ThefollowingaretheRCUHguidelinestoensurecompliancewithAct179,SLH2010(Attachment#1).These
guidelinespertaintoonlyRCUHemployeesandnootherStateorCountyagency.Inpreparingtheseguidelines
theRCUHhas
receivedguidancefromtheDepartmentoftheAttorneyGeneralandtheState’sEmployees’
RetirementSystem.
I. Background:Act179,SLH2010(hereafterknown as“Act179/§889”),whichwasenactedonJune28,
2010,andwhichbecameeffectiveJanuary1,2011,amendedChapter88,HRSPensionandRetirement
Systemstoadd§889.TheintentofAct179/§889isto“ensurethestatusoftheERSasataxqualified
retirementplan”(H.Conf.Rep.No. 111025

Leg.,2010Reg.Sess.).Undersection4019a)ofthe(IRS)
Code,taxqualifiedretirementbenefitsmaynotcommenceuntilafteranemployeeretiresorreaches
normalretirementage(Treas.Reg.§1.401(a)1(b)(1)).BecausetheERSdoesnothavea“normal
retirementage,”ERSbenefitsmaynotcommenceuntilafteran
employeeretires.Ifaretireeis
reemployed,“withoutabonafideseparationofservice,theretireemaynotbeconsideredretiredforthe
purposeofthe(IRS)Code.”
II. ApplicabilityofChapter88,HRSPensionandRetirementSystemtoRCUH:BylawtheRCUHemployees
areexcludedfromChapter88,HRS.TheRCUHhasitsownretirementplan,whichisnotpartoftheState
ERS.Therefo r e, RegularstatusRCUHemployeeswitha50%orhigherFTEareeligibletojointheRCUH
GroupRetirementAn nuity(GRA)PlanwhichisadministeredthroughtheTIAACREF.
III. ApplicabilityofAct179/§889toERSRetirantsthroughtheRCUH:“Retirant”isanindividualwhohas
retiredfromtheStateorCountyandisabeneficiaryoftheERS(§8821Definitions).Although RCUH
employeesareexcludedfrommembershipintheERS,anRCUHemployeewhoisa“retirant”issubjectto
Act179/§889.
Act179/§889isapplicabletoanycurrentandprospectiveretirant
oftheStateofHawaii’sEmployees’
RetirementSystem(ERS)whoworksorplanstoworkfortheRCUH.Therefore,foranERSretiranttowork
fortheRCUHhe/shemusteither(1)suspendhis/herERSpensionandhealthbenefitsor(2)priorto
employmentwiththeRCUHhada6consecutive
calendarmonthsofaretirement/breakinserviceperiod
duringwhichtimehe/shedidnotworkforanyStateorCountyagency.

1. CertificationofallemployeestoensureawarenessandcomplianceofAct179/§889:AllcurrentRCUH
employees(e.g.,allemployeecategoriesandFTEstatus)willbesentthe“RCUHCertifica tionof
ComplianceCurrentRCUHEmployee‐EmploymentofERSRetirantswiththeRCUH”formD95a
(Attachment#2).ThiscertificationformmustbecompletedandreturnedtotheRCUHHuman
ResourcesDepartmentnolaterthanJanuary
31,2011.Thecertificationformwillkeptinthe
employee’spersonnelfile.
2. Ongoingcertificationprocessforallnewhires(allemployeecategories/FTE):TheRCUHwillincludea
“NoticetoAllApplicants”onoureRecruitsystemandan“RCUHCertificationofComplianceRCUH
ProspectiveNewHire”(Attachment#3)onourElectronicHiringSystem(EHS).The“NoticetoAll

are“conditionsofemployment”.“AllRegularstatusRCUHemployees’workperformanceis
evaluatedannuallyinJune.Theseevaluationsdeterminewhetheranemployee’swork
performanceissatisfactory(i.e.,acondition
forcontinuedemployment).Thereforecompliant
withPolicy3.210,iftheemployee’sworkperformanceisunsatisfactory,he/shewillnotbe
retainedinthenextfiscalyear.ThisistherationalbasisfortheRCUHestablishingJune30,
2011asan“enddate”forthepurposeofcompliancewithAct179/§889.
Note:Act179/§889becameeffectiveonJanuary1,2011.Therefore,RetirantswhoareIV.6
(i.e.,Retirantswithouta6consecutivecalendarmonthretirement)shouldunde rstandthat
the“June30,2011”dateisa“conditionalenddate”.TheERSwillaccordRetirants/RCUH
employeeswithoutafixedterminationdatethesametreatmentasotherStateemployees
whoareonafiscalyearappointmentendingJune30,2011;
however,theERSreservesthe
righttotakesuchactionasitdeemsappropriatetoprotecttheERS'staxqualifiedstatus
shouldtheInternalRevenueServicetakeissuewiththistreatment.Shouldthisoccur,upon
notificationfromtheERS,theRCUHwillimmediatelyinformallaffectedRetirantsthatthe
conditional
June30,2011enddatehaschangednecessitatinganearlierterminationdate.

Summary:
Requirementsforemploymentofaretirantmetiftherewasnoagreementpriortothe
terminationoftheDecember1,2010February28,2011employment.Neitherthe
employernortheretirantisliabletotheERSfortheemploymentthatbeganpriorto
January1,2011(theeffectivedate
ofAct179/§889).Nosuspensionofbenefitsfor
the89daypositionthatbeganafterthe6consecutivemonth(March,April,May,June,
JulyandAugust)breakinemployment,providedthat,beforethebreakbegan,there
wasnoagreementthattheretirantwouldbehiredafterthebreak.
RCUHAnalysisofERSExample#3:TherearesimilaritieswithaRetirantemployedwiththe
RCUH,theseinclude:
(a) TheRetirant/RCUHemployeeretiredfr omtheStateorCountypriortotheJanuary1,2011
(effectivedateofAct179/§889).

9).”Therefore,sincetheRetirant/RCUHemployeealsobeganhis/her
appointmentpriortoJanuary1,2011,he/sheshouldbeallowedtocontinuethroughthe
fiscalyearenddate(i.e.,June30,2011).
CONCLUSION:PertheERSOctober1,2010guidelines,theRCUHemployeesliketheemployee
inExample#3willnotbeliabletotheERSforpenaltiesspecifiedinAct179/§889).TheRCUH
expectsitsaffectedemployeestobetreatednodifferentlythan anyState/Countyemployee
describedinExample#3.
7. PrincipalInvestigatorsandERSRetirantdescribedinIV.6(B)aboveshouldmeetanddecide
onan
actionplan:AseparatenoticewillbesenttoRCUHemployeesrequestingthemtocompletethe
“RCUHCertificationofComplianceEmploymentofERSRetirantswiththeRCUH”form(Attachment
#2D95a).ThedeadlinetocompleteRCUHD95aisJanuary31,2011.
TheRCUHHumanResourcesDepartmentwillprovidePrinci palInvestigatorswiththenamesofhis/her
