Thisformshouldbesubmittedifyouareclaimingthatyourgasdispensingfacility

(GDF)isexemptfromPhaseIIvaporrecoveryrequirementsperBAAQMDRegulation8,

Rule7,Section112.9.



Applicability ThisexemptiononlyappliestoGDFsthat:

 Thevehiclesrefueledatthefacilityinanytimeperiodareownedbyacommon

operator;AND





90%ofthefleetiscomprisedofvehicleswithonboardrefuelingvapor

recovery(ORVR).



ExamplesoffacilitiesthatmayhaveGDFsthatserviceafleetofvehicles(common

operator)arecarrentalcompanies,taxicabcompaniesanddeliverybusinesses.



Determining

ORVRVehicles

ManufacturesstartedinstallingORVRinvehiclessince1998,butnotallatonce.

Usethehelpdocumentcalled“HowtoDetermineORVR”attheendoftheseinstructions

tohelpyoudeterminewhichvehiclesinyourfleetareclassifiedasORVR.Thetableis

has4columns;Vehicleclass,Non‐ORVRVehicles,ORVRPhase‐inModelYearsand

ORVRModelYears.

Youwouldneedtoknowthetypeofvehiclesinyourfleetandthevehicles’modelyear.

Foreachvehiclewithamodelyearduringthetransitionperiodfromnon‐ORVRto

ORVR,youwillneedtochecktheemissionlabel(tune‐uplabel)intheengine

compartment.



Determiningif

90%oftheFleet

isORVR

Examples:

 If90ormorevehiclesinatotalfleetof100areORVR,youqualifyforthe

exemption.(90÷ 100=0.90)

 If50vehiclesinatotalfleetof100areORVR,youdonotqualifyforthe

exemption.(50÷ 100=0.50)0.50islessthan0.90.


