Certification of Manufacturer’s License for Commerical Use of the State Seal

Commentary
Commercial use of the Texas state seal is governed by section 17.08, Texas Business & Commerce
Code and the secretary of state’s administrative rules found in 1 Texas Administrative Code Chapter 72.
Section 17.08 prohibits private or commercial use of the state seal of Texas unless the user applies to the
secretary of state.
Pursuant to 1 Texas Administrative Code § 72.42(c), vendors or resellers are exempt from the § 17.08
registration requirement if the manufacturer of the product has obtained the required license to use the
state seal, the vendor or reseller obtains a certification of the manufacturer’s license, and the vendor or
reseller maintains the certification at its place of business for four years. The certification must be made
readily available for inspection by the secretary of state’s office upon request.
Instructions for Form
Identifying Information: Provide the name and business address of the vendor or reseller
submitting the certification, as well as the name and state seal license number of the
manufacturer executing the certification.
Product Type and Number: State the type and number of items transferred from the
manufacturer to the vendor or reseller.
Execution: A person authorized to sign on behalf of the manufacturer must sign and date the
certification.
