InorderfortheZBOAtoapproveaSpecialException,itmustfindallofthefollowingcriteriahavebeenmet:
1.
Suchrequestwillnotadverselyaffectthevalueanduseofadjacentorneighboringpropertyorbe
contrarytothepublicinterest
.
IftheZBOAapprovestheSpecialExceptionrequest,thentheapplicantwillhave90daysfromthedateofthe
meetingtoobtainanynecessarybuildingpermitsforconstruction.IftheZBOAdeniestheSpecialExceptionrequest,
thentheapplicantmayfileapetitiontothecourtin
accordancewithSection106‐196oftheCityofLaPorte’sCode
ofOrdinances.

CODEREQUIREMENTS
Sec.106‐191.‐Specialexceptions.
(a)Applicationforspecialexceptions.Allapplicationsforspecialexceptiontothetermsofthischaptershallbeinwritingandshall
specifythefactsinvolved,thereliefdesired,andthegroundsthereof.Eachsuchapplicationshallbefiled,alongwiththe
appropriatefees,withtheenforcementofficerwhoafterinvestigationshalltransmitsuchapplicationtogetherwithhisreportto
theboardofadjustmentwithintendaysafterthefilingoftheapplicationwiththeenforcementofficer.
(b)Specialexceptionstobereviewed;findingoffacts.Theterm"specialexception"shallmeanadeviationfromtherequirements
ofthischapter,specificallyenumeratedherein,whichshallbegrantedonlyinthefollowinginstances,andthenonlywhenthe
boardfindsthatsuchspecialexceptionwillnotadverselyaffectthevalueanduseofadjacentorneighboringpropertyorbe
contrarytothebestpublicinterest:
(1)Toreconstruct,enlargeorextendabuildingoccupiedbyanonconforminguseonthelotortractoccupiedbysuch
building,providedthatthereconstruction,extension,orenlargementdoesnotpreventthereturnofthepropertytoa
conforminguse.
(2)Todeviateyardrequirementsinthefollowingcircumstances:
a.Anyexceptionfromthefrontyardrequirementswheretheactualfrontyardsetbackofanyabuttinglotdoesnot
meetthefrontyardrequirement.
b.Arearyardexceptionwheretheactualrearyardsetbackofanyfourormorelotsinthesameblockdoesnotmeet
therearyardrequirementsoftheseregulations.
c.Ayardexceptiononcornerlots.
d.Anexceptionwheretheexistingfrontyardsetbacksofthevariouslotsinthesameblockarenotuniform,sothat
anyoneoftheexistingfrontyardsetbacksshall,forbuildingshereafterconstructedorextended,betherequired
minimumfrontyarddepth.
(3)Towaiveorreduceoff‐streetparkingandloadingrequirementswhentheboardfindsthesameareunnecessaryforthe
proposeduseofthebuildingorstructureforwhichthespecialexceptionrequestapplies.
(4)Todeviatefromtheminimumlotsizeorwidthrequirementsforpropertywithinthelargelotdistrict,wheretheboard
findsthatallofthefollowingconditionsareshown:
