Parties
Standing Order 1-11
is
about Court Activity Record Information (CARl).
CARl includes all Criminal Offender Record Information (CORl),
as
well as juvenile court records and civil
restraining order information.
The Court
is
required to review
CARl
in all cases about abuse prevention orders and domestic relations protective
orders.
Before delivering any probation services, the Probation Department shall inform you
if
your CARl has been
reviewed.
The Probation Department will inform you
of
the information included in your CARl that they have considered in
this case.
You shall have the opportunity to review your CARl record.
The Probation Department shall inform both parties, together, whether any CARl information has been
considered.
If
you have safety concerns, the Probation Department will discuss the information separately.
You may consent to the disclosure
of
your CARl information to the other party.
Absent your consent, the other party may ask the Court for
an
order disclosing your CARl information, and the
Court may order its disclosure.
A member
of
the Probation Department may provide the CARl record to the Court.
If the Court reviews the CARl record, the Court shall explain on the record or describe by written findings what
CARl information was relied on and any conclusions that were made as a result
of
the review the CARl.
You shall have a reasonable and meaningful opportunity to rebut or otherwise respond to the CARl record.
You may request additional time to prepare your rebuttal.
The Probation Department will notify the Court
if
there is an outstanding warrant for either party.
