ThefollowingaretheRCUHguidelinestoensurecompliancewithAct179,SLH2010(Attachment#1).These

guidelinespertaintoonlyRCUHemployeesandnootherStateorCountyagency.Inpreparingtheseguidelines

theRCUHhas

receivedguidancefromtheDepartmentoftheAttorneyGeneralandtheState’sEmployees’

RetirementSystem.



I. Background:Act179,SLH2010(hereafterknown as“Act179/§88‐9”),whichwasenactedonJune28,

2010,andwhichbecameeffectiveJanuary1,2011,amendedChapter88,HRS–PensionandRetirement

Systemstoadd§88‐9.TheintentofAct179/§88‐9isto“ensurethestatusoftheERSasatax‐qualified

retirementplan”(H.Conf.Rep.No. 11‐1025

Leg.,2010Reg.Sess.).Undersection4019a)ofthe(IRS)

Code,tax‐qualifiedretirementbenefitsmaynotcommenceuntilafteranemployeeretiresorreaches

normalretirementage(Treas.Reg.§1.401(a)‐1(b)(1)).BecausetheERSdoesnothavea“normal

retirementage,”ERSbenefitsmaynotcommenceuntilafteran

employeeretires.Ifaretireeis

reemployed,“withoutabonafideseparationofservice,theretireemaynotbeconsideredretiredforthe

purposeofthe(IRS)Code.”



II. ApplicabilityofChapter88,HRS–PensionandRetirementSystemtoRCUH:BylawtheRCUHemployees

areexcludedfromChapter88,HRS.TheRCUHhasitsownretirementplan,whichisnotpartoftheState

ERS.Therefo r e, RegularstatusRCUHemployeeswitha50%orhigherFTEareeligibletojointheRCUH

GroupRetirementAn nuity(GRA)PlanwhichisadministeredthroughtheTIAA‐CREF.



III. ApplicabilityofAct179/§88‐9toERSRetirantsthroughtheRCUH:“Retirant”isanindividualwhohas

retiredfromtheStateorCountyandisabeneficiaryoftheERS(§88‐21Definitions).Although RCUH

employeesareexcludedfrommembershipintheERS,anRCUHemployeewhoisa“retirant”issubjectto

Act179/§88‐9.



Act179/§88‐9isapplicabletoanycurrentandprospectiveretirant

oftheStateofHawaii’sEmployees’

RetirementSystem(ERS)whoworksorplanstoworkfortheRCUH.Therefore,foranERSretiranttowork

fortheRCUHhe/shemusteither(1)suspendhis/herERSpensionandhealthbenefitsor(2)priorto

employmentwiththeRCUHhada6consecutive

calendarmonthsofaretirement/break‐in‐serviceperiod

duringwhichtimehe/shedidnotworkforanyStateorCountyagency.

employees(e.g.,allemployeecategoriesandFTEstatus)willbesentthe“RCUHCertifica tionof

Compliance–CurrentRCUHEmployee‐EmploymentofERSRetirantswiththeRCUH”formD‐95a

(Attachment#2).ThiscertificationformmustbecompletedandreturnedtotheRCUHHuman

ResourcesDepartmentnolaterthanJanuary

31,2011.Thecertificationformwillkeptinthe

employee’spersonnelfile.



2. On‐goingcertificationprocessforallnewhires(allemployeecategories/FTE):TheRCUHwillincludea

withPolicy3.210,iftheemployee’sworkperformanceisunsatisfactory,he/shewillnotbe

retainedinthenextfiscalyear.ThisistherationalbasisfortheRCUHestablishingJune30,

2011asan“enddate”forthepurposeofcompliancewithAct179/§88‐9.



Note:Act179/§88‐9becameeffectiveonJanuary1,2011.Therefore,RetirantswhoareIV.6

(i.e.,Retirantswithouta6‐consecutivecalendarmonthretirement)shouldunde rstandthat

the“June30,2011”dateisa“conditionalenddate”.TheERSwillaccordRetirants/RCUH

employeeswithoutafixedterminationdatethesametreatmentasotherStateemployees

whoareonafiscalyearappointmentendingJune30,2011;

however,theERSreservesthe

righttotakesuchactionasitdeemsappropriatetoprotecttheERS'staxqualifiedstatus

shouldtheInternalRevenueServicetakeissuewiththistreatment.Shouldthisoccur,upon

notificationfromtheERS,theRCUHwillimmediatelyinformallaffectedRetirantsthatthe

Summary:

Requirementsforemploymentofaretirantmetiftherewasnoagreementpriortothe

terminationoftheDecember1,2010–February28,2011employment.Neitherthe

employernortheretirantisliabletotheERSfortheemploymentthatbeganpriorto

January1,2011(theeffectivedate

ofAct179/§88‐9).Nosuspensionofbenefitsfor

the89‐daypositionthatbeganafterthe6consecutivemonth(March,April,May,June,

JulyandAugust)breakinemployment,providedthat,beforethebreakbegan,there

wasnoagreementthattheretirantwouldbehiredafterthebreak.



CONCLUSION:PertheERSOctober1,2010guidelines,theRCUHemployeesliketheemployee

inExample#3willnotbeliabletotheERSforpenaltiesspecifiedinAct179/§88‐9).TheRCUH

expectsitsaffectedemployeestobetreatednodifferentlythan anyState/Countyemployee

describedinExample#3.


