EXHIBIT A – NON-RESIDENT ENTERTAINER RIDER
Section 71.80(15), Wisconsin Statutes, requires that nonresident “entertainers” file a surety bond or cash deposit with the
Wisconsin Department of Revenue if the Total Contract Price for a performance in Wisconsin exceeds $7,000.00. The
bond or deposit, which is six percent (6%) of the Total Contract Price, must be filed with the Department of Revenue at
least seven (7) days before a performance. If the entertainer does not provide proof of filing the bond or deposit to the
“employer,” the employer is required to withhold, from the entertainer’s payment, the amount for which a bond or
deposit should have been provided.
The law defines “entertainer” as a “nonresident natural person who, for consideration, furnishes amusement,
entertainment or public speaking services, or performs in one or more sporting events in this state and includes both
employees and independent contractors.” Sec. 71.01(2), Wis. Stats. “Employer” is defined as “the resident person or firm
which engages the services of an entertainer. . . .” Sec. 71.80(15)(a), Wis. Stats.
The entertainer hereby acknowledges that it will not be posting a surety bond or cash deposit with the Wisconsin
Department of Revenue prior to the event. As a result, Marquette University will deduct six percent (6%) of the Total
Contract Price and transmit this amount directly to the Wisconsin Department of Revenue. Marquette University will
provide the entertainer with a receipt of this transmittal of funds at the time payment is made for the performance.
Total Contract Price does not include travel expenses (i.e., transportation, lodging, and meals).
