APPLICABILITY.ThischecklistshouldbeusedwhensubmittinganapplicationforanLDRTextAmendment.ThepurposeofanLDR
TextAmendmentistopubliclyreviewachangetotheLDRstoensurethatitimprovesimplementationoftheJackson/Teton
CountyComprehensivePlan.
WhenisanLDRTextAmendmentapplicationrequired?
AnLDRtextamendmentapplicationisneededforanyproposalthatinvolveschangestothelanguageintheLDRs.
DoIneedaPreApplicationConferencefirst?
APreApplicationConferenceisnotrequiredpriortosubmittal,butan
applicantmayrequestapreapplicationmeetingtodiscuss
the requirements and applicable regulations with PlanningStaff. This is encouraged for applicants who are unfamiliar with the
regulationsandtheplanningprocess.IfaPreApplicationConferenceisheld,thischecklistmaybemodifiedbystafftoreflectthe
specificsof
yourproject.
POSTEDNOTICE.Theapplicantisresponsibleforpostingandmaintaininganoticeofthepublichearingonthelandsubjecttothe
application.Thepostednoticeshallmeetthefollowingstandards.
Content. The posted notice shallcontain the notice contentrequired by Subsection 1 above, except the description of the
locationofthelandsubjecttotheapplication.AtemplateisavailableintheAdministrativeManual.
Timing.Thenoticeshallbe
postedforatleast10dayspriortothehearing,andshallberemovedwithin5 daysfollowingthe
hearing.
Size.Thenoticeshallbe4ftby4ft.
LocationandLegibility.Anoticeshallbeplacedalongeachfrontlotlinesoastobelegible
fromeachaccesspointtothesite.
Thenoticemaybemountedto abuilding.Ifthenoticeisfreestanding,itshouldbesetback2 ftfromanylot lineoraccess
easement.
Materials.ThenoticeshallmeetthematerialsstandardsofDiv.5.6.andshallnotbelighted.
FINDINGSFORAPPROVAL.TheapplicationshallincludeanarrativestatementaddressingeachoftheapplicableFindings,found
inSection8.7.1,LDRTextAmendment.
The advisability of amending the text of these LDRs is a matter committed to the legislative discretion of the Board of County
Commissionersandisnotcontrolledbyanyonefactor.IndecidingtoadoptordenyaproposedLDRtextamendmenttheBoard
ofCountyCommissionersshallconsiderfactorsincluding,butnotlimitedto,theextenttowhichtheproposedamendment:
1. IsconsistentwiththepurposesandorganizationoftheLDRs;
2. ImprovestheconsistencyoftheLDRswithotherprovisionsoftheLDRs;
3. Providesflexibilityforlandownerswithinstandardsthatclearly
definedesiredcharacter;
4. Isnecessarytoaddresschangingconditions,publicnecessity,and/orstateorfederallegislation;
5. ImprovesimplementationoftheComprehensivePlan;and
6. IsconsistentwithotheradoptedCountyResolutions.
