the County Administration Building in Tavares, Florida to consider requests for
variances and any other petitions that
may
be
submitted in accordance with Chapter
XIV
of
the
Lake County Land Development Regulations.

There was no response when Chairman Argento asked for any public comment.
AGENDA UPDATE
Michele Janiszewski, Chief Planner noted that Tab 5 has incorrect location map and confirmed
that incorrect document does not affect anything related to the variance. Ms. Janiszewski said
public comments had been received about Tab
3,
the Vyborny Property. There are three (3) letters
of
opposition, one (1)
of
concern and four ( 4) in support. The Board agreed to move this request
to the regular agenda.

Vyborny Property
Janie Barron, Senior Planner, presented the Vyborny Property variance. She said the property was
located at the intersection
of
the Wekiva Trail and Soaring Hawk Lane in the Sorrento area. The
Future Land Use Category is the Wekiva River Protection Area Sending AreaA-1-40 and is zoned
Agriculture. They applicant is requesting Family Density Exception lot split. However, the Lake
County Code Section 14.11.02.D. 7

requires the the lot to front on a publicly maintained road
and this variance would allow a lot fronting on an easement which connects to another easement
which connects to a publicly maintained road. In addition a variance is requested to Section
14.11.02.D.14 to allow a
lot
split that might change the character
of
the subdivision. Ms. Barron
noted there are other lots
of
similar size in that area
of
the subdivision but those front on a publicly
maintained road.
Ms. Barron explained the Vybrony's wanted to provide security for their son and grandson. She
said staff is recommending approval with the condition that the Family Density Exemption must
be presented within six (6) months, deed restrictions will
be
included stating the applicant will not
obligate the County
to
maintain Soaring Hawk Lane and the lot must not be the subject
of
any
other administrative lot split.
In response
to
questions from Bea Meeks, Ms. Barron said deed restrictions will be added
indicating that the lot had
to
remain with the family for five (5) years. Ms. Barron said there had
not been a previous lot split involving this property, the lot was created prior
to
1981
and it meets
the Lot
of
Record (LOR) definition.
In
response to Ms. Meeks' comments, Ms. Barron read the
hardship definition from
the
code.
Richard Backus asked about the condition
of
the easement and Ms. Barron deferred that question
to
the applicant.
Ronald
& Eric Vyborny, applicants, said they didn't realize that they were obligated to help
maintain the easement.
They
offered
to
improve the easement and said they would not
be
adversely impacting the condition
of
the easement.
Ronald Vyborny explained they want their son and grandson safely nearby. Eric Vyborny
described how this variance would make it easier to care for him
to
care for his son and meet his
shared custody agreement.
PUBLIC COMMENT
Bettina Beshere said she lives on Soaring Hawk Lane and was opposed
to
this variance. She is
concerned about maintaining the character the community, which is consists primarily
of
five (5)
acre lots. She thought the family could accomplish their goals without dividing the property adding
that she thought the property had been previously divided. She explained her concern was with the
division
of
the lot but she was not opposed to a second residence on the property. Her concern
was about increasing the density.

In response
to
Bea
Meeks, Ms. Beshere confinned her objection was
to
the subdivision
of
the
property, not to
the
additional residence.
In response
to
concerns from Richard Backus, Ms. Barron explained the applicant was given
incorrect information when he first contacted the County. He did not know the restrictions on his
property were different because it is located in the Wekiva Protection Ares. Accessory dwellings
in that area are limited
to
eight hundred (800) square feet but twelve hundred (1200) square feet is
allowed in other areas. There was discussion regarding the expense
of
applying for another
variance.
Ms.Beshere questioned the hardship issue, noting other homes were available for purchase in close
proximity
to
the grandparent's home.
Ms. Janiszewski
said
the applicant had to meet the intent
of
the code or have substantial hardship
or his situation
would
have
to
violate the principles
of
fairness. Mr. Backus noted that not
approving the application would create a financial hardship and was concerned about the applicant
being given incorrect information in the first place. He questioned subdividing the property. Ms.
Janiszewski said
the
board should approve or disapprove.
In discussion with Eric Vyborny, Ms. Meeks confirmed that placing his mobile home in another
community would create a financial hardship because his parents were giving him the property
that is the subject
of
this variance. She noted that there could
be
other financial considerations.
Mr.
Vyborny explained that he would like a larger home
to
one day accommodate a future family.
Ms. Wuensche!
noted
that they were still dealing with hardship issue. Eric Vyborny detailed his
financial situation that led them
to
apply for the variance.
The applicant, Mr. Vyborny, said he had no objection
to
placing his son's mobile home on his
property. Eric Vyborny said the two homes would have
to
be similar in construction style and
failure
to
do
that
would
necessitate another variance.
Ms. Beshere asked about the "other means
to
achieve," Ms. Janiszewski said both residences have
to
be the same construction style.
Ms. Wuensche!
said
she didn't like lot splits but she believed this this family has a hardship. Mr.
Backus said he opposed to lot splits, he preferred to use other methods
to
meet the need.

I
am
a neighbor
of
Tina Beshere and Michelle Pasternak. I am not sure the county regulations are the same, but
I was advised when I purchased this property that it had been divided once, one acre cut
off
to build the home
out behind this area, newly sold, but previously owned by Sheila McCartney and that it could not be divided
again. Hence the 4 acre
size
vs.
5 acres as the other properties
off
Soaring Hawk Lane are.
I also had checked
to
see
if
I could add an in-law type home and was advised that was acceptable but it would
remain whole.
I
am
opposed to subdividing this property as it will set a precedent for others and change the nature
of
the area.
This regulation is one
of
the
reasons I purchased in the area. To keep the area rural and pristine.
I reside at 31607 Soaring
Hawk
Lane.

Attention Janie Barron re. Var-19-12-4 Vyborny,
While I'm sorry for Mr. Vybornys family problems I am adamantly opposed to creating a double lot to allow 2
mobile homes on the property. This would change the appearance and character
of
our private road and
neighborhood. And I feel it would decrease my property value by creating a "mini trailer park" with a hodge
podge
of
buildings, (they also have an RV.)
I was also under the impression that the 5 acre parcel had already been divided when Hal Gentry owned it back
in the 80s and they had a variance approved and one acre was carved out for the home on the south end
of
that
lot. How many times is this allowed?
In addition the problem
is
road maintenance. All
of
the neighbors contribute to maintaining the road and as far
as I know the Vyborny's did not pay their share. That being said they have been here about a year now and
maybe they are not aware
of
their responsibility to help maintain the road. I'm sure they are very nice people.
Surly there must be a better solution to their problem. Perhaps a "Mother
in
Law" dwelling, something that does
not
require dividing the property.

the Vyborny subdividing
their
property.
We feel
that
it
would change the appearance and character
of
our private neighborhood. Thus, decreasing
our
property
value.
In
addition, we maintain the road, Wekiva Trail and Soaring Hawk
Ln.
The roads are in pretty
bad
shape. Although a
few
of
us
pay a company
to
grade the road when needed, not all the neighbors contribute
to
the maintenance.
So
the
cost
is
borne
by
a
few
but
used
by
all.
It
appears
that
the
Vyborny's would
not
be
in a position
to
contribute
to
the road
maintenance although they would
have
2 families using the road.
The
variance indicates
that
it
is
a family hardship variance. However, when they decide
to
sell the property
the
lots
would most likely
be
sold
to
a non family member.
It
is
my understanding
that
the property
has
already been subdivided in the past.
It
originated
as
5 acres and 1 acre
was
carved
off
leaving the 4 acres.
The
stipulation was the same,
that
the property could
not
be
further
subdivided.
So,
how
is
it
that
the
Vyborny's
can
subdivide again.
Does
that
mean, when they sell,
that
the
new owners can, again,
subdivide? When does this end?
This
could
turn
into a mini trailer park right
in
the
middle
of
our neighborhood.
They should be able
to
find a-solution
to
their
issue
without
subdividing
their
property.

informed

an
upcoming variance hearing regarding splitting a
lot
at 32100 Wekiva Trail
for
the
son
of
Ron
and
Rebecca
Vyborny's
son
Eric
to build a home on. Although I
am
not
a direct neighbor to
them, I would like to express my opinion
on
the matter. Eric
is
the kind
of
neighbor everyone would
be
glad
to have, always willing t o help you
out
no
matter
what
it
is
you need. Over the past
few
storm
seasons
whenever there was a storm
that
caused
damage, Eric
is
always there, chain saw in hand, ready
to
help
his
neighborhood
with
clearing the streets
or
your driveway
so
both the public and first
responders
can
get thru.
After
the hurricane last year,
Eric,
myself, my son, and a few other neighbors
were out
as
soon
as
it
was safe and cleared the trees from Wekiva River
Rd
first, then went street
to
street, driveway to driveway, clearing tr
ees
and debris
so
people could get in and
out
of
the
neighborhood.
On
several occasions I have seen him
on
the side
of
Wekiva River
Rd
helping a stranded motorists, one
day
he
actually came
to
my
house and asked
to
borrow a socket
to
help someone change a tire, since
they were not fa r from
my
house I went with him and the people
he
was helpi
ng
were from
ou
t
of
state,
not
even
anyone
he
knew.
Eric
would
be
a welcome addition
to
our
neighborhood, I would
be
glad
to
call him my nieghnor any day
of
the week.
