We, the undersigned, entered into a common law marriage in the State of Oklahoma in the
month/year of______________/____________. We entered into this relationship:
In good faith
With mutual consent
As a permanent union with a present intent to be married; and
With both parties having the capacity to marry (that is, neither party is married to
someone else, both are of legal age, and the parties are not closely related by blood).
In order to further validate this common law marriage, the parties herein state that they live
together and hold themselves out to the world as husband and wife. The following documentation
must be provided:
1. A copy of each party’s social security card; and
2. At least one of the following items:
Joint tenancy deed to a house or a rental lease listing both parties;
Statement showing a joint bank account or joint ownership of other property (such
as stocks, bonds, real estate or an automobile);
IRS Federal 1040 Tax Form listing both parties as filing married.
We understand that a common law marriage has the full weight and effect of a ceremonial marriage
and also understand that neither party can remarry unless this common law marriage is dissolved
by divorce, annulment or death of one of the parties.
