voidandshall,atLandlord'soption,terminatethisAgreement.
1. ALTERATIONSANDIMPROVEMENTS.Tenantshallmakenoalterationstothebuildingsor
improvementsonthePremisesorconstructanybuildingormakeanyotherimprovementsonthePremises
withoutthepriorwrittenconsentofLandlord.Anyandallalterations,changes,and/orimprovementsbuilt,
constructedorplacedonthePremisesbyTenantshall,unlessotherwiseprovidedbywrittenagreement
betweenLandlordandTenant,beandbecomethepropertyofLandlordandremainonthePremisesat
theexpirationorearlierterminationofthisAgreement.
1. NONDELIVERYOFPOSSESSION.IntheeventLandlordcannotdeliverpossessionofthePremisesto
TenantuponthecommencementoftheLeaseterm,throughnofaultofLandlordoritsagents,then
Landlordoritsagentsshallhavenoliability,buttherentalhereinprovidedshallabateuntilpossessionis
given.Landlordoritsagentsshallhavethirty(30)daysinwhichtogivepossession,andifpossessionis
tenderedwithinsuchtime,TenantagreestoacceptthedemisedPremisesandpaytherentalherein
providedfromthatdate.Intheeventpossessioncannotbedeliveredwithinsuchtime,throughnofaultof
Landlordoritsagents,thenthisAgreementandallrightshereundershallterminate.
1. HAZARDOUSMATERIALS.TenantshallnotkeeponthePremisesanyitemofadangerous,flammable
orexplosivecharacterthatmightunreasonablyincreasethedangeroffireorexplosiononthePremisesor
thatmightbeconsideredhazardousorextrahazardousbyanyresponsibleinsurancecompany.
1. UTILITIES.Tenantshallberesponsibleforarrangingforandpayingforallutilityservicesrequiredonthe
Premises.
1. MAINTENANCEANDREPAIR;RULES.Tenantwill,atitssoleexpense,keepandmaintainthePremises
andappurtenancesingoodandsanitaryconditionandrepairduringthetermofthisAgreementandany
renewalthereof.Withoutlimitingthegeneralityoftheforegoing,Tenantshall:
(a) Notobstructthedriveways,sidewalks,courts,entryways,stairsand/orhalls,whichshallbeused
forthepurposesofingressandegressonly;
(b) Keepallwindows,glass,windowcoverings,doors,locksandhardwareingood,cleanorderand
repair;
(c) Notobstructorcoverthewindowsordoors;
(d) Notleavewindowsordoorsinanopenpositionduringanyinclementweather;
(e) Nothanganylaundry,clothing,sheets,etc.fromanywindow,rail,porchorbalconynorairordry
anyofsamewithinanyyardareaorspace;
(f) Notcauseorpermitanylocksorhookstobeplaceduponanydoororwindowwithouttheprior
writtenconsentofLandlord;
(g) Keepallairconditioningfilterscleanandfreefromdirt;
(h) Keepalllavatories,sinks,toilets,andallotherwaterandplumbingapparatusingoodorderand
repairandshallusesameonlyforthepurposesforwhichtheywereconstructed.Tenantshall
notallowanysweepings,rubbish,sand,rags,ashesorothersubstancestobethrownor
depositedtherein.Anydamagetoanysuchapparatusandthecostofclearingstopped
plumbingresultingfrommisuseshallbebornebyTenant;
(i) AndTenant'sfamilyandguestsshallatalltimesmaintainorderinthePremisesandatallplaces
onthePremises,andshallnotmakeorpermitanyloudorimpropernoises,orotherwise
disturbotherresidents;
(j) Keepallradios,televisionsets,stereos,phonographs,etc.,turneddowntoalevelofsoundthat
doesnotannoyorinterferewithotherresidents;
(k) Depositalltrash,garbage,rubbishorrefuseinthelocationsprovidedthereforandshallnotallow
anytrash,garbage,rubbishorrefusetobedepositedorpermittedtostandontheexteriorof
anybuildingorwithinthecommonelements;
(l) AbidebyandbeboundbyanyandallrulesandregulationsaffectingthePremisesorthe
commonareaappurtenanttheretowhichmaybeadoptedorpromulgatedbythe
CondominiumorHomeowners'Associationhavingcontroloverthem.
1. DAMAGETOPREMISES.IntheeventthePremisesaredestroyedorrenderedwhollyuninhabitableby
fire,storm,earthquake,orothercasualtynotcausedbythenegligenceofTenant,thisAgreementshall
terminatefromsuchtimeexceptforthepurposeofenforcingrightsthatmayhavethenaccruedhereunder.
