Developer’s Guidance Notes Small Scale Section 278
General Guidance
Schemes vary in complexity and it is not possible to accurately predict a timescale for approval. The
Council’s service response standard is to provide an initial technical response within 4 weeks of validation;
however, we endeavour to respond before this time where possible.
Completion of the short form licence does not constitute permission / authority to commence works
immediately thereafter. Works within the public highway must not commence until the licence is in place
and all pre-commencement clauses discharged.
Due to the risk of abortive work, the Council will not normally process an application for a Small Scale
S278 Licence before Full or Reserved Matters Planning Approval has been issued and all relevant pre-
commencement conditions discharged. Evidence of such approval/discharges must accompany the
application. However, if the LHA is reasonably confident that planning permission is imminent and that no
changes to the layout will be made, the Council may at the discretion of the Highway Control Team
Manager, accept the application. Fees in this scenario are NON-REFUNDABLE and will be credited to the
Final Licence Fee (if applicable) if and when a Short Form S278 Licence is completed. In the event that
planning consent is not forthcoming for the submitted layout; and the layout changes, a new application
with all relevant fees will be required.
PCC ERCS is the Peterborough City Council Estate Road Construction Specification.
Notes
1. Planning Approval Conditions Precedent
The Local Planning Authority (LPA) may attach conditions precedent which have the potential to alter
the layout or otherwise impact upon it, e.g. conditions specifying certain access geometry dimensions,
conditions relating to hard and/or soft landscaping schemes etc. Copy of confirmation from the LPA
that all conditions have been discharged including copies of plans submitted to discharge said
condition must also be supplied with this application. If such a condition is breached, it may render
the whole development unlawful; i.e. without planning permission. Please note that the submission
of technical details direct to the Local Highway Authority (LHA) with a Small Scale S278 application
does not constitute an application to the LPA to discharge a planning condition. Any such application
to discharge a planning condition must be made formally and independently to the LPA.
2. Correspondence
Where a Developer uses an agent or consultant to act on its behalf, all correspondence from the
Highway Control Team will go direct to the agent/consultant and will be copied to the Developer.
3. Licence Fee
A non-refundable Licence Fee is charged by the LHA in respect of all Small Scale S278 applications.
a. The Licence Fee is calculated at 8% of the Works Value or £3,000 minimum.
b. An invoice will be raised for the initial fee ‘Part 1 Licence Fee’ upon receipt of the application,
which will be a minimum of £3,000 or 50% of the LHA’s estimated works value (whichever is
less). The application will not be validated until this invoice is paid.
c. If applicable, an invoice will be raised for the second fee ‘Part 2 Licence Fee’ upon technical
approval for the balance of the fee if the full licence fee is calculated to be more than £3,000.
The Licence will not be completed until this invoice is paid.
d. If any of the plans are amended by the developer other than at the request of the LHA,
additional fee’s will be charged at a rate of £500 per amendment.
e. If the Licence is not completed within 1 month of technical approval, an additional fee may
be charged and the Security Deposit amount reviewed.

4. Security Deposit
A Security Deposit is required before the Licence is signed and completed, which is equivalent to the
council’s estimated cost of works plus the value of any Commuted Maintenance Sum. The council's
estimated cost of works is based upon the tender sum for the works, plus the cost of any Stats works,
plus 10% contingency.
5. Commuted Sums
Commuted Sums to cover the costs of future maintenance will be required (in accordance with
Paragraph 1.2 of the current PCC ERCS) in respect of certain elements of infrastructure. For details
please refer to Appendix H of the current PCC ERCS.
6. Design CBR
All construction designs will be assessed upon a design CBR of <2%, unless a site specific Ground
Investigation Report is provided with the application. The following notation should be added to the
Sub-base details ‘On site testing is to be carried out in accordance with Chapter 6 of the Peterborough
City Council Estate Road Construction Specification, and the results shared and agreed by the PCC
Engineer’.
7. Pre-condition Survey
The scope of the pre-condition survey is such as to record all aspects of the condition of the surface
of the existing highway comprising carriageways, footways, footpaths, cycleways and verges together
with the positions of highway boundaries over any lengths of the existing public highway that may be
affected by the implementation of the development in accordance with Clause 2.9.2 of the current
PCC ERCS. The report must include a plan showing where the photos were taken. The purpose of
the survey is to protect the Developer and their contractor and provide reliable evidence to resolve
any disputes in respect of damage to or encroachment upon the public highway post development.
8. Swept Path Analysis
Swept Path Analysis (if not already approved as part of planning consent) - This will be a 16.5m HGV
on industrial / distributor roads or a PCC refuse collection vehicle (10.5m length) for residential
developments. Full details of the vehicle used in the swept path analysis are also required. If the
scheme includes a bus route, a bus should also be shown. Movements must be shown exiting in both
directions and entering from both directions (whilst a stationary vehicle is shown waiting to exit).
9. Plan Criteria
The scale on the submitted plans should be appropriate for the detail shown, but generally 1:100
1:200 scale should be used for block plan details. It is imperative that drawings have the following
note clearly displayed: ALL WORKS MUST BE CONSTRUCTED IN ACCORDANCE WITH THE
CURRENT PETERBOROUGH CITY COUNCIL ESTATE ROAD CONSTRUCTION
SPECIFICATION.
10. Plan 1 - Location Plan
This plan must be of an appropriate scale and extent to identify the development site of which the
highway works relate to and include surrounding street names. It should be based upon a current
ordnance survey plan and it is recommended that the scale of choice be 1:1250 although it is
recognised that for some more rural areas, 1:2500 may be all that is readily available. This plan should
show a thin ‘red outline’ of the site boundary as per the approved planning location plan, and should
be titled ‘Plan 1 Location Plan’. This plan will be appended to the Licence and following technical
approval we will require 4 hard copies.
11. Plan 2 Extent of Works
This plan will be based on the site layout plan and must include a purple outline including a 2m margin
either end of the works and over to the opposite highway boundary to delineate the potential extent
of works within the public highway. It will be titled ‘Plan 2 – Extent of Works’ and will be appended to
the Licence. The works will need to be coloured in accordance with the colour schedule overleaf.

12. Electronic plans
Upon technical approval an electronic copy of the approved plans will be required in addition to the hard
copy plans.

Details to be kept to a minimum on the Coloured Section 38 drawing, all underlying existing details to be removed
from the drawing.
Heavy Duty Vehicle Crossings need to be identified
Signage and Road Markings also need to be shown.
Existing street furniture that is to be removed or relocated to be shown using the appropriate symbol from the list
above, with an X through it.
It is imperative that drawings have the following note clearly displayed: ALL WORKS MUST BE CONSTRUCTED
IN ACCORDANCE WITH THE PETERBOROUGH CITY COUNCIL: ESTATE ROAD CONSTRUCTION
SPECIFICATION 2012”.

13. Section 278 Short Form Pre-commencement Clauses
a. All pre-commencement clauses within the Small Scale S278 Licence must be discharged prior to
commencement on site. These include:-
b. Provision of copies of Street Works Licences for all operatives expected to work within the existing
public highway.
c. Provision of contractor / subcontractor details including public liability for a minimum of £10M.
d. Approval of highway works programme. A minimum of 10 working days must be allowed for
approval of the programme.
e. Confirmation that Road Space has been booked and approved, which will include the assessment and
approval of the Temporary Traffic Management Plan. To book Road Space with the Council’s Street
Works Coordinator please email streetworks@peterborough.gov.uk.
14. Highway Assessment
In accordance with Clause 2.2.3 of the current PCC ERCS a Highway Assessment will be submitted including
details of the full depth of carriageway make up from the subgrade level (achieved through core samples
and laboratory testing). This report will allow the Designer in consultation with the Case Officer to evaluate
the existing carriageway to determine if it is appropriate to accommodate the proposed development and
what type of tie-in arrangement is suitable. For instance if a new junction is formed the existing carriageway
may require improvement to withstand the additional loading and stresses that will be transferred through
turning movements, additional volume of commercial vehicles, and the introduction of new breaking and
acceleration zones. All off site highway works must be designed to accommodate the additional traffic
generated, considering both the construction phases and the design life of the carriageway. All associated
utility connections and other disruptions to the carriageway must be considered as these will have an
adverse effect on the integrity of the carriageway. The case officer will require all of the above to be
determined prior to issuing technical approval of any scheme.
15. Street Lighting
If the proposal includes a single replacement street lighting column in a slightly different location, please
contact the Highway Control Team to discuss what plans/documents are necessary. If the proposal is for
more than this, please refer to and submit Section K (only) of the main Road Adoption Application Form.
16. Statutory Undertakers Works
For validation: A preliminary estimate of the cost of any necessary stats works, including the diversion,
lowering, protection of existing stats equipment resulting from the highway works. Drawings from the Stats
Companies detailing their existing equipment in the vicinity of the highway works.
For technical approval: Information from each Statutory Undertaker detailing the location of any existing
equipment in the vicinity of the site which may be affected by the highways works. Information from each
Statutory Undertaker either detailing the necessary works to their equipment, resulting from the highways
works (i.e. diversion, lowering, protection) or confirmation that no works are required to their equipment as
a result of the highway works. Information from each Statutory Undertaker detailing the cost of carrying out
the works to their equipment. This is required to enable the calculation of the security deposit and commuted
sums and from that the agreement fee.
