Checklist and Application
In support of the business community, the Town of Reading will be allowing licensed food establishments to
expand outdoor dining opportunities to align with the Governor’s Reopening Phase II Executive Order issued
on June 1, 2020. For more information see pgs. 6-7 of the Executive Order:

The following is a checklist and a temporary outdoor dining license application for review by an
interdepartmental team of Town staff and approval by the Town Manager. All proposed outdoor dining on
public and private property needs to be reviewed and approved by the Town and can be submitted
electronically to Assistant Town Manager, Jean Delios at jdelios@ci.reading.ma.us. Please include all items
in one e-mail if possible. Jean will share your proposal with the following Town Staff to review together
and with you. Depending on the complexity and nature of the proposal, additional permits and inspections
may be required with separate applications and sets of submission requirements from this temporary
outdoor license application.
Our Town goals are to expedite the permitting process, by:
Providing this consolidated packet of information to you so you know what information we need
to review under current laws and regulations.
Providing a one-stop meeting with Town staff, Expedited Approval Team (EAT) for technical review.
EAT will review applications for completion and comprehensiveness with regard to other
permits/license requirements and provide a recommendation to the Town Manager. This positive
recommendation will be made to the Town Manager and a license to expand outdoor seating will
be issued.
Town staff will do our best to review applications holistically, provide technical review, and clearly communicate
any additional information requirements. There are two Tiers of applications to recognize that some are simple
while others are more complex:
Tier 1: For a simple use of a public sidewalk and/or installation of tables and chairs that will be
moved inside at night or otherwise secured, please fill out the application sections that are
applicable. An expanded Food Operation and Safety Plan needs to be submitted to Laura Vlasuk,
Health Agent vlasuk@ci.reading.ma.us. No additional permits are required.
Tier 2: For complex proposals that may include use of public or private parking lots, on-street
parking spaces, temporary structures, heating, lighting or other elements, additional permits and
certificates are required depending on the nature of the proposal. EAT will review the proposal
holistically this is also an opportunity to present and work through your proposal with Town staff
for any other required permitting, inspections or licensing.

Alcohol License Application and supporting documentation- For expansion of liquor license for outdoor
serving if applicable- Send to Caitlin Saunders, Executive Assistant at csaunders@ci.reading.ma.us.
All applicants must provide a sketch drawing to scale (to the best of your ability) with the following
information:
a. Photos of your proposed location
b. Dimensions of the sidewalk, patio, deck, lawn, parking area or other outdoor space that you
would like to use for outdoor dining.
c. Orientation markers like street names and/or restaurant façade, parking lot boundaries or
marker so staff understand the location and orientation of your proposed layout.
d. Proposed layout of tents, umbrellas, tables, chairs, planters, and any other temporary
installations (sinks, bussing stations, podiums)
NOTE: Tables must be spaced at least 6’ft apart to facilitate mandatory distancing.
e. Location of proposed electrical connection.
f. Photos or description of barriers to be used around the perimeter of the outdoor dining area
to designate boundaries if applicable.

Letters of support from adjacent businesses if public parking is proposed to be utilized for outdoor
dining.

Professional plans, certifications and specifications will be needed depending on the nature of your proposal
to ensure that your proposal meets mandatory temporary structure engineering, installation and life safety
standards. Please see below for temporary structures (tents), electrical and heating elements.

Section 5: Outdoor Dining Parking and Circulation
We want to make sure that patrons and employees are safe by not crossing pathways with cars. We also
recognize the need for parking, pick-up/drop-off areas, and loading areas for commercial deliveries for your
business and your neighbors. Outdoor dining in public parking lots will require the closure of the lot to all
vehicle traffic and parking.
A request for the closure of public parking lots for outdoor dining may be requested via the Town Manager’s
Office for the Select Board to review and consider through a public hearing process. This process requires
about three (3) weeks of lead time to advertise and notice the hearing for two (2) weeks in advance of the
public hearing. Letters of support from adjacent commercial tenants who are directly impacted by the
proposal are required to be considered as part of this request for public parking lot closure.

Section 6: Temporary Structures (Tents), Heaters, and Electrical
Professional plans, certifications and specifications are required to ensure that your proposal meets mandatory
temporary structure engineering, installation and life safety standards
For example: The installation of a tent larger than 12 x 10 ( 120 Sq. ft.) with electrical hook-up, temporary walls
and outdoor heaters will require a building permit, structural certification, wiring inspection, and fire
prevention review and inspection.
These permits and certifications are in addition to this temporary expanded outdoor license application. Town
staff will do our best to review this application holistically and provide technical review with the additional
permits and certification requirements in mind.

Requirements for Accessibility
Dining must be accessible and meet ADA and Massachusetts Architectural Access Board’s regulations.

521 CMR 17.00: RESTAURANTS
17.2 SEATING
At least 5% but not less than one, of the tables shall be accessible, be on an accessible route, and in
compliance with the following:
17.2.2 A 36-inch (36" = 914mm) access aisle shall be provided between all accessible tables. No seating shall
overlap the access aisle. See Fig. 17a.
17.2.3 Clear floor space as defined in 521 CMR 5.00: DEFINITIONS shall be provided at each seating space.
Such clear floor space shall not overlap knee space by more than 19 inches (19" = 483mm). See Fig.
17a.
17.2.4 Knee Clearances: If seating for people in wheelchairs is provided at tables or counters, knee spaces at
least 27 inches (27" = 686mm) high, 30 inches (30" = 762mm) wide, and 19 inches (19" = 483mm) deep
shall be provided. See Fig. 17b.
17.2.5 Height of Tables or Counters: The tops of accessible tables and counters shall be from 28 inches to 34
inches (28" to 34" = 711mm to 864mm) above the finish floor or ground. See Fig 17b.

Acceptable Barriers
Barriers placed around the perimeter of the outdoor dining area must meet the following requirements:
Height: Between 36” – 38” in height
Not Permanent: Free-standing, stable, and easily removed
Continuous Rail: They must have a continuous rail 2” to 6” from the sidewalk or parking space surface
Base: The base of the barrier must be flat, with less than ½” thickness and placed so that it extends less
than 6” into the areas around the outdoor dining area.
