InorderfortheZBOAtoapproveaVariance,itmustfindallofthefollowingcriteriahavebeenmet:
1. Grantingthevariancewillnotbecontrarytothepublicinterest.
2. Enforcingthecodeprovisionwillresultinanunnecessaryhardshipduetothefollowingsituationsthat
areuniquetotheproperty:irregularityassociatedwiththesizeorshapeofthelot,uniquetopography
orsomeotheruniquephysicalsituationassociatedwiththeproperty.Anunnecessaryhardshipdoesnot
relatetoconvenience,financialconsideration,ortheapplicant’sownactions.
3. Grantingthevariancewillbeconsistentwith
thespiritofthecity’sZoningOrdinance.
IftheZBOAapprovestheVariancerequest,thentheapplicantwillhave90daysfromthedateofthemeetingto
obtainanynecessarybuildingpermitsforconstruction.IftheZBOAdeniestheVariancerequest,thentheapplicant
mayfileapetition
tothecourtinaccordancewithSection106‐196oftheCityofLaPorte’sCodeofOrdinances.

CODEREQUIREMENTS
Sec.106‐192.‐Variance.
(a)Applicationforvariances.Allapplicationsforavariancefromthetermsofthischaptershallbeinwritingandshallspecifythe
factsinvolved,thereliefdesired,andthegroundsthereof.Eachsuchapplicationshallbefiledwiththeenforcementofficerwho
afterinvestigationshalltransmitsuchapplicationtogetherwithhisreporttotheboardofadjustmentwithintendaysafterthe
filingoftheapplicationwiththeenforcementofficer.
(b)Findingsoffact/definitionofhardship.
(1)Theterm"variance"shallmeanadeviationfromtheliteralprovisionsofthischapterwhichisgrantedbytheboard
whenstrictconformitytothischapterwouldcauseanunnecessaryhardshipbecauseofthecircumstancesuniquetothe
propertyonwhichthevarianceisgranted.
(2)Exceptasotherwiseprohibited,theboardisempoweredtoauthorizeavariancefromarequirementofthischapter
whentheboardfindsthatallofthefollowingconditionshavebeenmet:
a.Thatthegrantingofthevariancewillnotbecontrarytothepublicinterest;
b.Thatliteralenforcementofthischapterwillresultinunnecessaryhardshipbecauseofexceptionalnarrowness,
shallowness,shape,topographyorotherextraordinaryorexceptionalphysicalsituationuniquetothespecificpiece
ofpropertyinquestion."Unnecessaryhardship"shallmeanphysicalhardshiprelatingtothepropertyitselfas
distinguishedfromahardshiprelatingtoconvenience,financialconsiderationsorcaprice,andthehardshipmustnot
resultfromtheapplicantorpropertyowner'sownactions;and
c.Thatbygrantingthevariance,thespiritofthischapterwillbeobserved.
(3)Theapplicantshallhavetheburdenofprovingtotheboardthattheforegoingconditionshavebeenmet.
(c)Usevarianceprohibited.Novarianceshallbegrantedtopermitauseinazoningdistrictinwhichthatuseisprohibited.
(d)Hearingsonapplicationsforvariances.Theboardofadjustmentshallfixareasonabletimeforthehearingofallapplications
forvariances,givepublicnoticethereof,aswellasduenoticetothepartiesininterest,anddecidethesamewithinareasonable
time,asspecifiedinsection106‐194(Noticeofpublichearingsbeforetheboardofadjustments).Uponthehearinganypartymay
appearinpersonorbyagentorbyattorney.
