2: Statutory/Program Assurances
The following assurances apply to this grant program. In order to meet the requirements of the grant, the grantee must
comply with these assurances.

The applicant provides assurance that the application does not contain any information that would be protected by the Family
Educational Rights and Privacy Act (FERPA) from general release to the public.
The applicant provides assurance to adhere to all Performance Measures, as noted in the 2021-2024 ESC Texas Tutoring
Support Program Guidelines, and shall provide the Texas Education Agency, upon request, any performance data necessary
to assess the success of the program.
The applicant provides assurance to adhere to all Statutory Requirements and TEA Program Requirements as noted in the
2021-2024 ESC Texas Tutoring Support Program Guidelines.
The applicant assures that any Electronic Information Resources (EIR) produced as part of this agreement will comply with
the State of Texas Accessibility requirements as specified in 1 TAC 206, 1 TAC Chapter 213, Federal Section 508 standards,
and the WCAG 2.0 AA Accessibility Guidelines.
The applicant assures that it will only use ESSER III funds for activities allowable under Section 2001 of the American Rescue
Plan (ARP) of 2021.
The applicant assures that it will comply with all reporting requirements, including submitting required reports in the time and
manner required by TEA.
The applicant assures that it will cooperate with any examination of records with respect to such funds by making records
available for inspection, production, and examination, and authorized individuals available for interview and examination,
upon the request of (a) TEA, (b) the Department and/or its Inspector General; and/or (c) any other federal agency,
commission, or department in the lawful exercise of its jurisdiction and authority.
The applicant assures that it will comply with all applicable assurances in OMB Standard Forms 424B and D (Assurances for
Non-Construction and Construction Programs), including the assurances relating to the legal authority to apply for assistance;
access to records; conflict of interest; merit systems; nondiscrimination; the Hatch Act provisions; labor standards; flood
hazards; historic preservation; protection of human subjects; animal welfare; lead-based paint; Single Audit Act; and the
general agreement to comply with all applicable Federal laws, executive orders and regulations.
The applicant assures no Federal appropriated funds have been paid or will be paid to any person for influencing or
attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or
an employee of a Member of Congress in connection with the making or renewal of Federal grants under this program.

§§200.300-345) and Subpart E--Cost Principals (2 CFR §§200.400-475) to ensure it is using ESSER III funds for purposes
that are reasonable, necessary, and allocable under the ARP Act of 2021.
