OVERVIEW
ApprovalofaSpecialConditionalUsePermit(SCUP)isrequiredunderthefollowingcircumstances:
1. Toconsiderapprovalofcertainusesidentifiedas“ConditionalUses”inthecity’sCommercialandIndustrial
Usetable(Section106310ofCityofLaPorteCodeofOrdinances)andResidentialUsetable(Section106
331).

2. WhendevelopingpropertyinaPlannedUnitDevelopment(PUD)zonedistrict,considerationofaSCUPis
requiredinaccordancewithSection106659oftheCodeofOrdinances.
SCUPrequestsarereviewedbythePlanningandZoningCommissionasapublichearing.TheCommissionconsists
ofresidentsofthe
communityappointedbyCityCouncil.TheCommissionmeetsonthethirdThursdayofevery
month,asnecessary.TheCommissionwillforwardarecommendationtotheCityCouncilforfinalconsideration.
SUBMITTALREQUIREMENTS
ThefollowingapplicationpackagemustbesubmittedtothePlanningandDevelopmentDepartmentatleastthree(3)
weekspriortothedesiredhearingdate.
Completedapplicationform.
Applicationfeeof$400;nonrefundable.
Siteplan,conceptualsiteplanorgeneralplan,drawntoscaleanddimensionedtoshowthe
locationof
proposedimprovementsforthedevelopment.
Projectdescription/justificationletterthatthoroughlyexplainswhatisbeing requestedandwhysuchSCUP
shouldbeapprovedbythePlanningandZoningCommissionandCityCouncil.
Affidavitofpostingfullyexecutedthatensuresthea pplicantwillposttherequiredpublichearingsignon
the
propertyforatleast10dayspriortothePlanningandZoningCommissionmeetingdate.Suchsignwillbe
providedbythePlanningandDevelopmentDepartment.
PROCESS
UponreceiptofacompleteapplicationpackagebythePlanningandDevelopmentDepartment,theSCUPrequest
willbescheduledforthenextavailablePlanningandZoningCommissionmeetingdateasapublichearing.
ThePlanningandDevelopmentDepartmentwillprovidetheapplicantwithaNoticeofPublicHearing
signthatmust
bepostedonthepropertywheretheSCUPisbeingrequested.Thesignmustbepostedonthepropertyvisibleand
within20feetfromtheabuttingstreetforaminimumof10daysbeforethescheduledpublichearing.
ThePlanningandDevelopmentDepartmentwillpublish
noticeofthepublichearingintheBayAreaObserverandat
CityHallinconformancewithlegalrequirements.Additionally,thecitywillsendnoticeofthepublichearingtoall
propertyownerswithin200feetofthesubjectpropertywheretheSCUPisbeingrequested.

ThePlanningandZoningCommissionpublichearingwillbeheldintheCityCouncilChamberatCityHall(604W.
FairmontParkway).Atthemeeting,thePlanningandZoningCommissionwillconductapublichearingandprovidea
recommendationtotheCityCouncilontheproposedSCUP.Ifadditional
informationisrequestedbythe
Commission,thepublichearingmay becontinuedtoafuturemeetingdate.
TheCommissionandCityCouncilmayimposespecialconditionsonanSCUPinanattempttoensurecompatibilityof
theproposeddevelopmentwithsurroundingpropertiesandthecommunityasawhole.
TheCommissionistaskedtoreviewtheproposedSCUPandofferarecommendationtotheCityCouncilfor
approval,denial,orapprovalwithconditions.
FollowingtheCommission’spublichearing,theirrecommendationonthepropos ed SCUPisthenforwardedtoCity
Councilforconsideration.
FortheCityCouncilpublic
hearing,thePlanningandDevelopmentDepartmentwillpublishnoticeofthepublic
hearingintheBayAreaObserverandpostnoticeatCityHallinconformancewithlegalrequirements.
TheCityCouncilpubl ichearingwillbeheldintheCityCounci lChamberatCityHall(604W.FairmontParkway).
At
themeeting,theCityCouncilwillconductapublichearingandrenderadecisionontheproposedSCUP.However,if
additionalinformationisrequeste dbytheCityCouncil,thepublichearingmaybecontinuedtoafuturemeeting
date.

Sec.106216.‐Generalconditionsforallconditionalusesinallzoningdistricts.
(a) Aspecialc onditionalusepermitmaybegrantedbythecitycouncilfo rtheconstructionofabuildingand/orthe
establishmentofauseasdescribedinthisoranyothersect i on,upon
atractoflandinsingleownershiporunderunified
control.
(b) Uponapplicationforaspec ial conditionalusepermitandsubmissionofageneralplan,majordevelopmentsiteplan,
minordevelopmentsite plan,orpreliminaryplat(asthecasemaybe),thecityplanningand zoningcommissionshall conduct
a
publichearing,dulyadvertisedandwithpropernoticebeinggiventoallpartiesaffecte d,asprovidedinsection106 171
(Amendmentprocedures).Th egeneralsiteplan,majo rdevelopmentsiteplan,minordevelopmentsiteplan,orpreliminary
platshallbedrawntoscaleandsha l lshow thearrangementoftheprojectindetail,including parkingfacilities,location of
buildings,build ingusestobepermitted,meansof ingres sandegr ess, andotherpertinent
info r ma t io n,together withthe
informationrequiredbythedevelopmentordinanceofthecity.
(c) Afterpublichearinganduponrecommendat i onofth ecityplanningandzoningcommission,thecitycouncilmay
modifythefinalplannedunitdevelopmentplanandissueaspe cialconditionalusepermitcontainingsuchrequirementsand
safeguards
asarenecessarytoprotectadjoiningproperty.
(d) Failuretobeginconstructionwithinoneyearafterissuanceorasscheduled underthe termsofaspecial conditional
usepermitshallvoidthepermitasapp r ove d, exceptuponanextensionoftimegrantedafterapplicationtoth eplanningand
zoningcommission.

(e) Ifconstructionisterminatedafterthecompletionofan ystageandthere isampleevidencethatfurtherdevelopment
isnotcontemplated,thedivisionestablishingsuchspecialconditionalusepermitmayberescindedbythecitycounc il, upon
itsownmotionorupontherecommendationoftheplanningandzoni ngcommission
ofthecity,andthepreviouszoningof
theenti re tractshall beinfulleffectonth eportionwhichisundeveloped.
(f) Everyspecialcond itiona lusepermitgranted asprovidedhereinshallbeconsideredasanamendmenttothezon ing
ordinanceasapp lic ab letosuch property.
Sec.106
217.‐Conditionsforapproval.
Aspecialc onditionalusepermitshallbeissuedonlyifallofth efollowingconditionshavebeenfound:
(1) Thatthespecificusewillbecompatible withandnotinjuriou stotheuseandenjoy men t ofotherproperty,
norsignificantlydiminishorimpairpropertyvalueswithin
theimmediatevicinity.
(2) Thattheconditionsplacedonsuchuseasspecifiedineachdistricthavebeenmetbyth eapplicant . 
(3) Thattheapplic ant hasagreed tomeetanyadditionalconditionsimposed,basedonspecificsitecon straints,
andnecessarytoprotectthepublicinte r est andwelfareofthe
community.

Theprocedurefor amendmentsforaspecia l conditionalusepermitshallbethesa measforanewapplicat ion . 
