This completed document must accompany all contracts and Purchase Orders for EIT products and services per UPP ACCESSIBLE TECHNOLOGY
ADDENDUM
THIS ADDENDUM TO THE (Name of Agreement) is entered into by
and between Marquette University (hereafter “Marquette) and
(hereafter “Supplier”) on the latest date set forth, below, witnesseth:
WHEREAS, the parties hereto have entered into an agreement for the purchase of (Enter Brief Summary of
Agreement/Product/Service)
(hereafter referred to as the “Agreement”); and
NOW, THEREFORE, it is understood and agreed upon by the parties hereto as follows:
1) Both parties acknowledge that the University is committed to purchasing or recommending electronic and
information technology (EIT) that provides the same programs, benefits and services that they do to individuals
without disabilities except when it is technically unfeasible to do so. Electronic and information technology
(“EIT”) is information technology and any equipment or interconnected system or subsystem of equipment that is
used in the creation, conversion, or duplication of data or information. EIT products and services includes, but is
not limited to, the following:
· Telecommunications products, Information kiosks, Automated teller machines, Internet and intranet websites,
Electronic books and electronic book reading systems, Search engines and databases, Course management
systems, Classroom technology and multimedia, Personal response systems (“clickers”), Office equipment
2) For web-based EITs, Supplier represents and warrants that products provided under this Agreement conform to the
W3C Web Content Accessibility Guidelines, version 2.0 (WCAG 2.0) at conformance levels AA and that such
conformity will continue for the duration of the agreement. In the event products provided under this Agreement
do not fully conform to WCAG 2.0 AA, supplier must advise Marquette in writing of the nonconformance and
must provide detailed information regarding the plans to achieve conformance including, but not limited to, an
intended timeline for conformance.
3) For non-web based EITs, Supplier represents and warrants that the products or services to be provided under this
contract comply with the accessibility requirements of section 508 of the Rehabilitation Act of 1973, as amended
(29 U.S.C. 794d), and its implementing regulations set forth at Title 36, Code of Federal Regulations, Part 1194.
Supplier agrees to promptly respond to, and resolve, any complaint regarding accessibility of its products or
services.
4) If any term in this addendum conflicts with a term in the above-referenced Agreement, the term in this addendum
shall control.
5) All other terms in the Agreement, and any other addenda, shall remain the same.
IN WITNESS WHEREOF, the parties have caused this Addendum to be executed in their respective corporate names
by authorized signatories on the day and year first set forth above.
