Complete the application by properly typing in all the blanks and attaching all required
documents.
Submit the ORIGINAL APPLICATION with all original information requested PLUS the
FIFTEEN (15) COPIES
of all original documentation for individual consideration by each
board member. Identifying information (date of birth, social security number and account
numbers) may be redacted from the copies.
All applications must be submitted with the application fee of $500.00. Checks should be made
payable to El Paso County.
If you are submitting an application for license renewal, you must file the application not later
than the 31
st
day before the license expiration date. See Texas Occupations Code § 1704.162. It
is the responsibility of the license holder to apply for a renewal. If a renewal application is not
timely filed and the current license expires, the license holder shall not execute any bail bond
until a new license is issued. Application will be time/file stamped by the Bail Bond Board
Administrator and such stamp will serve as proof to the date and time the application was
received.
No application shall be deemed complete nor shall any license issued become effective until all
applicable provisions of the Texas Occupations Code, Chapter 1704 have been fully complied
with.

the author of the letter and their relationship to the applicant, and which meet the statutory

Photo of Applicant. If this is a renewal application of a current license, a photo currently on
file with the El Paso County Sheriff’s Office is sufficient.
G.
One full set of applicant’s fingerprints. If this is a renewal application of a current license,
the fingerprint card currently on file with the El Paso County Sheriff’s Office is sufficient.
H.
A completed agent background application provided by the El Paso County Sheriff’s Office.
I.
Designate the form of $50,000 security to be deposited with the El Paso County Auditor’s
Office if application is conditionally approved:

Proof of completion of at least eight (8) hours of continuing legal education in criminal law
courses or bail bond courses approved by the State Bar of Texas and offered by an accredited
institution of higher education in the state.

Submit documentary evidence that in the two years preceding the filing of this application,
applicant has been continuously employed for one (1) year by a person licensed under
Chapter 1704 of the Texas Occupations Code (example, W-2 forms or check stubs), and that
the applicant was required to work not less than thirty (30) hours per week (example, time
sheets), excluding annual leave, and perform duties in all phases of the bonding business
(example, job description).
L.
Applicant and Designated Agent must submit a letter declaring that the applicant will
comply with Chapter 1704 and the rules adopted by the Board. (Exhibit B)

M.
Properly filed “Power of Attorney” designated and authorizing the agent to execute bail
bonds for the corporation. This document must be on file with the County Clerk’s Office.
N.
Submit documentary evidence that the agent is a resident of the State of Texas (Example,
copy of lease, utility bill, Texas driver’s license, or voter registration card in the agent’s
name.).
O.
Submit documentary evidence that the agent is a U.S. citizen (Example, birth certificate or
current passport along with a copy of a government issued photo identification document. In
addition, proof of a consular report of birth abroad, certificate of naturalization/citizenship
along with a copy of a government issued photo identification document.) If this is a
renewal application of a current license, a copy of the proof of U.S. citizenship currently on
file with the El Paso County Sheriff’s Office is sufficient.
P.
If this is a renewal, documentary evidence that certificate of deposit pledged to El Paso
County is current (Example, bank statement update or safekeeping receipt).
Q.
If applicant intends to use real estate as security, the application must include a statement
listing all nonexempt real estate owned by the applicant which is intended to be conveyed in
trust to the El Paso County Bail Bond Board as security upon tentat
ive approval of the
application. The following shall be included for EACH parcel:
(1) Certified copy of Warranty Deed on property pledged.
(2) Mortgagee Title Insurance Property on property pledged obtained within the last ninety (90)
days of filing, stating that there are no liens.
(3) Current statements from every taxing unit with power to assess or collect taxes against the
property indicating there are no unpaid taxes or outstanding tax liens on the property.
(4) A sworn statement from the applicant agreeing to keep all taxes paid on the property while
it remains in trust.
(5) A sworn statement from the applicant agreeing not to further encumber the property after
conveying it in trust to the El Paso County Bail Bond Board.
(6) A sworn agreement from the applicant that the applicant fully insure and keep current the
insurance on the property including all improvements against any damage or destruction for
the full amount of the value claimed for the property and all improvements, while the
property remains in trust.
(7) A current appraisal made in accordance with Texas Occupations Code § 1704.155(3).
(8) A sworn statement from applicant’s spouse, if any, agreeing to transfer to the El Paso
County, as part of the trust, any right, title, or interest that the applicant’s spouse may have
in the property, and that the applicant’s spouse will execute deed of trust to any community
property placed in the security deposit.

(9) Documentation of insurance on the property listing the name of the insurance company to
confirm that the property is properly insured. Along with insurance policy showing El Paso
County as additional insured. This should include a copy of the fire and extended coverage
insurance policy on the property pledged showing that the improvements are covered to the
minimum amount of eighty percent (80%) of appraised amount.

destruction in full amount of value claimed for improvements.
e.) I agree to name El Paso County Bail Bond Board as the beneficiary on the insurance
policy for improvements, and to provide proof of insurance upon granting of the
license, or any time upon requested of the Board.
f.) If the application is approved, I understand that no later than the 90

with an appraised value of all property combined and totaling not less than
$50,000.

After hearing under 1704.158, the board shall enter an
order conditionally approving application unless
grounds exists to deny application. If grounds exist
to deny, the board shall enter an order denying the
