I hereby consent to my child’s enrollment in the NorthWest Arkansas Community College (“NWACC”) Kids
College Summer 2019 program (“Kids College”). In consideration of such enrollment and my child’s right to
participate in Kids College, I hereby agree as follows:
A. I understand that photographs and video of my child may be taken during his or her participation in Kids
College activities and consent to their use in future NWACC publications and/or on the NWACC website
or social media for marketing purposes.
B. I understand that inappropriate behavior or disciplinary problems on the part of my child may result in
disciplinary action up to and including my child’s dismissal from Kids College without a refund.
C. I understand that my child’s participation in Kids College activities is completely voluntary. Furthermore,
I understand that my child will be participating in hands-on and experiential learning activities that involve
inherent risks of injury. I voluntarily agree to expressly assume all such risks which may result
from any such activities or are in any way related to my child’s participation in Kids College.
D. I further hereby consent to release from any future liability or negligence NWACC and its trustees,
employees, faculty, staff, agents, instructors, and all individuals assisting with Kids College for injury,
personal property damage, or death caused by or resulting from my child’s participation or in any way
connected with my child’s participation in Kids College, whether such injury, personal property damage,
or death was caused by NWACC, its representatives, another participant, or any other person or cause.
E. I agree to defend and indemnify NWACC for loss or damage, including any that result from claims or
lawsuits for personal injury, death, or personal property damage, relating to Kids College or use of
NWACC facilities or equipment.
F. I authorize any person connected with Kids College or NWACC to administer first aid to my child as
deemed necessary. I authorize medical and surgical care and transportation to a medical facility or
hospital for treatment necessary for my child’s well-being, at my expense.
G. I acknowledge that certain individuals holding enhanced carry permits are allowed to carry concealed
handguns on NWACC’s campus pursuant to Ark. Code Ann. § 5-73-322 and that the presence of any
such weapons on NWACC property is outside of NWACC’s control.
H. This agreement is governed by the laws of the State of Arkansas, and exclusive jurisdiction shall be in
the circuit court of Benton County, Arkansas and/or the United States District Court, Fayetteville,
Arkansas division. If any part of the agreement is determined to be unenforceable, all other parts shall
be given full force and effect.
I. This Kids College Liability Waiver will apply for each and every day my child participates in Kids College.
J. The undersigned parent or guardian acknowledges that she/he is signing this agreement on behalf of a
minor and that the minor shall be bound by the terms of the agreement. This agreement shall be binding
on the participant’s assignees, subrogors, heirs, next of kin, executors and personal representatives.
I HAVE READ AND UNDERSTOOD THIS RELEASE OF LIABILITY AGREEMENT. I VOLUNTARILY
AGREE TO ITS TERMS.

Please note that the liability waiver must be signed before your child can participate in Kid’s College. You can
sign it electronically and email it to sreagan@nwacc.edu or you may print, sign and bring it on or before the
first day of drop-off.
