3. Minutes: J. Kesseler moved to approve the minutes of the September 17, 2018 Public Art
Advisory Committee meeting. B. Cain seconded. Motion passed unanimously.
4. Action Item: Review and Make Recommendation on a Mural Proposal by Ryan Dawkins and
the Illuminaries Artist Team for the Lakeview Library. Public Art Coordinator Kristen Zaremba
provided background, noting that City staff from Cultural Affairs and the Oakland Public
Library have worked together to anticipate community support and technical installation
details to ensure a successful project. Lakeview Library staff member Derrick DeMay and
Turkey Trot Coordinator and Project Sponsor Ryan Dawkins introduced the project, noting the
documented community process utilized to arrive at the final design. Illuminaries artist Tim
Hon described the proposal. Staff and committee members asked for clarity on the scale and
color palette. The mural, measuring 50’ wide by 12’ high. Committee members complimented
the use of gray scale and color. The design focus is on oversized female figures, but
interspersed with smaller scale depictions of various library users, and will include text to
identify the library. Motion: P. Valdez moved to approve the mural design proposal by the
Illuminaries artist team for the Lakeview Library. J. Kesseler seconded. Motion passed
unanimously.
5. Action Item: Rainbow Recreation Center Gift-In-Place Design Review: Project Backboard
Project by Artist Muzae Sesay. Zaremba provided a general Rainbow Recreation Center Public
Art project update. Artist Johanna Poethig is currently refining details and translating the

approved design to production files before fabrication. In addition to the permanent public
art, basketball court improvements are being donated by Project Backboard. Local artist
Muzae Sesay met with youth from the center to develop ideas for a blacktop court design.
Two design proposals are currently under consideration. The artist proposes to ask the youth
participants to make the final decision. Committee members discussed the merits of each
composition, with a slight preference for the symmetry of design no. 1. Asked for more detail
regarding maintenance, and recommended that the anticipated life expectancy of the design
be clearly articulated to the community. Motion: J. Kesseler moved to approve the two
design proposals for the Rainbow Recreation Center Project Backboard Gift-in-Place design
by Muzae Sesay, with preference for design no. 1; with final design selection to be made by
the youth participants. B. Cain seconded. Motion passed unanimously.
6. Informational Item: Staff Updates on Pending Projects and Program Activity
a. Measure DD: Gardens at Lake Merritt Gates Project; Estuary Park Community
Meeting. Zaremba reported that there is continued interest for public art to be
included in the Estuary Park plans, noting a substantial number of participants at the
community meetings have highlighted a desire to preserve and add new artwork at the
site. City staff are still working on securing quotes and alternative approaches to cover
installation costs for the Garden Gates and Lakeside Green Streets projects.

Association Project : Temescal Utility boxes 2018
1. Description of the work:
The artwork to be created by the artist shall be: a completed total of 4 painted utility boxes in the
Temescal/Telegraph neighborhood depicting original designs related to the neighborhood
around themes of historic sites and events, nature, and diversity of the area.
2. Obligations of the artist and client:
a) Artist shall purchase materials necessary for the creation of the artwork.
b) Artist shall create the artwork, or in certain circumstances oversee the work of supporting
artist’s/assistants.
c) Client shall secure any permits necessary for the lawful creation and execution of the
work. Artist shall attend the necessary BID committee and board meetings, as well as the Public
Art Advisory Commission, in order to help secure BID and city approval of the artwork.
d) The artist will install the artwork that has been approved by the BID and the city. Any
minor changes artist deems necessary to enhance the composition or color in the artwork after
that approval, will be subject to approval by the BID Director, and done with no additional
charge to the client.
e) Client shall pay half of presented budget to artist before work begins to cover initial artist
expenses and materials.
g) Artist will apply protectant sealer/ anti graffiti coating once murals are complete.
3. Start and completion dates:
The artist shall undertake the creation of the artwork between the months of November and
December 2018. Dates may change, depending on permitting and weather.
4. Fees and schedule of payment:
Price of artwork: 415.62 per box . total amount 1662.50 for a total of 4 boxes.
Materials: approximately 30% of total
Upon execution of this agreement, client shall pay to the artist:
a) 50% due when project begins
b) 50% due on day of completion
5.Copyright:
Artist shall retain all copyrights of the artwork. The artist shall be entitled to advance notice of
any publicity or photographic reproduction of the work. As well as, be entitled to customary and
appropriate identification as the creator of the work.
6. Maintenance of the Work:
Client shall notify the artist promptly in the event of the need for any maintenance or restoration
services. Artist will restore the artwork in the event of light damage at no additional cost, up to
10 hours of work per year, for 5 years. Restoration that exceeds the 10 hour limit will be
compensated at $25 per hour. In the event of severe damage that exceeds the hourly limit of
maintenance per year, Artist shall be reasonably compensated at $25 per hour, by the client for
maintenance and/or restoration services rendered. In absence of any need for restoration or
maintenance, the work shall remain free of alteration by the client. If the artist is unreachable or
unavailable to perform any necessary maintenance or restoration services, after reasonable
efforts by the client, the client is permitted to contract with another party to perform maintenance
or restoration of the artwork.
7. Delay:
If the execution of the work is delayed by an act or neglect of the client, by labor disputes, fire,
unusual transportation delays, or by other external forces or natural calamities outside the
artist’s control, the artist shall be entitled to extend the completion date via verbal or written
notification to the client, by the time equivalent to the period of such delay.

Rights Act, 17 U.S.C §§106A and 113(d) (”VARA”), the California Art Preservation Act, Cal. Civil Code §§ 987 and 989
(”CAPA”), and any rights arising under United States federal or state law or under the laws of another country that convey

Utility Boxes
Shifra presented the four new designs from Eduardo Valadez, the same artist the BID used
previously, to install on four additional utility boxes. Randy questioned the historical accuracy of
the corn design. Roy suggested that the depiction of the “temascalli” looked like an igloo. Shifra
explained that the final image would be in color, and so wouldn’t look like a white igloo. Roy
suggested that the corn design be changed to acorns to be more historically accurate. General
agreement to keep the original corn design. Randy motioned to approve the utility boxes as
presented; motion was seconded by Tom. Approved unanimously.

CollegeoftheArtstocreate15designsreflectingthe
generalthemeof"Temescal:PasttoPresent."
NowtheTemescalBIDisworkingwithoneofthose
artists,EduardoValadez,todecoratefourmoreboxes
usingthesametheme,inspiredbythelocalfloraand
fauna,historicalbuildingsandtheOhlonepeople.The
proposedboxlocationsanddesignsare:

Temescalarea,renderedinarealisticfashionand
whosefeatherswillincorporatenativepatterns.

ThisboxwillfocusontheTemescal'shistoricnamesake,
"Temescalli,"whichisatraditionalceremonialsweat

Eduardo Valadez is a Mexican artist from Mexico City currently
working in southern California and the bay area. His work is
primarily community based focusing on interactive and
collaborative projects with a multidisciplinary focus of Writing,
Painting, and social sculpture. He is the Founder of the
conceptual project and group La Cocina Loca, Artist fellow at
YBCA , and freelance mural and graphic designer .

artworktodeterpeoplefromusingtheutilityboxesasafrequentcanvasfortags.Weplantoworkwiththesameartistas
lasttime(EduardoValadez)topainttheboxeswithartthatreflectsthediverseTemescalcommunityandbusinesses.We
willfinishwithanantigraffiticoat,andthenmaintaintheboxeswithworkperformedbyournormalBlockbyBlockcleaning
team.
Canyouapproveusdecoratingfourmoreboxes,givenweadheretoyournormalrules:
·Allvents,lockopeningsandhingesmustremainfreeofforeignmaterialswhichcouldimpedetheirfunction.
·Allmaterialsmustbenontoxic/noncorrosiveandadheretothesurfaceinamannerwhichpreventsthemfrom
erodingorsheddingintothestormwatersystem.
·TheCityofOaklandwillnotberesponsibleforanyartworkappliedtothecabinetsandintheeventthatthecabinet
mustbereplaced,theartworkwillnotbesavedorreturnedtotheartist.
·ShouldtheartworknotbemaintainedinamannerwhichreflectspositivelyontheCityandthecommunityordoes
notallowfordesignedoperationoftheunits,itwillberemovedfromthecabinetsurfaceorthecabinetreplacedandtheart
workwillnotbesavedorreturnedtotheartist.
