points or waste consolidation points.
WASTE OPERATOR means the Person in control of a Waste Operation.
WASTE OPERATION means any operation which removes, collects, Handles, sorts, transports
or disposes of Waste and has a Waste input or output of more than:
(a) 30 tonnes of Waste per annum if the Waste Operator is not required to hold an
Offensive Trades Licence; or
(b) 10 tonnes of Waste per annum if the Waste Operator is required to hold an Offensive
Trades Licence.
Waste Operators and operators of Waste Handling Facilities shall apply for the relevant
Licence on the Waste Licence Application Form overleaf.
Waste Operators shall provide such supporting information as the Council may require to
enable further processing of the application, including but not limited to:
• A description of the company’s waste collection operations.
• Details of the areas currently being serviced by the company.
• Details of the vehicles in use and the registration numbers and name or names of the
drivers.
• Details with regard to where the waste is being disposed of.
• Details with regard to the company’s policy should it become known that the waste
being collected or handled is of a hazardous, toxic or non-compliant nature.
• Details of the company’s base of operation and location for the storage and cleaning of
vehicles and equipment.
Operators of Waste Handling Facilities shall provide such supporting information as the
Council may require to enable further processing of the application, including but not limited to:
• A description of the company’s waste handling operations, including hours of operation,
staffing levels, type of materials handled, and anticipated quantities of the separate
waste types to be handled.
• Details of the vehicles in use and the registration numbers and name or names of the
drivers.
• Details with regard to where the waste will be or is being disposed of.
• Details with regard to the company’s policy should it become known that the waste
being handled is of a hazardous, toxic or non-compliant nature.
