Minutes
Call to Order
The meeting of the Incorporated Village of Muttontown was called to order by Mayor Dr. James
Liguori, at Village Hall, located at One Raz Tafuro Way, Muttontown, New York, at 7:00 p.m.

The Pledge to the Flag of the United States of America was recited by the Board, Village personnel,
residents and the general public.
Public Hearing
At 7:00 p.m. a motion was made by Trustee Singh, seconded by Trustee Economou and carried
to open the public hearing on proposed Local Law 2 of 2019 Amending Village Code § 158-16 of
Chapter 158: Subdivision of Land.
Mayor Liguori asked for comments from the Board of Trustees. Trustee Economou spoke. Village
Attorney Keith Corbett gave an overview of the proposed Local Law 2 of 2019 and proposed Local
Law 3 of 2019. The Village Engineer, Paul Stevens discussed further as did the Village Environmental
Engineer Jim Antonelli. Mr. Antonelli explained the amendments would be unlisted actions under
SEQRA and recommended negative declarations under SEQRA.
Mayor Liguori asked for comments from the public. Patricia Moed of 1874 Muttontown Road,
Paramjit Singh of 30 Juniper Lane, Santosh Mathai of 50 Woodcrest Drive, Mindy Stein of 225
Coachman Place, Julie Albernas of 21 Geralind Drive, Mr. Turakhia of 55 Coachman Place West,
Matthew Guerra attorney for the Syosset Central School District, Philippe Baumann of 1867
Muttontown Rd, Randi Lehman of 12 Shamrock Court and Michael Schloss of 311
Muttontown/Eastwoods Road addressed the board.
There being no one further wishing to comment, a motion was made by Trustee Economou,
seconded by Trustee Singh and carried to close the public hearing at 8:05 p.m.
A motion was made by Deputy Mayor Prasad, seconded by Trustee Economou and carried to
declare the Village as a Lead Agency for proposed Local Law 2 of 2019.
A motion was made by Deputy Mayor Prasad and seconded by Trustee Economou to issue a
negative declaration for proposed Local Law 2 of 2019 based on the recommendation of the Village
Environmental Engineer. Mayor Liguori asked Acting Clerk/Treasurer Joe Russo to poll the Board:

Mayor Liguori declared the law adopted as Local Law 2 of 2019.
At 8:06 p.m. a motion was made by Trustee Economou, seconded by Deputy Mayor Prasad and
carried to open the public hearing on proposed Local Law 3 of 2019 Amending Village Code § 74-
2 of Chapter 74: Freshwater Wetlands.
Mayor Liguori asked for comments from the Board of Trustees and from the public on proposed
Local Law 3 of 2019. The Village Attorney, Keith Corbett summarized as discussed in the prior public
hearing by the Village Engineer and Village Environmental Engineer.
There being no one further wishing to comment, a motion was made by Trustee Singh, seconded by
Deputy Mayor Prasad and carried to close the public hearing at 8:07 p.m.
A motion was made by Trustee Economou, seconded by Deputy Mayor Prasad and carried to
declare the Village as a Lead Agency for proposed Local Law 3 of 2019.

Department Reports
At 8:15 p.m. Trustee Economou asked Sergeant Ernst of the Muttontown Police Department to give
a report on Police activity for the month of August 2019.
Mayor Liguori asked Deputy Mayor Prasad to give a technology update. Deputy Mayor Prasad
discussed the new website and the Muttontown Family Block Party.
Mayor Liguori asked Acting Clerk/Treasurer Joe Russo to give a treasurer’s report for the month
ending August 2019. Acting Clerk Russo discussed the bank reconciliation data from village
statements ending July 31, 2019 through statement end date August 31, 2019
NEW BUSINESS
Resolution 19-08 A motion was made by Trustee Singh, seconded by Trustee Economou and
carried to waive the reading of the prior meetings minutes.
Resolution 19-109 A motion was made by Trustee Economou, seconded by Trustee Todaro and
carried to approve the prior meeting’s minutes.
Resolution 19-110 A motion was made by Deputy Mayor Prasad, seconded by Trustee Singh and
carried to approve the warrants as presented.
Resolution 19-111 A motion was made by Trustee Economou, seconded by Trustee Singh and
carried to approve the establishment of a standard workday for the Secretary to The Board of
Trustees.
Resolution 19-112 A motion was made by Deputy Mayor Prasad, seconded by Trustee Economou
and carried to approve the Court Grant.
Public Input
Roberta Censi of 86 Karol Place addressed the Board during public input.

§
158-16.
General Requirements.
A.
Considerafions, In considering applications for subdivision of land and/or
development, the Board shall be guided by the
standards
set
forth
herein. Said
standards
shall
be deemed to be
minimum
requirements for the convenience, health, safety and
welfare
of
the
village.
B.
Character of
land.
Land to be subdivided and/or developed shall be of such character
that
it
can be used safely
for
building
purposes
without
danger
to health or
peril
from
fire,
flood
or other
menace.
Land subject to such
hazards
shall not be subdivided nor
developed for residential
purposes
nor for such other
uses
as may
increase
danger
to
health,
life
or property or aggravate a
flood
hazard, but such land may be set
aside
for
such
uses
as shall not
involve
such
danger
nor produce unsatisfactory
living
conditions.
C.
Conformance to
Village
Comprehensive Plan and
Official
Map. Subdivisions and/or
developments shall conform to the
Official
Map and shall be properly related to the
proposals shown on the
Village
Comprehensive Plan. The plat shall include all
streets,
shown
on the said plan and map,
which
are
within
the site and such other
streets
as the
Board
may require.
D.
Frontage on improved
street.
The
area
proposed to be subdivided and/or developed
shall
have
frontage
on and direct
access
to a
street
duly
placed on the
Official
Map and,
if
such
street
is
private,
it shall be
improved
to the satisfaction
of
the
Board or there shall be
a bond
held
by
the
village
covering
such improvement.
E.
Preservation of
natural
cover.
Land
to be subdivided and/or developed shall be
laid
out
and improved in
reasonable
conformity
to exisfing topography, in order to minimize
grading,
cut and
fill
and to retain, insofar as possible, the natural contours,
limit
stormwater
runoff
and conserve the natural cover and
soil.
No topsoil, sand or gravel
shall
be removed
from
any lots shown on any
subdivision
plat except for the purpose of
improving
such lots and
for
the
laying
out of
streets
shown thereon.
Topsoil
so removed
shall
be restored to the depth
of
six
inches and
properly
seeded
and
fertilized
on the
areas
of
such lots not occupied by buildings or structures. No
excess
topsoil so removed shall
be disposed of outside of the boundaries of the village except upon the approval of the
Board
ofTrustees
of
the
village.
F.
Preservation
of
natural
buffer.
In granting approval
of
any
application
for
a
subdivision
other than a
partitioning
as defined in secfion 158-8
(Word
usage
and
definitions)
of
this
Chapter, the subdivider shall set
aside
and
reserve-a
perimeter
buffer
of
fifty
feet
which
shall
remain undisturbed, except as may be required for
access,
utilities,
or such
augmentafion of the existing
flora
or other existing natural
features
as the Planning Board
may require or permit in
accordance
with
the planning objectives set
forth
in the Village
Comprehensive Master Plan, as
amended
from
time to time. The perimeter buffer shall
be contained
within
one or more lots and shall be included in the bulk and
area
calculation(s) when determining minimum lot
size
and all required
setbacks
shall be
measured
from
the outer boundary of
such
perimeter buffer. Further, if a perimeter
buffer
traverses
a lot
designated
for a park, playground or other recreational
purpose,
as
defined in § 127-2 of the Village Code, the
gross
area
of
such
buffer shall be credited
towards the minimum required
area
for
such
park, playground or recreational lot. The
metes
and
bounds
of
such
perimeter buffer shall be memorialized in
covenants
and
restrictions recorded in the office of the County Clerk as a condition of subdivision
approval.
G.
Preservation of existing natural
features.
Existing natural
features
that
enhance
the
attractiveness
of the
site
and which would add value to residential or other development
or to the village as a whole,
such
as
trees,
watercoiu'ses,
ponds
and similar irreplaceable
assets,
shall be
preserved
insofar as
possible
by harmonious design of the subdivision.
The Board may
make
reasonable
modifications in
standards
for layout of
streets
to
accomplish
such
purposes
as
well
as the objectives noted in Subdivision E. For
purposes
of
computing the number of lots that a subdivision
will
yield,
the
following
features
shall
be excluded: all
"slope
lands" as defined by
Chapter
190 (Zoning),
Article
I
(Purpose,
Title
and
Definitions),
section 190-2 (Word
usage
and definitions) ofthe
Code
ofthe
ViUage
of
Muttontown;
and all "freshwater wetiands" and
"adjacent
areas"
as defined by
Chapter
74
(Freshwater
Wetlands), section 74-2
(Definitions)
of the
Code
of the Village
of
Muttontown.
Section 4. Severability.
If
a
court
determines
that any
clause,
sentence,
paragraph
subdivision, or part
of
this Local Law
or the application thereof to any
person,
firm
or corporation, or
circumstance
is
invalid
or
unconstitutional, the court's order or judgment shall not
affect,
impair, or invalidate the
remainder
of
this Local Law, but shall be confined in its operation to the
clause,
sentence,
paragraph,
subdivision, or part
of
this Local Law or
in
its application to the
person,
individual,
firm
or corporation, or circumstance, directly involved
in
the controversy in
which
such
judgment or order shall be
rendered.
Section 5. Applicability,
This
article shall apply to all
actions
occurring on or
after
the
effective
date
of this article.
Section 6. Effective Date.
This

take
effect
immediately upon

Secretary

74-2.
Definitions.
The
following
terms,
phrases,
words and their derivatives shall
have
the
meanings
given
herein:
ADJACENT
AREA
- The
area
surrounding the freshwater wetland,
measured
a
horizontal
distance
of
100
feet
from
the boundary thereof
APPLICANT
- Includes the owner
of
the
affected
property, his
agent
or contract
vendee
who
files
an application
for
a permit
pursuant
to
this
chapter.
BOUNDARY
- The outer
limit
of
the physical feature that constitutes a wetiand
resource
in
terms
of
vegetation, soils and hydrologic conditions specified herein
in
the
definition
of
"freshwater wetland."
FRESHWATER
WETLAND
~
An
area
of
at
least
2,000
square
feet that is
naturally
inundated or
saturated
by
surface
water or groundwater at a frequency
and duration
sufficient
to support,
under
normal circumstances, a
prevalence
of
vegetation
typically
adapted
for
life
in
saturated
conditions (called
"hydrophytes;", see
defmition
of
"hydrophytic
vegetation" herein), or contains
hydric
soils.
Freshwater
wetlands are commonly referred to as
"swamps,"
marshes,"
"bogs"
or "vernal pools.". Regulated freshwater wetlands
for
the
purpose
of
this
chapter
include water
bodies
and
watercourses.
HYDROPHYTIC
VEGETATION
- Plant
life
growing
in
water or on a
substrate
that is at
least
periodically
deficient in oxygen as a result of
excessive
water
content, as set
forth
in
the Federal Manual of
Identifying
and Delineating
Jurisdictional
Wetlands, as
amended
or updated. Most common hydrophytes are
listed
and categorized in Wetiands
Plants
of
the
State
ofNew
York,
published by
the United
States
Fish and
Wildlife
Services
in
cooperation
with
the National and
Regional Wetiands Plant
List
Review
Panels,
as
amended
or updated.
PERMIT
-
A
freshwater wetlands permit
for
the conduct
of
a
regulated
activity.
PERMIT
-
Any
corporation,
firm,
partnership, association, tmst or
estate,
one or
more individuals and any unit
of
govemment or
agency
or subdivision thereof
PLANNING
BOARD
- The Planning Board ofthe Incorporated
Village
of
Muttontown
designated
by the
village
to be responsible
for
administering the
provisions
of
this
chapter
and promulgating rules, regulations and
procedures
necessary
to implement and administer properly the provisions herein.
POLLUTION
- The
presence
in the environment
of
human-induced conditions or
contaminants
in
quantities or characteristics
which
are or may be
injurious
to
humans,
vegetation,
wildlife
or property.
PROJECT ~
Any
action resulting in direct or indirect physical impact on a
fireshwater wetland, including but not
limited
to
any regulated
activity.
REGULATED
ACTIVITY
-
Any
form
of
draining,
dredging, excavating or
removal
of
soil,
mud,
sand,
shells, gravel or other
aggregate,
either directly or
indirectly;
any
form
of
dumping,
filling
or deposition of any
soil,
stones,
sand,
gravel, mud, rubbish or
fill
of any
kind,
either directly or
indirectly;
ejecting any
structures,
constructing
roads,
the
driving
of
piling
or placing ofany other
obstruction, whether or not changing the ebb and
flow
ofthe water; and any
form
of
pollution,
including but not
limited
to
installing
a
septic
tank, running a
sewer
outfall,
discharging
sewage
treatment
effluent
or other
liquid
wastes
into or so as
to drain
into
a
freshwater wetland and any other
activity
which
substantially
impairs any
of
the
several
functions
served
by the freshwater wetlands or the
benefits derived therefrom.
WATER
BODY
-
Any
surface
water
element,
including
but not
limited
to
ponds
and intermittent
streams,
covering an
area
of
at
least
2,000
square
feet. A water
body may be
periodically,
seasonally
or permanently covered by water.
WATERCOURSE
- Any brook,
creek,
stream,
river,
rivulet,
floodway
or other
such
waterway
flowing
in a defined channel.
Section 4. Severability.

A. Title: You must establish a standard work day for each employee title (e.g. clerks, bus drivers, etc.) even if you do not
have any
full-time employees in that title. You may establish several standard work days for different positions. For
example, all laborers may have an eight hour standard work day, all clerical workers seven and a half hours, and all
elected ofcials six hours. Employers may also establish several standard work days for the same title, depending if
there are signicant variances in the job duties.
B. Standard Work Day (Hrs/day): The minimum number of hours that can be established for a standard workday is six,
while the maximum is eight. A standard workday is the denominator to be used for the days worked calculation; it
is not necessarily always the number of hours a person works. For example, if a clerk is only required to work three
hours a day, you must still establish a standard workday between six and eight hours as the denominator for their
days worked calculation.
Once the Resolution is passed, it must be kept on le by the employer and made available to the Retirement System
upon request.
