Chapter 302 YARD SALES
302-1.
Definitions. For the purpose of interpreting this chapter, the following terms shall have the meanings given herein:
DONATED PERSONAL PROPERTY – The personal property of persons other than those residing on the residential premises where such sale is to take
place, such personal property being donated to or such sale being conducted by a tax-exempt religious or charitable organization and the entire proceeds
from such sale being donated to or retained by the sponsoring tax-exempt religious or charitable organization.
RESIDENTIAL PREMISES – A building or structure having at least one dwelling unit or boarding or lodging room, and the lot of land associated therewith
and any accessory structures, and any lot of land within a residential zone.
302-2.
Permit required. No person shall sell or offer for sale personal property from any residential premises, as defined herein, except as permitted
by this chapter. Only the sale of donated personal property, as defined herein, and the sale of personal property owned, used and maintained for personal
use only by the seller and not for resale to the public shall be permitted to be sold from residential premises, and only after issuance to the seller of a
permit for such purposes, as follows:
A.
Application. A permit may be obtained by submitting a completed application to the Code Enforcement Officer upon forms provided for such
purposes, together with a fee as set forth in Chapter 109, Fees, Article I, Code Enforcement Permits, of this Code.

B. Permit limitations. No permit shall be issued for sales of personal property upon residential premises for a period of more than three consecutive
days, and no more than two permits shall be issued for such sales upon a residential premises in any one calendar year. The second sale must take place
more than 60 days after the last day of the first sale.
302-3.
Signs. Notwithstanding the provisions relating to signs under Chapter 260, Signs, of this Code, one sign containing not more than four square feet in
area may be placed upon a residential premises where the sale of personal property has been permitted.
302-4.
Exceptions. The provisions of this chapter shall not apply to sales of personal property made under court order or process.
302-5.
Forms. Applications and permits required under this chapter shall be approved as to form by the City Council.
302-6.
Violations and penalties. Any person, firm or corporation conducting any sale regulated under this chapter without being properly licensed therefor
or who or which shall violate any of the terms of this chapter shall, upon conviction, be fined not less than $25 nor more than $100. Each day of violation shall
constitute a separate offense for purposes of prosecution of violations of this chapter.
