and any other facility on the property. Include all existing structures on the site plan drawing.
Applicant is free to use a different format for the site plan if it is preferred.
EXHIBIT A
Fort Lupton Municipal Code
Section 7-167. Backyard Chickens.
It shall be unlawful to place or maintain backyard chickens in any area of the City unless the following
conditions and requirements are met:
(a) Backyard chickens, chicken coops, and chicken runs are allowed as an accessory use only in
conjunction with an established single-family residence. No backyard chickens, chicken coops, or chicken
runs shall be located in common areas of a multi-unit, multi-use or multi-family property, or any property
owned or leased by the City.
(b) All backyard chicken uses and facilities shall require a permit to be obtained from the City prior
to maintaining backyard chickens on any property. The permit application process is described in
paragraph (q) of this Section.
(c) No more than six (6) backyard chickens are permitted per established single-family residence.
(d) Roosters are prohibited.
(e) Other poultry or fowl are prohibited. No person may own or keep peacocks, pigeons, turkeys,
ducks or other like fowl.
(f) Water shall be provided onsite and accessible to chickens at all times.
(g) Chicken feed shall be stored in a resealable, airtight, predator-proof container. Spillage and
leftover feed must be removed daily.
(h) Chicken waste shall only be stored in a resealable, airtight, predator-proof container.
(i) On-site slaughtering of backyard chickens is prohibited.
(j) Any animal that attacks, injures or kills a backyard chicken not on the permitted property shall
not be deemed an “animal that creates a danger” and the owner of such an animal shall not be charged
with violating any provisions of Section 7-153 of the Code.
(k) During daylight hours, backyard chickens shall have access to a chicken run that is adequately
fenced and protected from predators and shall also have access to the chicken coop.
(l) From dusk until dawn, backyard chickens shall be protected from predators by being enclosed
within a chicken coop.
(m) At no time are backyard chickens permitted to move around freely on a property outside of a
chicken coop, chicken run, or other facility.
(n) No backyard chickens, chicken coops, chicken runs, or other facilities shall be allowed in the front
yard of a property at any time.
(o) It is required that a chicken coop and chicken run be constructed on any property approved for
a backyard chicken permit. The chicken coop and chicken run must meet the following conditions and
requirements:
(1) The chicken coop and chicken run shall be located in the rear or backyard of the principal
structure. Neither the chicken coop nor chicken run shall be located between the rear of the principal
structure and the front yard line.
(2) The chicken coop shall have a minimum five (5) feet setback from any side or rear property
line.
(3) The maximum chicken coop size permitted is 120 square feet.
(4) A minimum of four (4) square feet of space per chicken shall be provided in the chicken coop
and chicken run.
(5) The maximum height of a chicken coop shall be no more than seven (7) feet at the highest
point of the roof.
(6) Chicken coops shall be predator resistant with a solid covered roof.
(7) Chicken runs shall be fenced and provide adequate protection from predators.
(8) Chicken coops and chicken runs shall be maintained and shall be regularly cleaned to control
dust, odor, and waste and not constitute a nuisance, safety hazard or health problem to surrounding
properties.
(9) The location of the chicken coop and chicken run in relation to the principal structure, and
any other structures on the property, shall be illustrated on the application during the permit
application process described in paragraph (q) of this Section.
(p) Many homeowner association bylaws do not allow backyard chickens. It is the responsibility of
the applicant to confirm that any homeowner association bylaws applicable to the property do not
disallow backyard chickens prior to submitting an application to keep backyard chickens.
(q) Backyard chicken permit application process:
(1) Applicant must submit a completed backyard chicken permit application provided by the City.
(2) Applicant must pay a $30.00 application fee that is non-refundable and nontransferable.
(3) Applicant must provide proof of ownership of the property prior to being issued a permit.
(4) Applicant must provide a site plan showing the location of any proposed chicken coop,
chicken run and existing structures on the property at the time of submitting the backyard
chicken application.

(5) After the backyard chicken permit application and application fee are received by the City,
the applicant must schedule an inspection of the chicken coop and chicken run by a
designated employee of the City to ensure it complies with the requirements set forth in
paragraph (o) of this Section.
(6) Once the backyard chicken permit application and fee is submitted, and the chicken coop and
chicken run are found to comply with paragraph (o) of this Section after inspection by a
designated employee of the City, the applicant will be issued a nontransferable backyard
chicken permit.
(r) A backyard chicken permit may be revoked at any time by the City’s code enforcement officer
should it be determined that the use is not being operated in a safe and clean manner or is not in
compliance with this Section of the Code.
