REQUEST A HEARING DATE
Under F.S. 318.15 (c)*
I wish to request a Hearing Date under Florida Statutes 318.15 (c) A person who is charged with a
traffic infraction may request a hearing within 180 days after the date upon which the violation occurred,
regardless of any action taken by the court or the department to suspend the person’s driving privilege, and,
upon request, the clerk must set the case for hearing. The person shall be given a form for requesting that his or
her driving privilege be reinstated.
Your case will be set for hearing and a notice will be mailed to you at the address reflected on your citation
unless an address update is included in this request.
If you live out of state and cannot attend your court date, you may request an Affidavit of Defense. This form
must be filled out and the original returned to the clerk’s office prior to your court date, at which time it will
be submitted to the Judge in lieu of your presence. You will be notified by mail of the court’s ruling on your
case.
If you are under the age of 18 you will need to have a parent/legal guardian present with you in court.
If you fail to appear for your court date, your privilege to drive will be suspended and the original fine plus a
late fee will become due. In addition, you will receive the points for that violation.
