About This Packet: If a guardian no longer wants to serve as the guardian, the guardian can
ask the court to resign. Someone else must be willing to take over as guardian. This can
be a co-guardian who will continue, or someone new who wants to petition to become
the new guardian. A new guardian will have to fill out a separate packet asking to be
appointed.
The Protected Person, their Attorney, and the Relatives Have to Be Notified: After
you file the papers, you will have to send a copy to the protected person, their
attorney, and the same relatives who were served with the original guardianship
papers.
Use black ink and write clearly.
Petition to Resign as Guardian
This form tells the judge and all of the parties why the guardians want to resign. You
must explain in detail why you want to resign, and who will act as the guardian in the
future.
Notice of Hearing
This form sets a court date for the judge to review your request. Leave the hearing
date lines blank – the clerk will fill in a date when you file the papers.
Accounting – not included, ask staff for the form if needed
If you are the guardian over the estate who is required to file annual accountings, and
there is not a co-guardian who will continue, you will have to file an accounting listing
all the protected person’s income, expenses, and assets.
Note:
If someone else plans to petition to be appointed as the new guardian, it is a
good idea to file your resignation documents and the other person’s
appointment documents at the same time. This makes sure that both requests
can be set for the same court date.

Make Copies: Make enough copies of the forms you filed to serve on everyone listed below.
Send a Copy of the File-Stamped Forms to all necessary people:
The protected person;
The protected person’s attorney;
The guardian(s) (if you are not the guardian);
All of the relatives who are entitled to notice of the guardianship proceedings
(usually the same people who were served with the original guardianship papers).
How to Serve: Usually, you can send the documents by regular mail (not certified). If any other parties
have registered for e-service, you can e-serve it through your e-filing account at the time you file.
When to Serve: Serve the documents within three days after filing.
This form tells the Court when, where, and how you served the documents.
If you are going to serve other parties the same day you file your documents, you can
fill this form out and file it at the same time you file your other documents.
File this form. If you do not, the judge may cancel your hearing.
Before the Hearing: Make sure you file the Certificate of Service showing who was served with the
court papers. Make plans to appear by phone or video if possible (request forms here:
https://www.familylawselfhelpcenter.org/self-help/guardianship/guardianship-forms#misc).
Or, arrive at least 20 minutes early to allow enough time to park, get through security, and find
the courtroom.
During the Hearing: The protected person, their attorney, the guardian, and any relatives can attend
the hearing. They will be able to object to your request if they wish.
After the Hearing: The judge may tell you to prepare a written order from the hearing. If so, the order
form is included at the end of this packet. You will have to send the filed order to the required
people afterwards; fill out the Notice of Entry of Order and file it after serving the order.
