CONDITIONS OF LICENCE
Under The Highways Act 1980 Section 139, 140 & 140a
1. General.
In accordance with Section 139 of The Highways Act 1980, a site cabin or storage container cannot be
deposited on the public highway without the permission of the Highway Authority, in this case Bolton Council. If
permission is granted to deposit a site cabin or storage container on the public highway, it will be given on the
understanding that the site cabin or container company or operator complies fully with the requirements of
Section 139 of The Highways Act 1980, along with the conditions set out within the Council’s ‘Code of Practice
for the Placing of Skips on the Highway’ 4th Edition, which are outlined below.
2. Siting.
a) A site cabin or storage container shall be placed with its longer side parallel and near to the edge (channel) of
the carriageway.
b) Where more than one site cabin or storage container is deposited on the highway at any one time, the site
cabin or storage containers shall be deposited as closely as possible to each other.
c) Site cabins or storage containers shall not be deposited on adopted footways without prior agreement.
3. Dimensions.
Normally only site cabin or storage containers measuring less than 3 metres in length by 2 metres in width will
be suitable for use on the public highway. Site cabin or storage containers with dimensions larger than 5 metres
in length by 2 metres in width will not be permitted without express approval, this also includes enclosed
containers.
4. Colour & Markings.
a) The ends of each site cabin or storage container shall be fitted with vertical markings in accordance with ‘The
Builders Skips (Markings) Regulations 1984’.
b) The site cabin or storage container shall be indelibly marked with the owner’s name, and telephone number.
5. Lighting & Guarding.
a) Each site cabin or storage container shall be guarded by 3 traffic cones in an oblique line on the approach
side of the skip or container. Where two or more skips are less than 2 metres apart they shall be guarded as on
site cabin or storage container.
b) During the hours of darkness a warning lamp shall be placed on each corner of the site cabin or storage
container (or end corners for more than one cabin or container) and a warning lamp between each pair of cones
on the approach.
6. Care & Disposal of Contents.
a) No site cabin or storage container, whilst deposited on the public highway, shall contain any inflammable,
explosive, noxious or dangerous material or any material likely to putrefy, or which otherwise is, or is likely to
become a nuisance to users of the highway.
b) All reasonable care shall be taken to prevent materials from spilling out of the site cabin or storage container,
any overspill shall be immediately removed from the highway and measures taken to prevent dust pollution.
c) No site cabin or storage container shall remain on the public highway outside the specified period of
permission on the licence.
d) Upon removal of the site cabin or storage container the public highway shall be left in a clean and tidy
condition.
7. Public Liability Insurance.
The site cabin or storage container owner or operator must be covered by Public Liability Insurance which
should be available for inspection, minimum cover to be £3 million. Such insurance must indemnify the Highway
Authority from and against all actions, claims, losses and expenses whatsoever in respect of personal injury or
damage to property, however, caused, arising out of or in any way attributed to the presence of the applicants
builders skip or enclosed container.
Important Reminder
A site cabin or storage container shall not be deposited on the public highway without prior permission from the
Highway Authority, as retrospective permission may not granted. All licence conditions must be fully complied
with at all times, failure to comply may result in the permission being revoked and the removal of the site cabin
or storage container and possible further legal action.
Warning
If during the hours of darkness, a site cabin or storage container is reported or found unlit, Bolton Council, as
Highway Authority, may light and guard the site cabin or storage container and recover all reasonable costs
from the site cabin or storage container owner or operator.
