5. The Subscriber agrees to establish and practice data security for all information obtained through the
Criminal Defense Attorney Portal that prevents unauthorized use, access, distribution, modification, theft,
or sabotage, whether internal or external and whether due to natural or human-caused disasters or intrusions.
Unauthorized use includes, but is not limited to, electronically uploading to internet websites, copying, saving,
faxing or emailing information obtained from the Criminal Defense Attorney Portal, except in the course of
representation of a party. The Subscriber may not sell, assign, or transfer any Information obtained from the Portal.
6. PERSONAL USE OF INFORMATION OBTAINED FROM THE CRIMINAL DEFENSE ATTORNEY PORTAL IS PROHIBITED.
“Personal use” includes, but is not limited to, using this information to solicit business or to initiate contact with
potential new clients for yourself or others. The Court will report any prohibited uses to the State bar and to
appropriate local authorities.
7. All Criminal Defense Attorney Portal User IDs and passwords are to be treated as confidential and may not
be transferred.
8. The Subscriber acknowledges and consents to the Court monitoring and auditing of any access to the Criminal
Defense Attorney Portal using the Subscriber’s User ID and password.
9. Cancellation policy: Subscriber and/or the Court may cancel the subscription for any reason at any time.
10. Access to the Criminal Defense Attorney Portal is granted solely at the discretion of the Orange County
Superior Court. The Court may revoke or deny access to a subscriber for any reason. Any person who willfully
destroys or alters any court record maintained in electronic form is subject to prosecution and penalties,
including those imposed by Government Code section 6201. Please read the Court’s Privacy Policy

11. Indemnification: Subscriber agrees to indemnify, hold harmless, and defend the Orange County Superior
Court, its officers, agents and employees (collectively, the “Indemnified Parties”), with respect to any claim, loss,
liability, damage, lawsuit, cost, or expense that arises out of, or is in any way related to the Subscriber’s use of
the Criminal Defense Attorney Portal or this agreement. The indemnity obligation will extend, without limitation,
to any and all claims of every kind and nature whatsoever, arising in any manner by reason of the negligent acts,
errors, omissions or willful misconduct incident to the use of Criminal Defense Attorney Portal by Subscriber and
its agents or employees, as to any injury, loss, or damage that is sustained by any person, entity or organization.
The provisions of this section shall survive the expiration or termination of this agreement.
