GUEST SPEAKER/PERFORMER/EXPERT
AGREEMENT
This Agreement is entered into as of _____, day of _____________________, 20____, between Anne Arundel
Community College, c/o ___________________________, 101 College Parkway, Arnold, Maryland 21012-1895 -
Phone # _______________________ (the College), and _____________________________________, (the Guest).
Subject to the terms and conditions of this Agreement, the College hereby engages the Guest as an independent
contractor to perform the services set forth herein, and the Guest hereby accepts such engagement.

2. Relationship Between Parties: This Agreement shall not render the Guest an employee, partner, agent of, or
joint venture with the College for any purpose. The Guest is and will remain an independent contract in their
relationship to the College and is required to pay Federal and State taxes, and may receive a 1099
Miscellaneous from the College. The College shall not be responsible for withholding taxes with respect to the
Guest’s compensation hereunder. The Guest shall have no claim against the College hereunder or otherwise for
vacation pay, sick leave, retirement benefits, social security, workers’ compensation, health or disability
benefits, unemployment insurance benefits, or employee benefits of any kind. The Guest shall be responsible
for expenses related to any injury or malady occurring during the period of this Agreement.
Each party represents and warrants to the other party that is has full right and power to enter into this
Agreement.
The Guest understands that they are not an agent of the College and shall not imply or express to the public to
be an agent of the College.
3. Schedule: This Agreement shall cover the duties outlined in Section 1. Performed by the Guest on
In the event that the performance of any of the covenants of this agreement is prevented by any cause beyond
the reasonable control of the College or the Guest, both the College and Guest shall be relieved of their
obligations hereunder with respect to this engagement. Both parties shall make every effort to reschedule the
engagement when possible.
4. Financial Responsibility: The Guest will receive a total of $____________ dollars as fees for the services
provided to the College.
The fees shall be paid within __________ (10, 15 or 30) days after the date of performance.
Payment shall be made by College check or other reasonable method determined by the College. The
check/payment is to be made payable to the individual designated as the Guest as listed on this Agreement.
It is understood and agreed between the College and the Guest that payment of the compensation specified
in this Agreement, its continuation or any renewal thereof, is dependent upon and subject to the allocation
of funds for the purpose set forth in this Agreement. At the time that this Agreement is made, appropriate
funds have been allocated to compensate the Guest for the fees described herein.
5. Choice of Law: The laws of the State of Maryland shall govern the validity of this Agreement, the
construction of its terms and the interpretation of the rights and duties of the parties hereto.
6. College Policies: Guest Speakers are subject to all college behavior polices including title IX (non-
discrimination) requirements which are incorporated herein and made a part hereof.
7. Background Investigation Policy: As a condition of this Agreement, all Guest
Speakers/Performers/Experts who will be working on any College campus (this includes attending
meetings), may be asked to provide proof of a successful background investigation checks. This
investigation shall include, but is not limited to, verification of credentials, criminal history, and driving
records (as appropriate). The College reserves the right to request documentation from the Guest

peaker/Performer/Artist for proof of their ability to work in the United States.
8. Modification of Agreement: This Agreement and any documents incorporated specifically by references
represent the entire agreement between the parties and suspend all prior verbal or written statements or
agreements. This Agreement may be amended only by written amendments duly executed by the Guest
and the College.
9. Indemnification: The Guest shall indemnify and hold harmless the College, its trustees, employees, and
agents for any claim, including legal expenses to defend same that may be brought against such parties for
acts of the Guest. The College at its discretion may require the Guest carry liability insurance (including
malpractice insurance, if warranted) relative to any service that they are performing for the College.
10. Termination: The College may terminate this Agreement for cause at any time with _________

11. Entire Understanding: This document and any exhibit attached constitute the entire understanding and
Agreement of the parties, and any and all prior agreements, understandings, and representations are hereby
terminated and canceled in their entirety and are of no further enforced and effective.
12. Unenforceability of Provisions: If any provision of this Agreement, or any portion thereof, is held to be
invalid and unenforceable, then the remainder of this Agreement shall nevertheless remain in full force and
effect.
