BastropCounty,hereinaftercalledthe“County”and _hereinaftercalledthe“Participant”
recognizetheneedanddesirabilityoflitter‐freeCountyroadsandareenteringintothisAgreementtopermittheParticipantto
contributetowardtheeffortofmaintaininglitter‐freeCountyroads.
TheCountyagreestoaccomplishthefollowing:
•
Erectatleasttwo(2)signs,oneoneachend,ontheadoptedsectionwiththeGroup’snameoracronymdisplayed.
•
Providesafetyinformationliterature,trashbags,trafficcontrolsigns,andsafetyvests.
•
Removefilledlitterbagsfromtheadoptedsectionandwillremoveanylarge,heavyorhazardousitems.
Bysignaturebelow,theParticipantanditsmembers,bothjointlyandseverally,acknowledgesthehazardousnatureofthework
andagree,bothjointlyandseverally,tothefollowingtermsandconditions:
•
Participantsagreetoabidebyalllawsandregulationsrelatingtosafetyandsuchothertermsandconditionsasmaybe
requiredbytheCountyforspecialconditionsofaparticularadoptedsection.
•
Furnishadequatesupervisionbyone(1)ormoreadultsforminorvolunteersofaparticipatinggroupwhoare15yearsof
ageorolder,withatleastone(1)adultforeverythree(3)childrenwhoare10to14yearsofage.Childrenundertheageof
10maynotparticipateintheProgram.
•
TheParticipantwillconductasafetymeetingwitheveryindividualpriortoeachpickupday.Participantsmustattenda
safetymeetingconductedbytheParticipantbeforeparticipatinginacleanup.
•
TheParticipantswillpickuplitteraminimumof2timesperyearatstaggeredintervalsandatsuchadditionaltimesas
requiredbytheCountyCommissioner. Itisdesiredthatone(1)ofthesepickupsoccurduringtheStateannualTrash‐Off
eventeachAprilorduringthefirstweekinAprilandone(1)ofthesepickupsduringthefirstweekofSeptember.
•
TheParticipantsasawholeandeachindividualauthorizedfortheactivityagreestoacknowledgethattheCountyis
generallyprohibitedbylawfromexpendinganyfunds,directlyorindirectly,forthepurposeofinfluencingthe
outcomeofanyelectionorthepassageordefeatofanylegislation.
•
TheParticipantswillhavetheoptionofrenewinganagreementsubjecttotheapprovaloftheCountyCommissionerof
theprecinct.
•
TheParticipantswilladvisetheCountyCommissioneroftheprecincteachtimethatlitterhasbeenpickeduponthe
adoptedroad.
•
TheParticipantswillnotassignitsresponsibilitiestoanyothergroup.
•
TheParticipantswillappointanauthorizedrepresentativeandanalternatetoserveasspokespersonfortheGroup.
•
TheParticipantswillobtainrequiredsuppliesandmaterialsfromtheCountyduringregularbusinesshours.
•
TheParticipantswillassurethattrafficcontrolsignsaresetupbeforecleanup,duringcleanupandremovedaftercleanup.
•
IndividualswillwearCountyfurnishedsafetyvestsduringtrashcleanup.
•
TheParticipantswillberesponsibletoplacelitterintrashbags,placetrashbagsinanapprovedarea,andBastropCounty
willmakearrangementstodiscardatanapproveddisposalsite.
•
TheParticipantswillreturnunusedmaterialsandsuppliestotheCountywithintwo(2)businessdaysfollowingeachcleanup.
•
TheParticipantswillneitherpossessnorconsumealcoholicbeveragesorillegaldrugswhileontheadoptedsection.
•
TheParticipantswillmaintainafirst‐aidkitandadequatedrinkingwaterwhileontheadoptedsectionofroad.
TheParticipantsagreeifanyactionsbytheParticipantsrelativetotheperformanceofthisagreementaredeterminedtobecontrary
toanylegislativerestrictionsoranyrestrictionsontheuseofappropriatedfundsforpoliticalactivities,theCounty,atitssole
discretionwilltakeanyandallnecessaryactions,including,butnotlimitedto,theremovalofsignsdisplayingtheParticipantsname
oracronym.
TheParticipantsacknowledgethattheCountywillremoveasignwhichisdamagedduetovandalism,andwillnotreplacethesign
withinthetermsoftheagreementunlesstheParticipantsremitstotheCountyanamountequaltothecostofthereplacementsign.
IftheCountyundertakesaconstructionprojectonanadoptedsection,theParticipantsmaysuspenditsagreementorchooseanew
sectiontoadoptforthedurationoftheconstructionproject.
IfinthesolejudgmentoftheCountyCommissioneroftheprecinctitisdeterminedthattheIndividualorParticipantsarenot
meetingthetermsandconditionsoftheagreement,theCountymayterminatetheagreementandremovethesign(s)upon30days’
notice.
ThisagreementmaybemodifiedinanymanneratthesolediscretionoftheCounty.TheCountyreservestherighttoterminateor
revisetheProgramatanytimeandforanyreasonatthesolediscretionoftheCounty. TheCountyandtheParticipantboth
recognizeandagreethatinnoeventshalltheCountyhavetherighttocontroltheParticipantinperformingthedetailsofpickingup
litterfromthesectionofCountyroadadoptedbytheParticipant,and,inpickinguplitter,theParticipantsshallactasan
independentcontractor.
