OVERVIEW
ASpecialExceptionprovidesanopportunityforcertainexemptionsforvariouscoderequirementswhenaproperty
isdesignatedasnonconforming.TheseexemptionsarefullyoutlinedinSection106191oftheCityofLaPorte’s
CodeofOrdinances,andincludecertainreductionsorwaiverstoparkingrequirements,deviationstoyard
requirements
incertaincircumstances,deviationsfromlotsizeorlotwidthintheLargeLotDistrict(LL),and
reconstructionorexpansionofnonconformingbuildings.SpecialExceptionrequestsarereviewedbytheZoning
BoardofAdjustment(ZBOA)afterapublichearing.SpecialExceptionsmayonlybeapprovediftheZBOAfindsthat
suchrequestwillnotadverselyaffectthevalueanduseofadjacentorneighboringpropertyorbecontrarytothe
publicinterest.TheZBOAconsistsofresidentsofthecommunityappointedbyCityCouncil.TheZBOAmeetsonthe
fourthThursdayofeverymonth,asnecessary.

ThefollowingapplicationpackagemustbesubmittedtothePlanningandDevelopmentDepartmentatleastthree(3)
weekspriortothedesiredhearingdate.

ApplicationfeeofResidential‐$150,Commercial‐$250;nonrefundable.
Siteplanorplotplan,drawntoscaleanddimensionedtoshowtheproposed
SpecialException.
Projectdescription/justificationletterthatthoroughlyexplainswhatisbeing requestedandwhysuchSpecial
ExceptionshouldbeapprovedbytheZBOA.
Affidavitofpostingfullyexecutedthatensuresthea pplicantwillposttherequiredpublichearingsignonthe
subjectpropertyforatleast10daysprior
tothemeetingdate.SuchsignwillbeprovidedbythePlanningand
DevelopmentDepartment.
PROCESS
UponreceiptofacompleteapplicationpackagebythePlanningandDevelopmentDepartment,theSpecial
ExceptionrequestwillbescheduledforthenextavailableZBOAmeetingdate.
ThePlanningandDevelopmentDepartmentwillprovideaNoticeofPublicHearingsigntotheapplicantthatmust
bepostedonthe
propertywheretheSpecialExceptionisbeingrequested.Thesignmustbepostedontheproperty
visibleandwithin20feetfromtheabuttingstreetforaminimumof10daysbeforethescheduledpublichearing.
ThePlanningandDevelopmentDepartmentwillpublishnoticeofthepublichearingin
theBayAreaObserverandat
CityHallinconformancewithlegalrequirements.Additionallythecitywillsendnoticeofthepublichearingtoall
propertyownerswithin200feetofthesubjectpropertywheretheSpecialExceptionisbeingrequested.
TheZBOAmeetingwillbeheldinthe
CityCouncilChamberatCityHall(604W.FairmontParkway).Atthemeeting,
theZBOAwillconductthepublichearingandprovidearulingontheSpecialExceptionrequest.

InorderfortheZBOAtoapproveaSpecialException,itmustfindallofthefollowingcriteriahavebeenmet:

Suchrequestwillnotadverselyaffectthevalueanduseofadjacentorneighboringpropertyorbe
contrarytothepublicinterest
.
IftheZBOAapprovestheSpecialExceptionrequest,thentheapplicantwillhave90daysfromthedateofthe
meetingtoobtainanynecessarybuildingpermitsforconstruction.IftheZBOAdeniestheSpecialExceptionrequest,
thentheapplicantmayfileapetitiontothecourtin
accordancewithSection106196oftheCityofLaPorte’sCode
ofOrdinances.
ThefollowingisanexcerptfromtheCityofLaPorte’sCodeofOrdinancespertainingtoSpecialExceptions.
CODEREQUIREMENTS
Sec.106191.‐Specialexceptions.
(a)Applicationforspecialexceptions.Allapplicationsforspecialexceptiontothetermsofthischaptershallbeinwritingandshall
specifythefactsinvolved,thereliefdesired,andthegroundsthereof.Eachsuchapplicationshallbefiled,alongwiththe
appropriatefees,withtheenforcementofficerwhoafterinvestigationshalltransmitsuchapplicationtogetherwithhisreportto
theboardofadjustmentwithintendaysafterthefilingoftheapplicationwiththeenforcementofficer.
(b)Specialexceptionstobereviewed;findingoffacts.Theterm"specialexception"shallmeanadeviationfromtherequirements
ofthischapter,specificallyenumeratedherein,whichshallbegrantedonlyinthefollowinginstances,andthenonlywhenthe
boardfindsthatsuchspecialexceptionwillnotadverselyaffectthevalueanduseofadjacentorneighboringpropertyorbe
contrarytothebestpublicinterest:
(1)Toreconstruct,enlargeorextendabuildingoccupiedbyanonconforminguseonthelotortractoccupiedbysuch
building,providedthatthereconstruction,extension,orenlargementdoesnotpreventthereturnofthepropertytoa
conforminguse.
(2)Todeviateyardrequirementsinthefollowingcircumstances:
a.Anyexceptionfromthefrontyardrequirementswheretheactualfrontyardsetbackofanyabuttinglotdoesnot
meetthefrontyardrequirement.
b.Arearyardexceptionwheretheactualrearyardsetbackofanyfourormorelotsinthesameblockdoesnotmeet
therearyardrequirementsoftheseregulations.
c.Ayardexceptiononcornerlots.
d.Anexceptionwheretheexistingfrontyardsetbacksofthevariouslotsinthesameblockarenotuniform,sothat
anyoneoftheexistingfrontyardsetbacksshall,forbuildingshereafterconstructedorextended,betherequired
minimumfrontyarddepth.
(3)Towaiveorreduceoffstreetparkingandloadingrequirementswhentheboardfindsthesameareunnecessaryforthe
proposeduseofthebuildingorstructureforwhichthespecialexceptionrequestapplies.
(4)Todeviatefromtheminimumlotsizeorwidthrequirementsforpropertywithinthelargelotdistrict,wheretheboard
findsthatallofthefollowingconditionsareshown:

a.Thatoneormorelotslocatedinthesameblockasthesubjectpropertyarenotuniformintermsofshapeand/or
sizesothatanyfurthersubdivisionofthesubjectpropertycannotbeinaccordancewiththeregulationsgoverning
thedistrict;
b.Itcanbedemonstratedthatthesubdivisionwillnotcircumventthespiritofthedistrictregulations,orparticularly,
theruralcharacterofthedistrict;and,
c.Grantingthespecialexceptionwillnotbeinjurioustothevalueorenjoymentofadjacentpropertieswithinthe
district.
(c)Hearingsonapplicationsforspecialexceptions.Theboardofadjustmentshallfixareasonabletimeforthehearingofall
applicationsforspecialexceptions,givepublicnoticethereof,aswellasduenoticetothepartiesininterest,anddecidethesame
withinareasonabletimeasspecifiedinsection106194(Noticeofpublichearingsbeforetheboardofadjustments).Uponthe
hearinganypartymayappearinpersonorbyagentorbyattorney.
