ThePlanningandZoningCommissionpublichearingwillbeheldintheCityCouncilChamberatCityHall(604W.
FairmontParkway).Atthemeeting,thePlanningandZoningCommissionwillconductapublichearingandprovidea
recommendationtotheCityCouncilontheproposedSCUP.Ifadditional
informationisrequestedbythe
Commission,thepublichearingmay becontinuedtoafuturemeetingdate.
TheCommissionandCityCouncilmayimposespecialconditionsonanSCUPinanattempttoensurecompatibilityof
theproposeddevelopmentwithsurroundingpropertiesandthecommunityasawhole.
TheCommissionistaskedtoreviewtheproposedSCUPandofferarecommendationtotheCityCouncilfor
approval,denial,orapprovalwithconditions.
FollowingtheCommission’spublichearing,theirrecommendationonthepropos ed SCUPisthenforwardedtoCity
Councilforconsideration.
FortheCityCouncilpublic
hearing,thePlanningandDevelopmentDepartmentwillpublishnoticeofthepublic
hearingintheBayAreaObserverandpostnoticeatCityHallinconformancewithlegalrequirements.
TheCityCouncilpubl ichearingwillbeheldintheCityCounci lChamberatCityHall(604W.FairmontParkway).
At
themeeting,theCityCouncilwillconductapublichearingandrenderadecisionontheproposedSCUP.However,if
additionalinformationisrequeste dbytheCityCouncil,thepublichearingmaybecontinuedtoafuturemeeting
date.

Sec.106‐216.‐Generalconditionsforallconditionalusesinallzoningdistricts.
(a) Aspecialc onditionalusepermitmaybegrantedbythecitycouncilfo rtheconstructionofabuildingand/orthe
establishmentofauseasdescribedinthisoranyothersect i on,upon
atractoflandinsingleownershiporunderunified
control.
(b) Uponapplicationforaspec ial conditionalusepermitandsubmissionofageneralplan,majordevelopmentsiteplan,
minordevelopmentsite plan,orpreliminaryplat(asthecasemaybe),thecityplanningand zoningcommissionshall conduct
a
publichearing,dulyadvertisedandwithpropernoticebeinggiventoallpartiesaffecte d,asprovidedinsection106 ‐171
(Amendmentprocedures).Th egeneralsiteplan,majo rdevelopmentsiteplan,minordevelopmentsiteplan,orpreliminary
platshallbedrawntoscaleandsha l lshow thearrangementoftheprojectindetail,including parkingfacilities,location of
buildings,build ingusestobepermitted,meansof ingres sandegr ess, andotherpertinent
info r ma t io n,together withthe
informationrequiredbythedevelopmentordinanceofthecity.
(c) Afterpublichearinganduponrecommendat i onofth ecityplanningandzoningcommission,thecitycouncilmay
modifythefinalplannedunitdevelopmentplanandissueaspe cialconditionalusepermitcontainingsuchrequirementsand
safeguards
asarenecessarytoprotectadjoiningproperty.
(d) Failuretobeginconstructionwithinoneyearafterissuanceorasscheduled underthe termsofaspecial conditional
usepermitshallvoidthepermitasapp r ove d, exceptuponanextensionoftimegrantedafterapplicationtoth eplanningand
zoningcommission.
