Force Majeure. Neither party shall be considered in default in the performance of its
obligations under this Contract and/or either party may cancel without penalty by notice
to the other party without liability if such performance is prevented or delayed by Force
Majeure. "Force Majeure" shall be understood to be any cause which is beyond the
reasonable control of the party affected, including but not limited to, war, hostilities,
terrorism, revolution, civil commotion, strike, lockout, epidemic, accident, severe
weather, fire, wind or flood or any act of God. A party becoming aware of any Force
Majeure condition that may affect an Event shall seek to promptly give the other party
notice of such condition.
