The State of California requires certain criteria be met before a student may be classified as a resident
for enrollment purposes.
ESTABLISHING CALIFORNIA RESIDENCY
Physical Presence in California:
The following criteria apply in proving physical presence in California:
Individuals 18 years and older must be a U.S. citizen who has lived in California for one year and one day
prior to the first day of instruction of the semester for which classification is requested.
Individuals under 18 years of age must be a dependent of a California resident who has resided in California

r one year and one day prior to the first day of instruction of the semester for which classification i

requested.
NOTE: Non U.S. Citizens
Non-U.S. citizens will be evaluated for residency based on immigration status as permanent residents or on the
type of visa held, length of stay in California, and intent to maintain California as a permanent home. Students on
B, C, D, F, H-2, H-3, J, M, O-2, P, or Q visas and students not in the United States legally are precluded from
establishing residency.
Intent to Remain in California
Individuals requesting classification as a California resident must also show intent to maintain California as a
legal residence. Just being present within the state does not show intent to become a resident. Objective
manifestations of intent to establish California residence include, but are not limited to:
California State income tax returns with
California address
Federal income tax returns with California

Documentation of entry into a legal agreement
in California(i.e., marriage, divorce)
Documentation of California as home state of
record as required by the military
License from California for a professional
practice
California voter registration
Current W-2 form showing California address

NOTE: You will need two items form the above list. One dated one year and one day prior to the
start of the semester in which you plan to enroll, and one dated currently. All items submitted
should be in your name with a California address, unless you are submitting tax forms showing you
as a dependent.

Financial Independence:
Individuals requesting classification as a resident may be required to demonstrate financial independence for the
current and immediately preceding calendar year. Should Antelope Valley Community College require proof of
financial independence, both a notarized student and parent affidavit will be required to prove that the individual
requesting classification:
1) H
as not been claimed as an exemption for state and federal tax purposes by his/her non-
resident parents,
2) Has not received more than $750 from his/her non-resident parents within the current and
immediately preceding calendar year, and
3) Has not lived in the home of his/her non-resident parents for more than six weeks within th
e
cu
rrent and immediately preceding calendar year.
NOTE:
A student who has not been a resident of California for more than one year and who is the dependent child of a
California resident who has been a resident for more that one year prior to the residence determination date is
entitled to resident classification. A dependent child is one who has been claimed as a dependent for income tax
purposes.
Military Personnel and/or Dependents:
Antelope Valley Community College will classify servicepersons who are not California residents, but are stationed
in California on active military duty, as a resident, for as long as they are on active duty. A current military I.D.
will verify the student’s status on a semester-by-semester basis.

ependents of servicepersons will be classified as a resident, for a period of one year from the date of the
dependent’s entry into California.
Dependents will lose resident status one full year after date of entry into California unless permanent residence in
California has been established and can be documented. To establish California residency, the student must prove
physical presence in the state of California for one year prior to the residency determination date and show intent to
maintain California as his/her legal state of residence.
