I
PURPOSE
The purpose of this policy is to recognize that the problem of substance abuse, and the
profound effects it has on our society. In order to provide for a safer work environment, the
Freehold Boro Police Department has established this substance abuse policy.
This policy compliments G.O. 2-16 Early Warning System/Monitoring and Rules and
Regulations 3:6.1 Alcoholic Beverages and drugs, which establishes guidelines to assist with
the early identification of potential problem members/employees and to reference other
departmental policies and procedures that must also be utilized to effectively carry out this
process
Urine and breath samples shall be ordered from a law enforcement officer when there exists
facts that provide a reasonable objective basis to suspect the officer is illegally using drugs or
alcohol, or when conducting a random drug and alcohol testing program. Urine samples
ordered based on a reasonable objective basis shall not be ordered from an officer without the
approval of the county prosecutor or the chief executive officer of this agency or someone
acting in the capacity during his/her absence.
Note: Nothing in this policy is to be interpreted as constituting a waiver of management’s
responsibility to maintain discipline or the right to take disciplinary action against the employee.
II
POLICY
It is the policy of the Freehold Boro Police Department to have a drug/alcohol free work
environment for the personnel of this agency and for the people it serves. The law
enforcement profession has several uniquely compelling interests that justify the use of
employee drug and alcohol testing. The public has a right to expect that those who are sworn
to protect them are at all times both physically and mentally prepared to assume these duties.
There is sufficient evidence to conclude that the use of controlled substances and other
forms of drug and alcohol abuse will seriously impair an employee’s physical and mental
health, and thus, their job performance.
Therefore, in order to ensure the integrity of the Freehold Boro Police Department, and to
preserve public trust and confidence in a fit and drug and alcohol free law enforcement
profession, this department shall implement a Substance Abuse Policy to detect prohibited
drug and alcohol use by sworn law enforcement officers.
III
DEFINITIONS
A.
Alcohol:Theintoxicatingagentinbeveragealcohol,ethylalcoholorother
molecularweightalcoholsincludingmethylorisopropylalcohol.
B.
Alcoholconcentration:Thealcoholinavolumebreathintermsofgramalcohol
per210litersofbreathasindicatedbyabreathtest,orthealcoholmeasuredby
gramsofalcoholper100millilitersofblood
C.
Alcoholuse:Theconsumptionofanybeverage,mixtureorpreparation
includingmedications,containingalcohol.
D.
AnabolicSteroids:AnabolicSteroidsareaclassofnaturalandsyntheticsteroid
hormonesthatpromotecellgrowthanddivision,resultingingrowthofmuscle
tissueandsometimesbonesizeandstrength.
E.
Applicant:Anypersonwhoisapplyingand/orinterviewingtobeamemberof
thePoliceDepartment.
F.
Cancelledtest:AdrugtestthathasbeendeclaredinvalidbytheMedicalreview
officer(MRO).Thesubjectisneitheraverifiedpositivenornegativetest,and
includesaspecimenrejectedfortestingbyalaboratory.
G.
ChainofCommand:TheunbrokenlineofauthorityextendingfromtheChiefof
Policethroughasinglesubordinateateachlevelofcommanddowntothelevelof
execution.Thechainofcommandshallalsobecarriedinreverse.
H.
Confirmationtest:Asecondanalyticalproceduretoidentifythepresenceofa
specificdrugormetabolitethatisindependentofthescreeningtestandthatusesa
differenttechniqueandchemicalprinciplefromthatofthescreeningtesttoensure
reliabilityandaccuracy.Inalcoholtesting,asecondtest,followingascreeningtest
witharesultof0.02orgreater,whichprovidesquantitativedataofalcohol
concentration.
I.
Controlledsubstances:Theterms“drugs”and“controlledsubstances”shallinclude
allderivativesofthefollowingclassesofdrugs.Marijuana,Cocaine,Opiates
(Heroin,etc),Phencyclidine(PCP),Amphetamines,Barbituates,Benzodiazepine,
Propoxyphene,MethadoneandMethaquadoneandcontrolledsubstanceanalogs
thatproducesimilareffects.
J.
CriminalDrugStatute:Afederalorstatestatueinvolvingthe
manufacture,distribution,dispensing,useorpossessionofany
controlledsubstance.
K.
Drug:Anysubstance(otherthanalcohol)thathasknownmindorfunctionaltering
effectsonahumansubject,specificallyincludinganypsychoactivesubstanceand
including,butnotlimitedto,controlledsubstanceandcontrolledsubstance
analogsthatproducesimilareffects.
L.
EAP/EmployeeAssistanceProgram:aprogramdesignedtoprovideameansto
ensurethatallswornandnonswornmembersofthedepartmenthaveaccesstoa
mechanismthatwilladministertotheemployee’smentalwellnessandfurnisha
rehabilitationprogramneededtomaintainastable,healthyandproductivework
environment.
M.
MedicalReviewOfficer:Thedesignateddoctororcontractphysician(s)appointed
bythechiefexecutiveofficerorhis/herdesigneewithappropriatemedical
trainingand
knowledge of substance abuse conditions, authorized to receive, review and
report laboratory drug test results.
N.
Member:AnyswornemployeeofthepolicedepartmenttoincludeSLEO1andSLEO
2
O.
Monitor/Specimencollector:Thechiefexecutiveofficerorhis/herdesigneeshall
designateamemberofhis/herstafftoserveasmonitorofthespecimen
acquisitionprocess.Themonitorshallalwaysbeofthesamesexastheindividual
beingtested.Intheeventthereisnomemberofthesamesexavailablefromthe
agencycollectingthespecimens,theagencymayrequestthatamemberofthe
samesexfromanotherlawenforcementagencyserveasmonitoroftheprocess.
P.
Possess:Tohaveonone’spersonorinone’spersonaleffectsorunderone’scontrol.
Q.
Prohibiteddrug:Prohibiteddrugsshallincludebutnotbelimitedtothe
following;Marijuana,Cocaine,Opiates,Phencyclidine,Amphetamines,
Barbituates,Benzodiazepine,Propoxyphene,MethadoneandMethaquadone.
Anysubstance(otherthanalcohol)thathasknownmindorfunctionaltering
effectsonahumansubject,specificallyincludinganypsychoactivesubstanceand
including,butnotlimitedto,controlledsubstanceandcontrolledsubstance
analogsthatproducesimilareffects.
R.
RandomSelection:Amethodofselectioninwhicheachandeveryswornemployee
ofthislawenforcementagency,regardlessofrankorassignment,hasanequal
chancetobeselectedfordrugandalcoholtestingeachandeverytimeaselection
isconducted.
S.
RandomTest:Adrugandalcoholtestadministeredtoapredetermined
percentageofemployeeswhoareperformingasafetysensitivefunctionand
whoareselectedperiodicallyonascientificallydefensiblerandomand
unannouncedbasis.
T.
ReasonableSuspicion:Thatquantityofprooforevidencethatismorethanahunch,
butlessthanprobablecause.Reasonablesuspicionmustbebasedonspecific,
objectivefactsandanyrationallyderivedinferencesfromthosefactsaboutthe
conductofanindividualthatwouldleadthereasonablepersontosuspectthatthe
individualisorhasbeenusingdrugsand/oralcoholwhileonoroffduty.
U.
Refusaltosubmittoatest:Failuretoprovideadequatebreathoralcoholtestingor
aurinespecimenfordrugtestingasrequired,withoutvalidmedicalexplanation
afteranapplicant,trainee,employeeormemberhasreceivednoticeofthe
requirementtobetestedinaccordancewiththeprovisionsofthispolicyor
engaginginconductthatclearlyobstructsthetestingprocess.
V.
SwornEmployee:Thoseemployeeswhohavebeenformallyvestedwithfulllaw
enforcementpowersandauthority.Aswornemployeeinthisordershallalso
includethetermsOfficer,Employee,MemberandIndividual.
W.
Trainee:Anewlyappointedpoliceofficerattendinginitialtrainingatan
approvedacademybythepolicetrainingcommission.
X.
VerifiedNegativeDrugTestResult:Adrugtestresultreviewedbyamedical
reviewofficeranddeterminednottobeevidenceofuseofaprohibiteddrug.
Y.
VerifiedPositiveDrugTestresult:Adrugtestreviewedbyamedicalreview
officeranddeterminedtobeevidenceofuseofaprohibiteddrug.
IV
PROCEDURE
A.
TypesofDrugTesting
For purposes of this policy the types of drug testing conducted by this agency
is as follows;
1.
PrePlacementTesting.AllapplicantstotheFreeholdBoroPoliceDepartment
shallbesubjecttopreemploymenttesting.Inadditionanypromotionor
lateraltransfertoadifferentassignmentmaybesubjectedtopreplacement
testing.
2.
RandomSelectionTesting.Allmembersshallbesubjecttorandom,
unannounceddrugscreening.
3.
ReasonableSuspicionTesting.Basedonspecific,contemporaneous,articulable
observationsconcerningamember’sappearance,behavior,speech,odoror
indicationsofuseorwithdrawalfromaprohibitedsubstanceandoralcohol,
drugscreeningmayberequired.
4.
FitnessforDutyTesting:Urinespecimensmaybecollectedfrommembersduring
aregularlyscheduledandannouncedmedicalexaminationorafitnessforduty
examinationbasedonpreplacementtestingandorreasonablesuspiciontesting.
5.
PostaccidentTesting.Anymemberwhoisinvolvedinanondutyaccidentresulting
inlossoflifeorcausesanyoftheinvolvedpersonsorthemselvestoseek
immediatemedicaltreatmentshallberequiredtoundergoadrugandoralcohol
screeningbasedonspecific,contemporaneous,articulableobservationsconcerning
amember’sappearance,behavior,speech,odororindicationsofuseorwithdrawal
fromaprohibitedsubstanceandoralcohol.
a.
Postaccidenttestingshallbeconductedinaccordancewiththe
ReasonableSuspicionTesting,locatedinsectionIVEofthispolicy.
B.
Drug Testing
1.
TheFreeholdBoroPoliceDepartmentconsiderscooperationwithdrugand
alcoholscreeningofitsapplicantsandmemberstobeanecessaryconditionof
continuedemploymentwiththisdepartment.
2.
Employeesofthedepartmentshallnottakeanymedicationwhichmaydiminishtheir
alertnessorimpair theirsensespriortoorafterreportingfordutyunlessdirectedby
aphysician.
3.
Whenemployeesarerequiredtotakeanyprescriptionmedicationoranynon‐
prescriptionmedicationwhichmaydiminishtheiralertnessorimpairtheirsenses,
theemployeeshallnotifytheirsupervisorastothemedicationrequired,its
properties,thedosageandtheperiodduringwhichtheemployeeisrequiredtotake
themedication.Thisnotificationshallbebytheprescribingphysician.Ifthe
medicationisanon‐prescriptiondrugtheemployeeshallmakethisnotification.The
requirednotificationshallbemadepriortotheemployeereportingforduty.This
informationsoprovidedshallbeconfidential.Certainprescriptivedrugsmayalteran
officer’sphysicaland/ormentalabilitywhichmayrendertheofficerunfitforduty.
4.
Reportingtoworkfortheperformanceofdepartmentbusinessorotherwisebeing
onFreeholdBoropropertyorbeingundertheinfluenceofdrugsoralcoholwhileon
dutyisprohibitedexceptunderthefollowingconditions:
a.
Approvedbonafidepolicetrainingconductedbyamunicipal,county,state
orfederallawenforcementagency.
b.
Specialinvestigationsconductedbyplainclothesorundercoverofficers
withpriorapprovaloftheChiefExecutiveOfficerandorhis/herdesignee.
(1)
Anyassignmentsofthisnatureshallrequirepriorwrittenauthorization
fromtheChiefExecutiveOfficerandorhis/herdesigneeandshallbe
strictlylimitedtotheuseofalcoholicbeverages.
5.
TheFreeholdBoroPoliceDepartmentrequiresasaconditionofemploymentthat
allemployeesshallprovideanegativeresultandthatapositiveresultwillresultin:
a)theemployeesterminationfromemployment;b)inclusionoftheofficer'sname
inthecentraldrugregistrymaintainedbytheDivisionofStatePolice;andc)the
officer being permanently barred from future law enforcement employment in New
Jersey.
6.
Whenanapplicanttestspositiveforillegaldruguse:
c. Theapplicantshallbeimmediatelyremovedfromconsiderationfor
employmentbytheagency;
d. TheapplicantshallbereportedtotheCentralDrugRegistrymaintainedbythe
DivisionofStatePolicebythelawenforcementagencytowhichtheindividual
applied;theapplicantshallbeprecludedfromconsiderationforfuturelaw
enforcementemploymentbyanylawenforcementagencyinNewJerseyfora
periodoftwoyears.
e. Wheretheapplicantiscurrentlyemployedbyanotheragencyasaswornlaw
enforcementofficer,theofficer'scurrentemployershallbenotifiedofthe
positivetestresult.Underthesecircumstances,theofficer'scurrentemployeris
requiredtodismisstheofficerfromemploymentandalsoreporthisorhername
totheCentralDrugRegistrymaintainedbytheDivisionofStatePolice.
7.
Whenaswornlawenforcementofficerortraineetestspositiveforillegaldruguse:
f. Theofficerandortraineeshallbeimmediatelysuspendedfromallduties;
g. Theofficerandortraineeshallbeterminatedfromemploymentasa
lawenforcementofficer,uponfinaldisciplinaryaction;
h. TheofficerandortraineeshallbereportedbyhisorheremployertoCentral
DrugRegistrymaintainedbytheDivisionofStatePolice;and
i. Theofficerandortraineeshallbepermanentlybarredfromfuture
lawenforcementemploymentinNewJersey.
8.
Consequencesofarefusaltosubmittoadrugtest:
j. Applicantswhorefusetosubmittoadrugtestduringthepreemployment
processshallbeimmediatelyremovedfromconsiderationforlawenforcement
employmentandbarredfromconsiderationforfuturelawenforcement
employmentforperiodoftwoyearsfromthedateoftherefusal.Inaddition,the
appointingauthorityshallforwardtheapplicant'snametotheCentralDrug
Registryandnotethattheindividualrefusedtosubmittoadrugtest.
k. Traineeswhorefusetosubmittoadrugtestduringbasictrainingshallbe
immediatelyremovedfromtheacademyandimmediatelysuspendedfrom
employment.Uponafindingthatthetraineedidinfactrefusetosubmita
sample,thetraineeshallbeterminatedfromlawenforcementemploymentand
permanentlybarredfromfuturelawenforcementemploymentinNewJersey.In
addition,theappointingauthorityshallforwardthetrainee'snametothe
CentralDrugRegistryandnotethattheindividualrefusedtosubmittoadrug
test.
l. Swornlawenforcementofficerswhorefusetosubmittoadrugtestorderedin
responsetoreasonablesuspicionorrandomselectionshallbeimmediately
suspendedfromemployment.Uponafindingthattheofficerdidinfactrefuse
tosubmitasample,theofficershallbeterminatedfromlawenforcement
employmentandpermanentlybarredfromfuturelawenforcementemployment
inNewJersey.Inaddition,theappointingauthorityshallforwardtheofficer's
nametotheCentralDrugRegistryandnotethattheindividualrefusedtosubmit
toadrugtest.
m. Aswornlawenforcementofficerwhotestspositiveforillegaldruguseor
refusestosubmittoadrugtest,andwhoresignsorretiresinlieuofdisciplinary
actionorpriortothecompletionoffinaldisciplinaryaction,shallbereportedby
hisorheremployertoCentralDrugRegistryandshallbepermanentlybarred
fromfuturelawenforcementemploymentinNewJersey.
9.
TheChiefofPoliceorhis/herdesigneemayconductsearcheswithoutfurthernotice
andwithoutreasonablesuspicionforillegaldrugsandoralcoholonFreeholdBoro
propertyandorlocationswherepropertyownedandorissuedbyFreeholdBorois
storedandorlocated.Allsearchesshallbeconductedinaccordancewithallexisting
StateandFederallaws.
Property subject to searches and or places to be searched may include the
following but shall not be limited to:
n. Anyandallstoragelocationssuchas:
(1)
AllvehiclesownedbyFreeholdBororegardlessoflocationincludingany
andallcontainersandorcompartmentslocatedtherein.
(2)
LockerslocatedonFreeholdBoroproperty.
(3)
Officesowned,maintainedoroccupiedbyFreeholdBoroemployees.
(4)
Desksowned,maintainedbyFreeholdBoro.
(5)
Safesowned,maintainedbyFreeholdBoro.
(6)
Garbageandgarbagereceptacles
(7)
Refrigerators
(8)
UniformsissuedandorwornbyFreeholdBoroemployees.
10.
Theprovisionsofthispolicyshallbesubjecttoanylimitationsorrequirements
imposedbyfederalorstatelaw.Ifanysectionofthispolicyisinvalidatedforbeing
contrarytoanylaw,precedentorregulation,theremainingsectionsshallremain
infullforceandeffect.
C.
Pre-employment police academy drug screening
Given the Department’s concern for drug or alcohol use interfering with the safety of the
workforce and the public with whom this agency has contact, all offers of employment
with this agency shall be conditioned on the applicant’s ability to pass a drug/alcohol
screening given at the police academy.
1.
Failuretopassadrug/alcoholscreenwillresultinthewithdrawalofaconditional
offerofemployment.Whenaswornofficeriswithdrawnforthisreason,the
applicantwillbebarredfromapplyingforanyotherlawenforcementpositionfor
aperiodnotlessthantwoyears.Resultsofpreviousfaileddrugscreeningmaybe
consideredinsubsequentjobapplications.Applicantsthataredeniedfull
employmentstatusmayrequestcopiesofthetestresultsfromthepolice
academy.
2.
AllapplicantsshallbenotifiedoftheFreeholdBoroSubstanceAbusePolicy(This
Standard Operating Procedure), and the mandatory drug screening withinthe
policeacademyatthetimetheycompletetheirjobapplication.
3.
Intheeventadrugscreenisdeterminedtobeinvalidorunreliablebythe
laboratory,butNOTduetomisconduct,theapplicantwillbeimmediatelynotified
ofthisfactandrequiredtosubmittoanewtest.Ifasampleisdeterminedtobe
unreliableduetomisconductoftheapplicant,theindividualwillberegardedas
havingviolatedthispolicyandsubjecttononhiringoranyotherappropriate
discipline.Testingmisconductincludes,butisnotlimitedtodilutingthespecimen,
substitutingsamplesorattemptingtoadulteratethespecimen.
D.
Random Testing
Members shall be subject to unannounced, random drug testing. The testing may take
place in house, or while attending any authorized law enforcement training facility.
Establish a system by which the selection process can be verified and documented.
Permit a representative of the collective bargaining unit(s) to witness the
selection process.
Provide that any member of the agency who discloses the identity of an officer selected
for random testing or the fact that a random selection is scheduled to take place prior
to the collection of urine specimens shall be subject to discipline.
1.
Thenamesofallmembersshallbeplacedinapoolfromwhicharandomselection
willbemade.Eachtimerandomsamplingisinitiated,theChiefofPoliceandorhis
designeeexceptforamemberoftheinternalaffairsunitwillconducttherandom
sampling.
a.
Therandomgenerationsshalloccurtwo(2)timesduringacalendaryear
(approximatelyoncepercalendarquarter).3Swornofficerseachgenerationwill
beselectedforthesample.Thetotalwillbe6officersselectedforthecalendar
year.Thisequatestoapproximately20%oftheoverallmanpowerforthis
departmenteachyear.
2.
Randomselectionverification:
a.
Lottery/Bingostyleballsofsimilarsizeandweightwillbenumberedstarting
with1andprogressivelyendingwiththetotalamountofswornofficers.
b.
Acorrespondingswornofficermasternamelistwillbekeptassigningasworn
officertoacorrespondingballnumber.
c.
Amemberfromeachcollectivebargainingunionifapplicableandthe
monitorselectedbytheChiefofPolicewillverifythenumberofballsused
andthecorrespondinglistofswornofficers.
d.
Onceverificationhasbeenmadetheunionrepresentativesandthemonitor
willsigntheswornofficermasternamelistpage.
3.
Randomselectiondrawing:
a.
ThemonitorappointedbytheChiefofPolicewilladheretothe
followingprocedureforballselection.
b.
Toensurethattheballsaredrawninarandomordertheballcagewillbespun
ten(10)timesineachdirectionbeforeanyballsaredrawn.
c.
Theballcagewillbespunthree(3)timesexactlystoppingatthebottom
d.
Themonitorwilldrawtheballfromthecollectionsectionoftheballcage.
e.
Themonitorwillrecordtheballnumberselectedontherandomselection
testingpage.
f.
Themonitorwillrepeatthisprocessuntilalloftheballshavebeenselected.
g.
Theballnumberdrawnbythemonitorwillbecheckedagainstthesworn
officermasternamelist.Thecorrespondingnamewillrepresentthesworn
officerselectedforrandomtesting.
h.
Anindividualwillbeadvisedthattheyareselectedforrandomdrugtestingonly
whentheyareonduty.Ifthememberisselectedonadayorshiftwhenhe/she
isnotworking,thatmemberwillbeadvisedupontheirreturntowork.Oncean
individualisnotifiedofselectionfortestinghe/shemustimmediatelyreportto
thecollectionfacility.Therandomtestingfrequencylevelshallbein
conformancewiththestandardsestablishedbytheofficeoftheChiefofPolice.
i.
Amemberwhoproducesapositivedrug/alcoholtestinviolationofthispolicy
orwhorefusestosubmittotestingunderthispolicyshallbedismissedfrom
thisagency.
j.
Theidentityofanyswornmemberwhohasproducedapositivedrugtestshall
bereportedtotheCentralRegistrymaintainedbytheDivisionofStatePolice.
4.
Membersshallreportevidenceofsuspecteddrugusebyothermembersto
theirimmediatesupervisorortheinternalaffairsofficer.
5.
Membersshallreportevidenceofsuspectedalcoholabusebyothermembersto
theirimmediatesupervisorortheinternalaffairsofficer.
E.
Reasonable Suspicion Testing
Members shall be required to submit to drug and or alcohol screening based on a
reasonable suspicion that they have violated the provisions of this policy.
“Reasonable Suspicion” must be based on specific, contemporaneous, articulable
observations concerning an individual’s appearance, behavior, speech, odor, or
indications of use or withdrawal from substances prohibited by this policy. This will
include and not be limited to testing for Anabolic Steroids and alike.
1.
Beforeanofficermaybeorderedtosubmittoadrugtestbasedonreasonable
suspicion,theagencyshallprepareawrittenreportwhichdocumentsthebasisfor
thereasonablesuspicion.Thereportshallbereviewedbythecountyprosecutoror
thechiefexecutiveofficerofthelawenforcementagencybeforeareasonable
suspiciontestmaybeordered.Underemergentcircumstances,approvalmaybe
givenforareasonablesuspiciontestonthebasisofaverbalreport.
2.
Wheneverpractical,twosupervisorsshouldconferandagreethatreasonable
suspicionexistspriortorequestingthatanindividualsubmittotesting.However,
whenonlyonesupervisorisavailable,thatsupervisorshouldattempttocontact
theChiefofPolice oroneofthedivisioncommandersandtheinternalaffairs
officer.
a.
Whenactingonreasonablesuspicionthatanindividualmaybeinviolationof
thispolicy,asupervisorshallmakeallattemptstorespecttheindividual’s
privacy.
b.
Questioningshouldbedoneinaprivatesetting.
c.
Supervisorsaretolimittheirconversationsregardingpossibleviolationsof
thispolicytothosepersonswhoareparticipatinginquestioning,evaluation,
investigation,ordisciplinaryactiononaneedtoknowbasis.Supervisorsare
toinstructotherindividuals,exceptasnotedabove,nottotalkaboutpossible
violations.
3.
Inallinstances,thesupervisorshallmakeawrittenrecordoftheobservations
leadingtoreasonablesuspiciontestingonan“observedbehavior”.Suchrecord
shallbesignedbythesupervisorwhomadesuchobservationsimmediately
concerningtheobservedbehavior.Wheneverpractical,acopyofthewritten
recordwillaccompanytheindividualtothetestingfacility.Reasonablesuspicion
testingshouldnotbebasedsolelyonthirdpersonobservationsorreports,unless
thesupervisor(s)canverifyandindicatefurthersuchobservationstobereliable.
4.
Prior to ordering “Reasonable Suspicion” drug and alcohol screens the Chief
of Police must be notified and approve of the testing of the individual in writing
on an order to submit.
5.
Anyindividualsubmittingtodrugandalcoholscreeningunderreasonablesuspicion
circumstanceswillbeimmediatelytofollowIV,F,1ofthispolicyorbeescortedtoa
designatedtestingfacility.
6.
Afterasampleisprovided,theindividualwillnotbepermittedto:
a.
OperateanyTownshipEquipment
b.
TheOfficerinChargeoftheshiftoradesigneeappointedbytheChiefofPolice
willtakepossessionoftheofficer’sdepartmentissuedweapon(s).
c.
Ifnecessary,theindividualwillwaitinadesignatedareauntilarrangements
aremadefortransportationtohis/herhome.
d.
Attemptstocontacttheindividual’sspouseorfamilymemberwillbemade
totransporttheindividualhome.
e.
Iftheindividualrejectsthesealternatives,thePoliceDepartmentwilltake
appropriatemeasurestoprohibittheindividualfromoperatinghis/her
vehicle.
7.
Individualstestedunderreasonablesuspicioncircumstancesshallbeplacedon
administrativedutywithpaypendingthetestresults.Ifthetestresultsarenegative,
theindividualmaybeevaluatedforfitnessfordutypriortobeingreinstatedtofull
Duty.Iftheresultsarepositive,theindividualwillbesubjectedtothe
implementationofdisciplinaryproceedings.
8.
Noncompliancewithanordertosubmittoreasonablesuspiciontesting,todisclose
andexplainthenatureofanysuspectedsubstance,toleavetheworkareaor
townshipfacilities,oranyotherreasonablerequestshallbeviewedas
insubordinationandtheindividualwillbesubjecttodisciplineuptoandincluding
dismissal.

Specimen Collection and Testing Procedures
Members will be required to sign appropriate forms prior to testing. The forms include,
but are not limited to,

The Freehold Boro Police Department shall designate a member of its staff to serve as
monitor of the specimen acquisition process. The monitor shall always be of the same
sex as the individual being tested. In the event there is no member of the same sex
available from the agency collecting the specimens, the agency may request that a
member of the same sex from another law enforcement agency serve as monitor of the
process.
The monitor of the specimen acquisition process shall be responsible for:
Ensuringthatalldocumentationisfullyandaccuratelycompletedby
theindividualsubmittingthespecimen.
Collectingspecimensinamannerthatprovidesforindividualprivacywhile
ensuringtheintegrityofthespecimen.
Complyingwithchainofcustodyproceduresestablishedforthecollection
ofurinespecimensandtheirsubsequentsubmissiontotheNewJersey
StateToxicologyLaboratorywithintheDivisionofCriminalJusticefor
analysis.
Theanalysisofeachspecimenshallbedoneinaccordanceproceduresadopted
bytheStateToxicologyLaboratory.Theseproceduresshallincludebutnotbe
limited to security of the test specimens, chain of custody, metabolite cut-off
levels and the issuance of test reports.
In order to safeguard the integrity of the specimen’s chain of custody the following
collection procedures shall be utilized.
1.
Priortothesubmissionofaurinespecimen,swornmembersshallcompletea
medicalquestionnaire(AttachmentA)whichclearlydescribesallmedications,both
prescriptionandoverthecounter(nonprescription),thatwereingestedinthepast
14days.
2.
Throughoutthetestprocess,theidentityofindividualapplicantsandsw ornand
nonswornmembersshallremainconfidential.Individualspecimensshallbe
identifiedthroughouttheprocessbytheuseofsocialsecuritynumbers.Atnotime
shallanindividual'snameappearonanyformorspecimencontainersenttothe
StateToxicologyLaboratory.Priortothetestingtheindividualwillbegivenacopy
ofthespecimencollectionproceduresbythespecimencollector
3.
Specimenswillbecollectedutilizingequipmentandsuppliesapprovedbythe
StateToxicologyLaboratory.
4.
Thedonorwillberequiredtotakeoffalljackets,bags,pocketbooks,etc.,(anything
thatcouldcontainaconcealedspecimen),andwashtheirhandspriortoproviding
thespecimen.
5.
Thedonorwillbeescortedtoanareaforprovidingthespecimenthatrespectsthe
donor’sprivacywhilecomplyingwiththispolicy.Theenclosureshallprovidea
toilet.Inordertominimizeembarrassmentofthedonorandtopreventdistraction
ofthecollectionsitepersonnelaccesstotheenclosureduringtheentirecollection
processwillbeprohibited.Onlythespecimencollectorandthedonorshallbe
present.
6.
After the monitor has inspected the appropriate forms for accuracy, the
applicant, trainee or sworn officer shall void into the specimen collection
container. After a specimen has been produced, the individual shall seal the
specimencontaineranddeliverittothemonitor.
7.
Individualmemberswillvoidwithoutthedirectobservationofthemonitorunless
thereisreasontobelievethattheindividualwilladulteratethespecimenor
otherwisecompromisetheintegrityofthetestprocess.Underthesecircumstances,
theproductionofaspecimenmaybedirectlyobservedbythemonitor.Themonitor
mustdocumentthefactsunderlyingtheirbeliefthatamembermayadulteratea
specimenorcompromisetheintegrityofthetestprocess.
8.
Toavoidtheriskofadulteratedordilutedspecimens,waterandcleaningagentsare
prohibitedintheenclosure.Similarly,abluingordyingagentwillbeplacedinthe
toilet.Onlyonetestistobeperformedatatime.Testingofanotherdonorwillnot
begin(includingfillingoutofnecessaryforms)untilthetestingprocessofthe
currentdonoriscompletedandthespecimenissecured.
9.
Oncethemonitorissatisfiedthattherequireddocumentationisaccurateandhe
orshehasinspectedthespecimencontainertodeterminethataspecimenhas
beenproduced,themonitorshalltakepossessionofthespecimenandensure
thatitisdeliveredtotheStateToxicologyLaboratoryforanalysis.
10.
TheNewJerseyStateToxicologyLaboratorywithintheDivisionofCriminalJustice
willconstitutethesolefacilityfortheanalysisoflawenforcementdrugtests.
11.
TheurinesamplesshallbedeliveredtotheNewJerseyStateToxicologyLaboratory
withintheDepartmentofCriminalJusticewithinthenext3businessdaysbya
memberofthelawenforcementagencyorsomeoneapprovedbytheChiefof
Police.
12.
Collectionsitepersonnelwillverifythatanadequateamountofurinewasprovided.
Ifthespecimentemperaturedoesnotfallwithinarangeof90°Fto100°Fthenthe
collectionsitepersonnel,within4minutes,mayrequestthatthedonorhavetheir
oraltemperaturetaken.Ifthedonor’sbodytemperaturevariesbymorethan1.8°F,
fromthespecimentemperature,thecollectionsitepersonnelshallrequesta
secondspecimenfortesting.Ifthedonorrefuses,tohavetheirtemperaturetaken,
thisshallbegroundstoconsiderthespecimenashavingbeentampered.
13.
Ifthecollectionsitepersonnelnoteanyunusualcolororsignofcontaminantsin
thespecimen,asecondspecimenshallberequested.Inallinstanceswherea
secondspecimenisrequested,theoriginal(suspect)specimenshallbeforwarded
tothelaboratoryfortesting.
14.
Theemployee/membershallhavetheoptiontoprovidethemonitorwithasecond
urinespecimenatthesametimethefirstspecimeniscollected.Thesecond
specimenshallbecollectedinthesamefashionasthefirstspecimen.Themonitor
shalltakepossessionofthesecondspecimenandplaceitinasecuredrefrigerated
storagearea.TheFreeholdBoroPoliceDepartmentshallmaintainpossessionofthe
secondspecimenforaperiodof60daysoruntiltheagencyreceivesnotification
fromtheStateToxicologyLaboratorythatthefirstspecimentestednegativeforthe
presenceofcontrolledsubstances.
15.
ThesecondspecimenshallbereleasedbytheFreeholdBoroPoliceDepartment
underthefollowingcircumstances:
a.
ThelawenforcementagencyisnotifiedbytheStateToxicologyLaboratorythat
thefirstspecimentestedpositiveforacontrolledsubstance;and
b.
Thelawenforcementagencyisinformedbytheindividualwhosespecimen
testedpositivethattheindividualwishestohavethespecimenindependently
tested;and
c.
Thememberemployeemustdesignatealaboratorythatislicensedasaclinical
laboratorybytheNewJerseyDepartmentofHealthundertheNewJersey
ClinicalLaboratoryImprovementActtoconducttheindependenttest;and
d.
Arepresentativeofthelicensedclinicallaboratorydesignatedbythe
individualtakespossessionofthesecondspecimeninaccordancewith
acceptedchainofcustodyprocedureswithin60daysofthedatethe
specimenwasproduced.
16.
Individualsthatinitiallyareunabletoproduceaurinespecimenmayremainunder
thesupervisionofthetestmonitoruntilthemonitorissatisfiedthattheindividual
cannotproduceaspecimen.Whiletheindividualisundersupervision,themonitor
mayallowtheindividualtodrinkfluidsinanattempttoinducetheproductionofa
specimen.Iftheindividualremainsunabletoprovideaspecimenaftera
reasonableperiodoftime,themonitormayhavetheindividualexaminedbya
doctortodeterminewhethertheinabilitytoproduceaspecimenwastheresultof
amedicalorphysicalinfirmityorconstitutedarefusaltocooperatewiththedrug
testingprocess.
17.
Laboratoryandmedicalpersonnelareresponsibleforcompletingtheappropriate
chainofcustodydocumentation,ensuringthatproperproceduresarefollowedto
protecttheintegrityofthesamplesandthereliabilityofthetestresults.The
appropriatechainofcustodyandcontrolformshouldbefilledoutbythecollection
sitepersonnelandthensignedbythedonor.Thespecimenistobekeptinthesight
ofboththedonorandthecollectionsitepersonnelfromthetimeitisdeliveredto
thetimeitisbeinglabeled.Thechainofcustodyformsmustbesignedbyboththe
collectionsitepersonnelandthedonor.
18.
Ifthespecimencontainerisreceivedatthatlaboratoryinanundamaged
condition,properlysealed,labeled,andinitialedascertifiedbythelaboratory,the
medicalreviewofficerandthepolicedepartmentwillbeprivilegedtorelyonthe
analysisofthespecimenssoreceived.
19.
Inreasonablesuspicioncircumstances,acopyofthesupervisorsreportwill
beforwardedtothemedicalreviewofficer.
20.
Thepolicedepartmentexpectsallofitsapplicantsandmemberstoexercisegood
faithwhenundergoingthescreenandensurethatpropertestproceduresare
adheredto.Thiswillguaranteethatthefinalresultsareaccurate.Failureorrefusal
toobservethesegoodfaithrequirementsmaysubjecttheindividualtoimmediate
discipline,uptoandincludingdismissal.
21.
Intheeventthataurinesampleisdeterminedtobeinvalidorunreliablebythe
collectionsitepersonnel,thelaboratoryanalyzingthesampleduetocircumstances
unrelatedtotheconductofthedonor,theapplicantemployeeormemberwillbe
immediatelynotifiedofthecircumstancesrequiringanewtest.Iftheurine sample
isdeterminedtobeinvalidorunreliableduetocircumstancesrelatedtothe
conductoftheindividual,theywillbesubjecttodiscipline,uptoandincluding
dismissal.
22.
Theanalysisofeachspecimenshallbedoneinaccordanceproceduresadoptedby
theStateToxicologyLaboratory.Theseproceduresshallincludebutnotbelimitedto
securityofthetestspecimens,chainofcustody,metabolitecutofflevelsandthe
issuanceoftestreports.
23.
TheStateToxicologyLaboratoryshallanalyzeeachspecimenforthefollowing
substancesandtheirmetabolites:
a.
amphetamine/methamphetamine;
b.
barbiturates;
c.
benzodiazepine;
d.
cannabinoids;
e.
cocaine;
f.
methadone;
g.
phencyclidine;and
h.
Opiates.
24.
Testingwillbelimitedtothepresenceofdrugsandtheirmetabolites.Underno
circumstanceswillthesamplebetestedforanyotherpurpose.Thepolice
departmentreservestherighttoexpandtheclassesofdrugsandmetabolitestested
ortomodifytheinitialandconfirmationtestingthresholds.
25.
Anytimespecimensaredeemedtobe“positive”bythelaboratoryand
MedicalReviewOfficerthespecimenwillbe retained.
26.
Positivetestresultswillberevealedtotheindividualonlyaftertheyhavebeen
verifiedbytheChiefofPoliceorhis/herdesignee.Theseresultsareconfidential
medicalinformationandmustnotberevealedordisclosedwithanyoneinthe
policedepartmentexceptonanabsoluteneedtoknowbasis,andthenonlyafter
theresulthasbeenconfirmed.Allindividualsnotifiedofconfirmedpositivetest
resultswillhave3businessdays,fromthetimeofnotification,torequestthatthe
secondspecimenbetestedifgivenatthetimeoftheoriginalsample.

27.
Applicantsormemberstakingadrugprescribedbyalicensedphysicianmust
presentthedruginitsoriginalcontainerwhichidentifiesthedrug,dosage,dateof
prescription,andauthorizingphysician.Itistheresponsibilityoftheindividualto
reviewwiththeirphysiciananyworkrestriction(s)thatshouldbeobservedwhileon
themedication.Incaseswhenuseofmedicationrequiresworkrestriction(s),itis
theresponsibilityoftheindividualtoreportsuchrestriction(s)tohis/hersupervisor.
Failuretoproperlynotifyasupervisorofsuchworkrestriction(s)shallbeaviolation
ofthispolicywhichmaysubjecttheindividualtodisciplineuptoandincluding
dismissal.
28.
Intheinterestofsafety,anindividualwhoseuseofmedicationnecessitateswork
restrictionsmaybereassignedorplacedonmedicalleave.Oncesuch
restriction(s)areliftedandtheindividualmaysafelyresumeallaspectsoftheir
assignedjobfunctionstheywillberestoredtotheirpriorposition.
29.
Iftheseproceduresarefollowed,theuseofprescriptionandnonprescriptiondrugs
inaccordancewiththedosageinstructionsshallnotbecausefordisciplineunder
thispolicy
30.
Testingforalcoholshallbedonebythetakingofsamplesofbreathorbloodfrom
theindividual.Ifbreathsamplesaretaken,thetestingshallbedonebyacertified
Alcotestoperator.Apositivebreathsampleshallbeconfirmedbyasecondbreath
sampleinaccordancewiththeproceduresestablishedforcertifiedAlcotest
operators.
a.
Bloodsampleswillonlybepermittedastestingforthepresenceofalcoholto
determineBACifthememberistransportedtoanareahospitalasaresultof
anondutyaccidentandisunabletoprovideabreathsample.
G.
Drug test results
1.
TheStateToxicologyLaboratoryshallnotifythesubmittinglawenforcementagency
oftestresultsfromthespecimenssubmittedforanalysis.Allreportsshallbein
writingandsenttotheagencywithin15workingdaysofthesubmission.
2.
TheStateToxicologyLaboratoryshallnotreportaspecimenashavingtested
positiveforacontrolledsubstanceuntilthespecimenhasundergoneaconfirmatory
testandthemedicalreviewofficerhasreviewedtheresultsofthattestwiththe
medicalquestionnairepertinenttothatspecimen.
3.
Thesubmittingagencyshallnotifytheapplicant,traineeorswornofficerofthe
resultsofapositivetestresultassoonaspracticalafterreceiptofthereportfrom
theStateToxicologyLaboratory.Uponrequest,theindividualmayreceiveacopyof
thelaboratoryreport.
4.
Undernocircumstancesmayanagencyoranindividualresubmitaspecimenfor
testingoraskthataparticularspecimenwithinthepossessionoftheState
ToxicologyLaboratoryberetested.
H.
Record Keeping
1.
TheInternalAffairsUnitshallmaintainallrecordsrelatingtothedrugtestingof
applicantsandemployeemembers.
2.
Therecordsshallincludebutnotbelimitedto:
a.
Foralldrugtesting:
(1)
theidentityofthoseorderedtosubmiturinesamples;
(2)
thereasonforthatorder;
(3)
thedatetheurinewascollected;
(4)
themonitorofthecollectionprocess;
(5)
thechainofcustodyoftheurinesamplefromthetimeitwascollected
untilthetimeitwasreceivedbytheStateToxicologyLaboratory;
(6)
theresultsofthedrugtesting;
(7)
copiesofnotificationstothesubject;and
(8)
foranypositiveresultorrefusal,appropriatedocumentationof
disciplinaryaction.
b.
Forrandomdrugtesting,recordswillalsoincludethefollowinginformation:
(1)
adescriptionoftheprocessusedtorandomlyselectofficersfordrugtesting;
(2)
thedateselectionwasmade;
(3)
acopyofthedocumentlistingtheidentitiesofthoseselectedfordrugtesting;
