1. The operator shall be responsible for notification of arrival and/or departure of any
and all fireworks. Notification shall be made to the pre-designated fire official.
2. As soon as the fireworks have been delivered to the display site, they shall not be left
unattended, and they shall be kept dry. Unauthorized persons and the public shall be
kept away from the fireworks.
3. All fire protection for the display site shall be in place as pre-determined by the pre-
designated fire official.
4. The sponsor/operator is responsible for providing monitors whose sole duty shall be
the enforcement of crowd control, shall be located around the display area, the
loading site and off loading site and at other locations as pre-determined by the fire
official and the operator.
5. Monitors shall be positioned around the discharge site to prevent spectators or any
other unauthorized persons from entering the discharge site. The discharge site shall
be so restricted throughout the display and until the discharge site has been inspected
after the display. Where required by the fire official, approved delineators or barriers
shall be used to aid in crowd control.
6. All operators shall be at least twenty-one (21) years old and licensed by the
Maryland State Fire Marshal.
7. All assistants shall be at least eighteen (18) years of age.
8. The operator shall provide a representative to the pre-designated fire official with a
current/valid Pyrotechnician License(s) issued by the Maryland State Fire Marshal
prior to the set-up of the display (s).
9. The names of all the licensed pyrotechnicians and their assistants shall be provided to
the fire official.
10. The operator is responsible for ensuring that all assistants are fully trained in the
proper performance of their assigned tasks and that they are knowledgeable of safety
hazards.
11. Display site shall be furnished with a minimum of three (3) experienced personnel,
one (1) of which shall be licensed by the Maryland State Fire Marshal as a
Pyrotechnician.
12. No smoking shall be allowed within fifty feet (50’) of any area where fireworks or
other pyrotechnic materials are present.

13. The sponsor/operator (s) shall be responsible for set-up of outdoor display(s) of
fireworks in Accordance with NFPA 1123 Outdoor Display of Fireworks.
14. The sponsor/operator is responsible for notification of the Federal Aviation
Administration, (FAA). A signed confirmation letter from the FAA shall be
submitted with the fireworks application.
15. Pyrotechnicians/operators shall furnish adequate personnel for cleanup and policing
of each display area after the displays have been fired. Said personnel shall remove
all unexploded fireworks, trash, wire, remove wooden framework, sets and lumber,
and refill holes in the sand etc.
16. Whenever, in the opinion of the Fire Authority or the operator, that any adverse
condition exists and affects safety, the fireworks display shall be postponed until the
condition is corrected.
17. Parachute flare-type fireworks are prohibited.
18. All fireworks shall be electronically fired “No Manual Firing Shall be Permitted”.
19. Only the operator and necessary assistants shall be permitted in the discharge area.
20. No person shall be allowed in the discharge area while under the influence of
alcohol, narcotics, or medication that could adversely affect judgment, mobility, or
stability.
21. The operator(s) shall discuss with the pre-designated fire official prior to the
fireworks display the proper disposal of any unfired/misfired shell(s).
22. A shell shall be fired five (5) minutes prior to the scheduled fireworks display. The
shell shall be observed carefully to determine that its trajectory is such that the shell
functions over the fallout area that any dangerous debris or unexploded shells will
land in the fall out area.
23. Immediately following the display but no sooner than Thirty (30) minutes after the
show, no one will be permitted within fifty (50) feet of any mortars. It is the
responsibility of the shooter to inspect the mortars to insure a shell has not fired.
When a shell does not fire from a mortar the operator shall warn the authority
jurisdiction. The operator shall be responsible for the proper disposal of any and all
misfired shell(s) that remain.
24. Following the display, the firing crew shall conduct an inspection of the fallout area
for the purpose of locating any unexploded aerial shells.
25. Ground display shall be located at a minimum distance of 100 ft. from a
spectator viewing area, any tents, and combustible materials.

26. Poles for ground display pieces shall be securely placed and firmly braced in order
they will not fall over during functioning of the firework device.
27. The site for the outdoor land or water display shall have a radius at least as great as
specified for those items in the display with the greatest required radius. For aerial
shells, the minimum required radius of the display site shall be 100 ft per inch of the
internal mortar diameter of the largest aerial shell to be fired.

29. The fireworks display company, the organization, or the individual shall be
responsible for having all required permit(s), (Maryland State Fire Marshals Office,
United States Coast Guard, Maryland Natural Resources Police etc.) for the
fireworks display(s). All required permits shall be submitted with the fireworks
display application and be onsite and made available upon request from the pre-
designated fire official.
30. All shells shall be properly labeled in order that they can be inventoried prior to the
firing of the display.
31. The fireworks company/shooter shall provide two (2) fire extinguishers at the
display site. Each fire extinguisher shall be U/L Listed Chemical Fire Extinguisher
having a minimum classification of 4A-40BC. Fire extinguishers must have a
current inspection tag from a company approved by the Maryland State Fire
Marshal.

Attach Insurance Certificate (Proof of Insurance); Town of Ocean City must be named as the additional insurer,
with one million dollar insurance coverage, thirty (30) day cancellation clause, to cover bodily injury, and
property damage for each display site.
The sponsor/operator is responsible for notification of the Federal Aviation Administration, (FAA). A signed
confirmation letter from the FAA shall be submitted with the fireworks application.
The fireworks display company, the organization, or the individual shall be responsible for obtaining the
fireworks display permit. The fireworks display application and a check and/or a money order in the amount of
$250.00 dollars shall be made payable to the Mayor and City Council, and received a minimum of thirty (30)
days prior to the performance.
*Pyrotechnicians/operators shall submit at the time of making application a detailed drawing or display
“blueprint” of the fireworks display site layout, which indicates the following:
a. Length and depth of area needed at each site for mortars, racks.
b. Minimum setback distances required at each site for the public.
c. Type of and location of protection for mortar launch areas.
d. Type and location of electronic firing device.
e. If shooting from a barge the size of the barge, (the size of the platform necessary to shoot the fireworks
safely in accordance with NFPA 1123). Length and depth of area needed for mortars and racks. If
applicable size and location of the safety shelter for the shooter.

**Should the shooters name change as indicated on the fireworks display application, the Office of the Fire
Marshal shall be notified in writing providing the shooters name change, Permit License # and expiration date.
The sponsor/operator is responsible for providing monitors whose sole duty shall be the enforcement of crowd
control. Monitors shall be located around the display area, the loading and off loading sites, and at other
locations as pre-determined by the fire official and the operator.
The sponsor/operator (s) shall be responsible for set-up of outdoor display(s) of fireworks in Accordance with
NFPA 1123 Outdoor Display of Fireworks.
The sponsor/operator (s) are responsible for providing an acceptable form of communications between the
shooter, security, monitors, site manager, and the fireworks display site-designated fire official.
