The undersigned Renter, hereby agrees to the use of City of Clear Lake Shores (the “City) city
property and known as Captains Corner Park, East Parking Lot, West Parking Lot (circle
one). This agreement only allows for temporary use of the facility, Representative agrees to the
following.
The RENTAL FEE shall be $_______ for the time period from 8:00 a.m. until _______ p.m.
(Monday thru Saturday or for the time period of 10:00 a.m. thru 6:00 p.m. on Sunday).
A Security Deposit in the amount of $ will be paid to the City. The Security
Deposit shall
be used by the City to pay for any clean-up, or used to repair, replace, or pay for
any damage or loss to the building, grounds, or furnishings of the facility, which are damaged
or destroyed by the Renter or any participant at the event. The City may hold such deposit for
such period of time as is necessary to determine the full extent of damages and to make all
repairs and/or secure replacements. The City Secretary or her agent must approve the clean-
up, repair or replacement before the refund can be made, then only after ten (10) days of the
date of the rental.
RENTER AGREES TO INDEMNIFY AND HOLD HARMLESS THE CITY
OF CLEAR LAKE SHORES FROM AND AGAINST ANY AND ALL
CLAIMS, LAWSUITS, DAMAGES OR CAUSES OF ACTION OF ANY
NATURE WHATSOEVER, FOR INJURY OR LOSS OF LIFE, OR
DAMAGE TO OR LOSS OF PROPERTY BY ANY PERSON
WHATSOEVER, RESULTING FROM OR ARISING OUT OF THE USE OF
OCCUPANCY OF THE PREMISES BY THE RENTER, ITS AGENTS,
EMPLOYEES, LICENSES, OR INVITEES HEREUNDER.
Renter has fully inspected the premises, and the same are accepted on an “as is” basis. The City of
Clear Lake Shores EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, IMPLIED OR
OTHERWISE, with respect to the premises, save and except warranties of title and peaceable
possession..
Renter represents and certifies that:
1. All information provided in this application is true and correct.
2. Misrepresentation or erroneous information in this application constitutes grounds for
denial of future applications and use.
3. Renter shall not use the premises for any unlawful or illegal purposes.
4. Renter is at least 21 years of age for this application to be considered.
5. Renter agrees to use care and diligence in the use of the premises. Rental will bear all
cost of clean-up and damage; failure will result in loss of deposit and possible further
charges incurred by the City. ______ (initials)

9. If Renter is an organization, the person or individual signing on behalf of the
organization agrees to be personally responsible to the City of Clear Lake Shores, Texas,
for any damages to the building, grounds, or for any damage to or loss of furniture or
equipment.

Agreement”, as approved and adopted by the City Council.

COVID-19 Notice to City Facility Users

You are receiving this notice because you have voluntarily reserved and/or rented an outdoor or indoor City facility
for your private use.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization.
The federal, state and local governments have declared emergencies and issued public health directives and
guidance related to COVID-19.
The City has adopted cleaning protocols to prevent the spread of COVID-19 within indoor facilities. The protocols
and resources available for outdoor facilities will be more limited, due to the nature of the facilities and the
public’s general use of the facilities. If you would like to know the protocols specific to the facility that you are
using, please contact the City at (281) 334-2799.
In addition, the City strongly encourages all facility users to comply with the CDC’s personal hygiene
recommendations:

The following regulations apply to your reservation and/or rental agreement for the facility:
You are solely responsible for ensuring how your private use will meet applicable public health
directives in effect at the time of your event. Public health directive includes state laws, rules,
regulations and executive orders; federal laws or regulations including those from the CDC and OSHA,
and any local health order.
You are solely responsible for informing your event attendees of any applicable health directives or
personal hygiene recommendations that apply to their attendance.
During your private use, the City cannot provide employees to monitor or enforce compliance with
applicable public health directives or personal hygiene recommendations. You are solely responsible
for monitoring and enforcement.
The City cannot guarantee that you or your event attendees will not become infected with COVID-19
from your reservation, rental or use of a City facility. You should inform your event attendees of the
COVID-19 risks associated with your private use.
Both parties hereby voluntarily and expressly agrees to defend and hold harmless each other and its affiliates and each
of their respective families, owners, agents, representatives, employees and contractors from and against any claim,
demand, cause of action, suit or other proceeding arising from or relating to exposure, infection, and/or spread of
COVID-19 while using the City’s Facility.
The Renteragrees that they will follow COVID-19 guidelines and precautions that are in effect during the time they
use the facility. This includes wiping down (with appropriate cleaners/sanitizers) all community areas, such as
restrooms, light switches, doorknobs, controls for appliances in addition to the normally expected cleaning activities.
